The Question was put, "Whether this Bill shall pass, with the said Amendments?"

It was Resolved in the Affirmative.

Boevey versus Boevey.

Upon reading the Petition of James Boevey Esquire; shewing, "That, on the Six and Twentieth Day of January last, it was ordered, that Elizabeth Boevey should answer to his Appeal depending in this House;" and Oath being made, "That she was served with the said Order the Eight and Twentieth of January last, and that she hath not answered:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Elizabeth Boevey shall put in her Answer to the said Appeal on or before Saturday the Eighteenth Day of this Instant February, at Ten of the Clock in the Forenoon; and in Default of her so doing, she shall be forthwith attached.

Old Governors of Birmingham School. versus Hicks & al.

Upon reading the Petition of the old Governors of the Free Grammar School in Bermingham, in the County of Warwick, of the Foundation of King Edward the Sixth; shewing, "That they have tried the Issue directed by this House, and have a Verdict that Mr. Hicks is not duly elected Schoolmaster; and praying that the Possession of the said School and Schoolhouse be forthwith delivered to the Petitioners, pursuant to the said Verdict:"

The House was adjourned during Pleasure, and put into a Committee, upon the said Bill.

The House was resumed.

And the Lord Cornwallis reported the Bill, with the Amendments.

Baron versus Haward.

The House being this Day moved, "That a Day may be appointed for hearing of the Cause wherein Christopher Baron and William Baron are Appellants, and William Haward Respondent:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Wednesday the Two and Twentieth Day of this Instant February, at Ten of the Clock in the Forenoon.

Judgements in Westm. Hall, for better Discovery of, Bill.

Upon reading the Petition of Thomas Goodinge and Symon Folkes Esquires, Custos Brevium et Recordorum of Their Majesties Court of King's Bench, and their Underclerks, praying to be heard before the passing of the Bill, intituled, "An Act for the better Discovery of Judgements in the Courts (fn. 1) of King's Bench:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That they shall be heard, by themselves or Counsel, at the Committee to whom the said Bill is referred, To-morrow, at Nine of the Clock in the Forenoon, in the Prince's Lodgings near the House of Peers.

Newton versus Ballet.

Whereas this Day was appointed for hearing Counsel upon the Petition of James Newton, as also Counsel for John Ballet; Counsel appeared for the Respondent Ballet, but none for the Petitioner Newton:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Appellant shall be peremptorily heard by his Counsel, as also Counsel for the Respondent, on Monday next, at Ten of the Clock in the Forenoon, as to the Payment of One Hundred Guineas.

Gardner and Bawden versus African Company.

Upon hearing Mr. John Gardner Merchant on the Behalf of himself and Dame Letitia Bawdon, Widow and Executrix of Sir John Bawdon, deceased, upon the Petition and Appeal of the said John Gardner and Dame Letitia Bawdon, from an Order made in the Court of Exchequer the Seventh Day of May last, and from a Decretal Order made in the said Court the Thirteenth of June following; and from a final Decree made in the said Cause the Four and Twentieth Day of November last; as also Counsel upon the Answer of the Royal Affrican Company of England, under their Common Seal, put in thereunto:

After due Consideration had of what was offered on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of John Gardner and Letitia Bawdon shall be, and is hereby, dismissed this House; and that the said Orders of the Seventh Day of May last and the Thirteenth of June following, and the final Decree made the Four and Twentieth Day of November last in the said Court of Exchequer, shall be, and they are hereby, affirmed.

Adjourn.
