Their Lordships, or any Three of them; to meet To-morrow, at Nine of the Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.
Bernadiston's Bill.
Hodie 2a vice lecta est Billa, "An Act to free the Estate of Sir Samuell Bernadiston from several Incumbrances, occasioned by a Judgement given against him upon an Information in the Court of King's Bench."
ORDERED, That the Consideration of this Bill be, and is hereby, referred to these Lords following:
Their Lordships, or any Five of them; to meet on Saturday next, at Ten of the Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.
House to fit early, to hear Causes.
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the House shall fit at Nine of the Clock in the Forenoon daily, to hear the Causes now depending in this House: And it is further ORDERED, That this Order be set upon the Doors of this House, to the End all Parties and Counsel concerned may take Notice hereof, and attend accordingly.
E. of Suffolk versus Prises.
The House being moved, "That Edward Prise and Symon Prise, now in the Custody of the Gentleman Usher of the Black Rod, for a Breach of Privilege committed against the Earl of Suffolke, may be bailed:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Edw. Prise and Symon Prise shall be at Liberty; giving to Sir Thomas Duppa, Gentleman Usher of the Black Rod, the same Security as before, that they will render themselves to him again on Tuesday next, at Ten of the Clock in the Forenoon.
Dashwood et al: versus Champante.
Upon Report from the Lords Committees for Petitions (as fit to be heard) the Petition of Sir Robert Dashwood Knight and Baronet, Sir Samuell Dashwood Knight, John Pery and Edward Noell Esquires, surviving Executors of the last Will and Testament of George Dashwood Esquire, deceased, in Trust for Minors, the younger Children of the said Mr. Dashwood, being an Appeal from an Order made in the Court of Exchequer, on the 29th Day of November last, upon re-hearing of a Cause there depending, wherein the said Sir Robert Dashwood, Sir Sam. Dashwood, John Pery, and Edw. Noell, were Defendants, at the Suit of Sir John Champante Knight, Complainant, pursuant to an Order made by the House of Peers, the 24th Day of April last, upon hearing of the Petitioners Appeal against a former Decree and Order made in the said Cause by the said Court of Exchequer:
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Sir John Champante may have a Copy of the said Petition; and be, and is hereby, required to put in his Answer thereunto, in Writing, on Thursday the Eighteenth Day of this Instant December, at Ten of the Clock in the Forenoon; whereof the Petitioners are to cause timely Notice to be given to the Defendant, to the End he answer accordingly.
Clark versus Baden.
Upon hearing Counsel this Day at the Bar, upon the Petition of Edmund Clarke, being an Appeal from a Decree in the Exchequer, in a Cause wherein Robert Baden was Defendant, and the said Edward Clarke Plaintiff; as also upon the Answer of the said Robert Baden put in thereunto:
After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Edmund Clarke shall be, and is hereby, dismissed this House; and that the Decree from which he appealed be, and is hereby, affirmed: And it is further ORDERED, That the said Edmund Clarke shall pay, or cause to be paid, unto the said Robert Baden, the Sum of Thirty Pounds, of good and lawful Money of England, for his Costs and Charges in defending his Appeal in this House.
Bill to prevent the Exportation of Bullion, and melting the Coin.
The House was adjourned during Pleasure, and put into a Committee, upon the Bill, intituled, "An Act against the Exportation of Gold and Silver, and melting down the Coin of this Realm."
The House was resumed.
And the Earl of Huntingdon reported, "That the Committee had made some Progress in the Bill; and were of Opinion, that the House should name a Committee, to draw some Clauses to be added to the said Bill."
Which was agreed, as followeth:
Lords Committees appointed to draw Two Clauses, to be added to the Bill, intituled, "An Act against Exportation of Gold and Silver, and melting down the Coin of this Realm:" 1. A Clause to prevent melting down the Coin of this Realm. 2. A Clause to prevent the Wasting and unnecessary Consumption of Gold and Silver, in Lace, Gilding, and Laquering. Whose Lordships are to report to the House.
Their Lordships, or any Three of them; to meet on Saturday next, at Nine of the Clock in the Forenoon, in the Prince's Lodgings; and to adjourn as they please.
Adjourn.
