Hodie 1a vice lecta est Billa, intituled, "An Act to enable Jane Rogers, the Widow and Relict of Bryan Rogers, late of Falmouth, Merchant, deceased, and Administratrix of his Goods and Chattels, with his Will annexed, and other Trustees therein named, to sell Lands, for the Payment of the Debts and Legacies of the said Brian Rogers, in Performance of his said Will."
Rex versus Tucker, in Error.
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Errors argued, upon the Writ of Error depending in this House, wherein Their Majesties are Plaintiffs, and Reginald Tucker Defendant, on Monday the One and Twentieth Day of this Instant January, at Ten of the Clock in the Forenoon.
Gibson versus Symonds.
Upon reading the Petition of Richard Gibson; praying, "That Richard Symonds (who hath an Appeal depending in this House, to which the Petitioner is Respondent) may give sufficient Security to pay Costs, in case this House shall affirm the Decree complained of; the said Symonds having formerly absconded in White Fryers, and is now actually a Prisoner in The Fleete; and that, in Default thereof, the Petition of Appeal may be dismissed:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Richard Symonds shall and he is hereby required, on or before Monday the One and Twentieth Instant, to enter into a Recognizance of One Hundred Pounds, with Two sufficient Sureties, to pay such Costs as this House shall think fit to give, if the said Decree shall be affirmed.
Hitchins versus Ballet, in Error.
This Day the Lord Chief Justice of the King's Bench, in the usual Manner, brought in a Writ of Error:
John Hitchins Plaintiff, and William Basset Defendant.
Hare's Bill.
Hodie 2a vice lecta est Billa, intituled, "An Act for the better enabling the Executors and Trustees of Sir Thomas Hare Baronet, lately deceased, to raise Portions and Maintenances for his Younger Children."
ORDERED, That the Consideration of the said Bill shall be committed to the Lords following; (videlicet,)
Their Lordships, or any Five of them; to meet on Monday next, at Nine of the Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.
Bp. of London and Dr. Birch versus Regem, in Error:
After hearing Counsel to argue the Errors assigned upon a Writ of Error, brought into this House the Fourth Day of December, One Thousand Six Hundred Ninety-four, from His Majesty's Court of King's Bench, wherein Judgement is entered for Their Majesties King William and Queen Mary, against the Bishop of London and Dr. Birch:
Judgement affirmed.
After due Consideration had of what was offered thereupon, it is this Day ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement given in the Court of King's Bench for Their Majesties, against the Bishop of London and Dr. Birch, shall be, and it is hereby, affirmed.
The Tenor of which Judgement, to be affixed to the Record to be transmitted, followeth; (videlicet,)
