Hodie 1a vice lecta est Billa, "An Act for the better enabling the Trustees of the Most Noble George late Duke of Buckingham to sell the Estate of the said Duke, for Payment of Debts."

Message from H. C. with a Bill.

A Message was brought from the House of Commons, by Colonel Birch and others:

Who brought up a Bill, intituled, "An Act for the ordering the Forces in the several Counties of this Kingdom;" to which their Lordships Concurrence is desired.

Shirley's Bill.

The Earl of Rochester reported, "That the Committee have considered the Bill for enabling of Hannab Shirley Widow, and Mary Battilhey, alias Shirley, her Daughter, to settle and dispose of certain Lands and Tenements, in the Counties of Midd. and Essex; and have heard all Parties concerned; and their Opinion is, that the Bill is fit to pass as it is."

They agreed with the Committee, and ordered the Bill to be engrossed.

Message to H. C. for a Conference on the Succession Bill.

A Message was sent to the House of Commons, by Sir Miles Cooke and Sir Adam Oateley:

To desire a present Conference, in the Painted Chamber, concerning the Subject-matter of the last Conference, upon the Bill touching the Succession to the Crown.

D. of Schomberg, Leave to apply to H. C. to return Thanks.

The House was informed, "That the Duke of Schomberg desired to apply himself to the House of Commons, to return his Thanks for the Respects he hath received from them."

And this House leaves it to his Grace, to do what he thought fit therein.

Message from the King, that a Committee may inspect the Minute Book concerning Irish Affairs.

The Earl of Nottingham acquainted the House, "That he was commanded by the King to deliver a Message to their Lordships, That His Majesty is graciously pleased to give Leave, that a Committee of this House may inspect the Minute Book concerning the Affairs of Ireland, according to the Desire of this House in their late Address."

Answer from H. C.

The Messengers return with this Answer from the House of Commons:

That they will give a Conference, as is desired.

Conference on the Succession Bill:

The Commons being ready in the Painted Chamber for the Conference, the House was adjourned during Pleasure, and the Lords went to the Conference; which being ended, the House was resumed.

Report of it.

The Earl of Rochester reported, "That the Managers of this Conference had delivered the Reasons of this House, and had left the Bill with the Members of the Commons who were at the Conference."

Wiseman versus Terry.

Whereas there is a Writ of Error brought into this House, wherein Sir Richard Wiseman is Plaintiff, and Stephen Terry Defendant; whereupon the said Sir Richard Wiseman hath assigned Errors, and therein alledged Diminution, which was looked on only for Delay, they having not alledged any particular Diminution in the said Transcript to the Writ of Error annexed:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Stephen Terry do join Issue upon the said Writ of Error; and that this House will hear the said Errors argued thereupon, by Counsel on both Sides, at the Bar, on Friday next, at Ten of the Clock in the Forenoon; whereof all Parties are to take Notice, and attend with their Counsel accordingly.

Sydenham versus Terry.

Upon reading the Petition of John Terry Defendant, to the Appeal of Sir John Sydenham Baronet; praying a short Day for hearing the said Cause:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Monday the 22th Instant, at Ten of the Clock in the Forenoon.

Duty on Tea, Coffee, &c.

Upon Report from the Committee for the Bill, intituled, "An Act for collecting the Duties upon Coffee, Tea, and Chocolate, at the Custom-house," a Petition was also reported of divers Merchants of the City of London:

It is ORDERED, That the Bill be re-committed; and that they do draw a Clause pursuant to the Prayer of the said Petition; whose Lordships are to meet on Thursday next, at Nine of the Clock in the Forenoon; and to adjourn as they please.

Monk's Bill, to be freed from a Marriage under Age.

Pilkington versus Regem, in Error.

Whereas, by virtue of Their Majesties Writ of Error returnable into the House of Peers in Parliament assembled, wherein Judgement is entered for the late King Charles the Second, against Thomas Pilkington late of London Esquire, Samuell Shute, Henry Cornish Esquires, Thomas Player Knight, Slingsby Bethel Esquire, Francis Jenkes, John Deagle, Richard Freeman, Rob't Kaye, John Wickham, Samuell Swynocke, and John Jekell; upon which Writ, Errors were assigned, and Issue joined:

After hearing Counsel at the Bar, on the Thirteenth Instant, to argue the Errors assigned thereupon, and due Consideration had thereof, the Lords Spiritual and Temporal in Parliament assembled do order and adjudge, That the Judgement given for the late King Charles the Second, against the said Tho. Pilkington, Samuell Shute, Henry Cornish, Esquires, Sir Tho. Player Knight, Slingsby Bethell, Francis Jenkes, John Deagle, Rich. Freeman, Rob't Kaye, John Wickham, Samuell Swynock, and John Jekell, be, and is hereby, reversed, and declared null and void.
