This Day Thomas Earl of Sussex, James Lord Chandos, and Robert Lord Lexington, took the Oaths, and made and subscribed the Declaration, pursuant to the Statutes.

E. of Mulgrave's Waterman pressed.

The Earl of Bridgewater reported from the Committee of Privileges, "That the Committee is of Opinion, That the Earl of Mulgrave's Privilege hath been broken, by Lieutenant Crowe's pressing and detaining Josias Williams his Lordship's Waterman; and that the said Joias Williams ought to be released, and the said Lieutenant Crowe sent for in Custody."

The Question being put, "Whether to agree with the Report of the Committee?"

It was Resolved in the Negative.

Dean and Chapter of Hereford versus Hodges.

Upon reading the Petition of the Dean and Chapter of the Cathedral Church of Hereford, and James Gregory Esquire, praying the Revival of their Appeal; and that Richard Hodges may answer thereunto, and that all Proceedings on the said Decree may be stayed in the Courts below:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Richard Hodges be, and is hereby, required to put in his Answer thereunto, in Writing, on Tuesday the 8th Day of April next, at Ten of the Clock in the Forenoon; whereof the Petitioners are to cause Notice to be given to the said Richard Hodges, to the End he answer accordingly.

Coke versus Fountain.

Upon reading the Petition of Edward Coke Esquire, an Infant, by the Lady Anne Coke a Widow, his Mother and Guardian; praying the Revival of their Appeal, to which Andrew Fountaine Esquire is Defendant, and a Day may be appointed for hearing thereof:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Wednesday the Third Day of April next, at Ten of the Clock in the Forenoon: And it is further ORDERED, That the stitched Papers and Vellum Book, or any other Writings which were formerly produced upon any Hearings in this House by the said Andrew Fountaine, shall be then produced; whereof the Petitioners are to cause Notice to be given to the Defendant, to the End he attend with his Counsel accordingly.

Vincent versus Parker.

Upon reading the Petition of Vincent Vincent Esquire; shewing, "That, since his Appeal lodged in this House, by Order of the Court of Chancery, he is taken into Custody, and committed to The Fleete, for not performing the Decrees of that Court (from which he appealed to this House); where he now remains, to his great Disgrace, Damage, and Expence; and humbly praying Relief therein:"

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition of Vincent Vincent Esquire be, and is hereby, referred to the Lords Committees appointed to consider and inspect the Journals of this House, whether any Proceedings may be had in the Courts in Westminster Hall, in the Intervals of Parliament, after Appeals or Writs of Error are depending in this House.

Sir R. Brooke versus Marshall.

Upon reading the Petition of Sir Robert Brook Baronet and Dame Martha his Wife, Relict and Administratrix of Christopher Tomlinson deceased; praying the Revival of their said Appeal, and that Sir Charles Porter may be made a Party thereto:

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Sir Charles Porter may have a Copy of the said Petition; and be, and is hereby, required to put in his Answer thereunto, in Writing, on Tuesday the First of April next, at Ten of the Clock in the Forenoon; whereof the Petitioners are to cause Notice to be given to the said Sir Charles Porter, to the End he answer accordingly.
