Simmons versus Grant & Ux.

Upon reading the Petition of Elizabeth Simmons, Executrix of Sir Ralph Bovey Baronet, deceased, from a Decree made in the Court of Exchequer, the Eleventh Day of May last past, in a certain Cause there depending, between Thomas Grant and Bridgett his Wife Plaintiffs, against the said Elizabeth Simmons Defendant; and praying, "That the said Thomas Grant and his Wife may answer thereunto; and that, in the mean Time, all Proceedings may be stayed:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Thomas Grant and Bridgett his Wife may have a Copy of the said Petition; and do and they are hereby required to put in their Answer thereunto, in Writing, on Friday the Four and Twentieth Day of this Instant November, at Ten of the Clock in the Forenoon: And it is further ORDERED, That, in the mean Time, all Proceedings shall be stayed in the Courts below.

Zouch versus English.

Upon Report from the Lords Committees, to whom was referred the Petition and Appeal of James Zouch Esquire, from a Decree made in the Court of Chancery, the Sixteenth Day of April, in the Fourth Year of the Reign of Their present Majesties King William and Queen Mary, by the late Lords Commissioners for the Custody of the Great Seal, in a Cause there then depending, between Thomas English and Dorothy his Wife (the Appellant's Sister) Complainants, and the Petitioner Defendant, et è contra, "That their Lordships have heard the Counsel of Mr. English, as well as of the said Mr. Zouch; and are of Opinion, That the said Petition is fit to be received:"

To which the House agreed; and ordered as followeth; (videlicet,)

"It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Samuel Swinnock, Executor to Thomas English, may have a Copy of the said Petition; and shall and he is hereby required to put in his Answer thereunto, in Writing, on Monday the Seven and Twentieth Day of this Instant November, at Ten of the Clock in the Forenoon."

D. of Richmond introduced.

This Day Charles Duke of Richmond was introduced, between the Duke of Northumberland and the Duke of St. Albans; the Duke of Norfolke Earl Marshal of England, and the Gentlemen Usher of the Black Rod, going before; and the Herald also carrying the Exemplification of his Letters Patents under the Great Seal of England, the Original being at present not to be found: His Grace delivered the same to the Speaker, on his Knee; who giving it to the Clerk, it was read at the Table.

The Letters Patents bear Date 9° Die Augusti, 27° Car. II^di; the Exemplification is dated 9° Die Novembris, 5° Gul. et Mariæ.

And his Writ was read, as followeth; (videlicet,)

"Gulielmus & Maria, Dei Gratia, Angl. Scoc. Franciæ, & Hib'niæ Rex & Regina, Fidei Defensores, &c. Charissimo Consanguineo Nostro Carolo Duci Richmond. Salutem: Cum nuper, de Avisamento & Assensu Concilii Nostri, pro quibusdam arduis & urgentibus Negotiis, Nos, Statum & Defensionem Regni Nostri Angl. & Ecclesiæ Anglicanæ concernen. præsens Parliamentum Nostrum apud Civitatem Nostram Westm. Vicesimo Die Martii, Anno Regni Nostri Secundo, teneri ordinavimus; & ibidem, cum Prælatis, Magnatibus, & Proceribus dicti Regni Nostri, Colloquium habere & Tractatum; quod quidem Parliamentum Nostrum tunc & ibidem incept. fuerat; & abinde, per separales Prorogationes, usque Vicesimum Sextum Diem Octobris ultim. præterit. continuat. fuerat; & ab eodem Vicesimo Sexto Die Octobris idem Parliamentum Nostrum usque ad & in Septimum Diem instantis Novembris ulterius prorogat. fuerat, apud Civitatem Nostram Westm. prædict. ibidem tunc tenend. & prosequend.: Vobis, sub Fide & Ligeantia quibus Nobis tenemini firmiter injungendo mandamus, quod, consideratis dictorum Negotiorum Arduitate & Periculis incumbentibus, cessante Excusatione quacunque, ad Parliamentum Nostrum præd. personaliter intersitis, Nobiscum, ac cum Prælatis, Magnatibus, & Proceribus præd. super dictis Negotiis tractatur. vestrumque Consilium impensur. Et hoc, sicut Nos & Honorem Nostrum, ac Salvationem & Defensionem Regni & Ecclesiæ prædict. Expeditionemque dictorum Negotiorum diligitis, nullatenus omittatis."

"Testibus Nobis ipsis, apud Westm. Septimo Die Novembris, Anno Regni Nostri Quinto.

Then his Grace took his Place; and came to the Table, and took the Oaths, and made and subscribed the Declaration, pursuant to the Statutes.

Burrows versus Dod & al.

Upon Report from the Lords Committees, to whom was referred the Petition of Thomas Burrows; praying, "That his Petition which was dismissed this House the Fourteenth Day of March last, upon the Petition of Anne Dod and others, may be retained; their Lordships, having heard Counsel for the said Mr. Burrows, as also for the said Anne Dod and others concerned, are of Opinion, that the said Petition is fit to be retained by this House, it appearing that the said Dod had also a Petition depending in this House against the said Burrows, and both Petitions ordered to be heard together; whereof no Mention is made in the said Petition for Dismission, nor any Notice given of that last Petition to the now Petitioner:"

To which Report, the House agreed; and ORDERED, That the said Petition of Thomas Burrows shall be, and is hereby, revived; and that this House will hear Counsel thereupon, as also upon the Petition of Anne Dod and others therein concerned, now depending in this House, on Tuesday the One and Twentieth Day of this Instant November, at Ten of the Clock in the Forenoon.

Mauduit, Windsor Herald, Petition to be discharged from an Arrest.

Upon reading the Petition of Peers Mauduit; shewing, "That he is Windsor Herald of Arms, and sworn and admitted Their Majesties Servant; that he was, within the Time of Privilege of Parliament, arrested and detained, at the Suit of Mary Deeble and others; and praying to be set at Liberty:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of this Petition shall be, and is hereby, referred to the Lords Committees for Privileges; who are to consider thereof, and report to the House.
