Pardon for Felony, Bill to repeal the Act for finding Sureties for.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House shall be put into a Committee, upon the Bill, intituled, "An Act to repeal a Statute made in the Tenth Year of King Edward the Third, for finding Sureties for the good Abearing of him or her that hath a Pardon of Felony," on Wednesday the Fourteenth Day of this Instant February, at Eleven of the Clock.

Simonds & al. concerning Prisoners, Bill.

Upon reading the Petition of Michael Symonds, Richard Oakely, Thomas Jordan, Samuell Sheppard, Daniel Wright, and John Greenc, on Behalf of themselves and many others, Creditors of divers Persons now Prisoners in The King's Bench, Fleet, and other Prisoners; praying to be heard, to the Bill, intituled, "An Act for the explaining and for the more effectual Execution of a former Act for Relief of poor Prisoners:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioners shall be heard, by their Counsel, as desired, To-morrow, at Eleven of the Clock in the Forenoon.

Then the Clerks gave the House an Account of what they found, pursuant to the Order Yesterday, concerning Messages to or from either House.

Which were read, as followeth; (videlicet,)

"9th May, 1679."

Then the Paper delivered to the Commons at the Conference, the Sixteenth of January last, was read.

Whereupon the following Committee was named:

Lords Committees appointed to draw, upon the Debate this Day, what shall be offered at a Conference with the House of Commons, in relation to what was delivered to them the Sixteenth of January last.

Committee to prepare Heads for a Conference concerning Intelligence about the Sailing of the Brest Fleet, delivered formerly to H. C. at a Conference:

The House was adjourned during Pleasure, and the Lords withdrew, to draw what was to be offered at the Conference with the Commons.

And after some Time, the House was resumed.

Report of the Heads.

And the Earl of Rochester reported what was to be offered to the Commons, at the Conference, as followeth; (videlicet,)

"The Lords are to acquaint the Commons, that, having on the Sixteenth Day of January last communicated to them, at a Conference, that the Lords having had laid before them, by the Earl of Nottingham, an Extract of a Letter, dated from Paris, June 1st, N. S. received May 30th O. S. 1693, as followeth;

"There are 68 Ships, in which there are 30,118 Men and 4,876 Guns. We have News since, that this Fleet is sailed, and was out of Sight:

"And whereas, upon an Address to the King, such Lords as are of the Privy Council had Permission from His Majesty, to acquaint this House when the Intelligence of the French Fleet's sailing from Brest was communicated to the Admirals of the Fleet: Several of those Lords did thereupon inform the House, that the Letter mentioned by the Earl of Nottingham was laid before the Committee of Council; and took it for granted, that the Intelligence therein contained was sent to the Admirals of the Fleet: But, it not appearing clearly whether it was so communicated or not, this House does desire of the House of Commons, that they will enquire, by the most proper Methods, of the Members of their House that are of the Privy Council, whether this Intelligence of the French Fleet's being sailed out of Brest was communicated to the Admirals of the Fleet, and when it was so communicated.

"Upon which, their Lordships hoped that some further Information might be had, by those that are of the Privy Council in that House, in order to the Discovery of the Causes of some of the Miscarriages in the last Summer's Expedition at Sea. But their Lordships, not having yet heard any Thing from the House of Commons concerning this Matter, have thought fit, at this Conference, to remind them of it, as a Business the Lords conceive to be of great Consequence, and fit to be enquired into."

To which the House agreed.

E. of Montagu & al. versus E. of Bath & al.

This Day the House proceeded, and heard Counsel further upon the Appeal of the Earl of Montagu and others, against the Earl of Bathe and others Respondents.

And, the Counsel being withdrawn; at the Request of both the Earls concerned therein, "That the further Hearing of Counsel in this Cause may be put off until Friday next;" it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear Counsel further in the said Cause, on Friday next, at Eleven of the Clock in the Forenoon.

Adjourn.
