E. of Suffolk takes his Seat.

This Day Henry Earl of Suffolke sat first in Parliament, upon the Death of his Brother George Earl of Suffolke; and took the Oaths, and made and subscribed the Declaration, pursuant to the Statutes in that Behalf made.

Writs of Error brought in.

The Lord Chief Justice Holt, in the usual Manner, brought in Two Writs of Error:

1 Hall, Plaintiff. Fisher, Defendant.

2 Smith, Plaintiff. Keilway, Defendant.

Sir J. Caldwell versus Fisher.

Upon reading the Petition of James Caldwell Baronet; shewing, "That, after great Expence and many vexatious Delays given him by William Fisher, both in Chancery and at Law, he brought a Cause in Ejectment, to recover his Right in a House; and that now that said William Fisher hath brought his Writ of Error in Parliament for Delay, and to supersede all Proceedings at Law; and praying, that the said Writ of Error may not be any-ways a Hindrance or Prejudice to the Petitioner's Proceedings at Law on the said Judgement:"

Receiving the Writ of Error not to stay Proceedings at Law.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the receiving of the said Writ of Error into this House shall not be any Stop of Proceedings at Law in the Courts below, on the said Judgement.

Cockayne, King's Equerry, discharged from an Arrest, on an Outlawry.

Upon reading the Petition of James Cockayne, sworn Equerry in Ordinary to Their Majesties; shewing, "That he is now arrested and detained in Prison since the last Adjournment, in Custody of the Sheriff of Midds. upon an Outlawry, after Judgement, and several other Mean Process, contrary to the Privilege of Parliament, within the Time of Privilege of Parliament:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said James Cockayne shall be, and is hereby, discharged from his Imprisonment; and this shall be a sufficient Warrant on that Behalf.

To the Sheriff of the County of Midds. and his Under Sheriff, and to ail Gaolers and Keepers of Prisons whatsoever, &c.

Col. Vaughan Gent. Pensioner, discharged from an Arrest.

The House being informed, "That Colonel John Vaughan, One of Their Majesties Gentlemen Pensioners, is now in Custody of the Sheriff of Midds. at the Suit of Moreton and Partner, which is contrary to the Privilege of Parliament:"

Moreton to attend.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Colonel John Vaughan shall be, and is hereby, discharged from his Imprisonment which he now lies under; and this shall be a sufficient Warrant on that Behalf; and the said Mr. Moreton is hereby ordered to attend this House on the First Day of the Sitting of this Parliament after the Prorogation.

To the Sheriff of Midds. and his Under Sheriff, and to all Gaolers and Keepers of Prisons, &c.

Then the Lord President acquainted the House, "That Her Majesty had sent a Commission for proroguing the Parliament."

Then the Lords Commissioners took their Places on a Form across the House; the Lord President in the Middle, and the Earl of Macclesfeild and Earl of Warraington on his Right Hand, and the Earl of Nottinghame, Lord Viscount Newport, on his Left Hand (all in their Robes); who commanded the Gentleman Usher of the Black Rod to go to the Commons, and desire they would be present, to hear the said Commission read.

Who being come, with their Speaker; the Commission was read, as follows:

Then the Lord President said,

Parliament prorogued.

"By Virtue of Their Majesties Commission now read, and to us directed, we do, in Their Majesties Name, prorogue this Parliament to Tuesday the Thirtieth Day of June next: And this Parliament is prorogued to Tuesday the Thirtieth Day of June next."
