Forster et al. versus Bernard.

Upon hearing Counsel this Day at the Bar, upon the Petition of Anthony Forster and Elizabeth his Wife, and James Browning an Infant, by his Guardian, Executor of the last Will of Katherine Browning his late Mother, deceased, which said Elizabeth and Katherine were the only Children of John Markland, lately deceased, being an Appeal from a Decree upon a Bill of Review of Humphrey Munt, by the Lords Commissioners of the Great Seal of England, on the 5th Day of December, 1689, and from a Dismission of their Bill with Costs; as also upon the Answer of John Bernard, Assignee and Administrator of Humphrey Munt, deceased, who was Executor of the last Will and Testament of John Markland, and Robert, Samuell, Sarah, Anne, and Mary Munt, Children of the said Humphrey Munt, by the said John Bernard their Guardian (who was made a Party to this Appeal, by Order of this House, dated the 11th of January, 1689:)

Judgement reversed.

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Decree, made by the Lords Commissioners of the Great Seal of England, from which the said Anthony Forster, Elizabeth his Wife, and the said James Browning, appealed to this House, shall be, and is hereby, reversed.

Protest against it.

Kempton Park, Philipps's Bill.

The Lord Viscount Weymouth reported the Bill, intituled, "An Act for the enabling the Sale of the Manor of Kempton and Kempton-Parke, and other Lands, late of Francis Phelipps Esquire, deceased, as fit to pass, without Amendments."

Which the House agreed to, and ordered the said Bill to be engrossed.

Coals, for regulating the Price of, Bill.

The Earl of Bridgewater reported from the Committee the Bill, intituled, "An Act for reviving a former Act for regulating the Measures and Prices of Coals, with an Amendment; which is offered to the Consideration of the House."

The Amendment was read Twice, and Agreed to; and the Bill ordered to be engrossed, with the said Amendment.

Pin-makers Bill.

The Earl of Bridgewater reported from the Committee, the Bill, intituled, "An Act for the better encouraging the Art of Pin-making, and keeping and setting the poor Pin-makers on work, with several Amendments; which are offered to the Consideration of the House."

The Amendments were read Twice, and agreed to; and the Bill ordered to be engrossed, with the several Amendments.

Impeachments in Statu quo from Parliament to Parliament.

The Earl of Mulgrave acquainted the House, "That the Lords Committees appointed by the House, to inspect and consider Precedents, whether Impeachments continue in Statu quo from Parliament to Parliament, are ready to make their Report; and desired the House would appoint a Day for that Purpose:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Report shall be made on Tuesday next, at Ten of the Clock in the Forenoon; and that all the Lords in and about the Town be summoned to attend the House at that Time.

Ld. Keveton to be searched for.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Gentleman Usher of the Black Rod, his Deputy or Deputies, do forthwith search for the Body of Peregrine Lord Keveton, in any House he shall suspect he is; and that if the Owner or Inhabitant of the said House shall refuse to let him enter, that then he do break open the Doors of the said House in the Presence of a Constable, and there search for and seize the said Lord Keveton, if he shall be there found, and bring him in safe Custody to this House; and this shall be a sufficient Warrant on that Behalf.

To Sir Tho. Duppa, Gentleman Usher of the Black Rod, his Deputy and Deputies, and every of them; and to all Mayors, Sheriffs, Bailiffs, and Constables, and other Their Majesties Officers Civil and Military, to be aiding and assisting in Execution hereof.

Adjourn.
