E. of Portland Introduced.
This Day William Earl of Portland was conducted by the Lord Great Chamberlain of England, and introducted between the Earl of Shrewsbury and the Earl of Manchester (being all in their Robes), the Usher of the Black Rod attending upon them; and Garter King at Arms, carrying his Patent of Creation and Writ of Summons, presented them to the Speaker, who delivered them to the Clerk of the Parliament; and he brought them to the Table, and read them both.
The Patent bears Date the Ninth of April, 1° Regis Gu'i'lmi et Mariæ, and the Writ of Summons bears Test the 13th of April, in the same Year. Which being done, he was brought by the said Lords to the Earls Bench, and placed in his due Place.
Ld. Cholmondeley introduced.
In the like Manner, Hugh Cholmondeley, being created Baron de Namptwich, was introducted, between the Lord Maynard and the Lord Lexington.
His Patent was brought to the Table, and read, bearing Date the Ninth Day of April, in the First Year of King William and Queen Mary; and the Writ of Summons was also read, bearing Date the 13th Day of April, in the same Year.
Visc. Sidney introduced.
In the like Manner, Henry Viscount Sydney de Sheppy was introducted, between the Lord Maynard and the Lord Lexington.
His Patent was read at the Table, being dated the Ninth Day of April, A° 1° Guliel. Regis et Reginæ Mariæ; and also the Writ of Summons was read, bearing Date the 13 Day of April, in the same Year.
Lords take the Oaths.
Presently after, these Lords following took the Oaths, and made and subscribed the Declaration, in Pursuance of the Acts:
Dissenters Toleration Bill.
The Earl of Nottingham reported from the Committee, the Amendments made in the Bill concerning Toleration.
ORDERED, That this Report be taken into Consideration on Wednesday next.
Bill for removing Papists from London, &c.
The Earl of Nottingham reported from the Committee for the Bill for removing Papists out of the Cities of London and Westminster, "That they have thought of an Expedient to be offered to the House of Commons; which is, in the Proviso concerning the Queen Dowager, sent up by the House of Commons, they do not agree, but insist upon their own; and however, for an Expedient, offer the Proviso following:
"Provided also, That the Queen Dowager may retain in Her Family so many Popish Servants of the King's Subjects as Her Majesty shall think fit, not exceeding the Number of Thirty, so as none of the said Servants be a Priest, Monk, or Friar; any Law or Statute to the contrary notwithstanding."
This Proviso is to be offered to the House of Commons.
Bradshaw versus Northend.
Upon reading the Petition and Appeal of Sir James Bradshawe Knight, Richard Northend, and Nathaniell Northend, complaining of a Decree pronounced against the Petitioners, by the then Lord Chancellor Jeffryes, the 25th Day of November, in the Third Year of the late King James the Second; and, upon a Second Hearing, the Lord Chancellor ordered the First Decree should stand; to which Appeal Christopher Northend is Defendant; and praying the Reversal of the said Decree or Orders:
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Christopher Northend may have a Copy of the said Appeal; and be, and is hereby, required to put in his Answer in Writing, on Monday the 6th Day of May next, at Ten of the Clock in the Forenoon; whereof the said Sir James Bradshawe and the others, Complainants, are to cause timely Notice to be given to the said Christopher Northend, to the End he answer accordingly.
E. Rivers versus E. Derby & al.
This House being moved, "That a Day of Hearing may be appointed, in the Cause wherein the Right Honourable the Earl Rivers is Plaintiff, and the Right Honourable the Earls of Derby and Strafford, Francis Richardson and Thomas Maine, are Defendants:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel of both Sides, at the Bar, on Tuesday, the 23d Day of this Instant April, at Ten of the Clock in the Forenoon; whereof the Earl Rivers is to cause timely Notice to be given to the Defendants, to the End they may attend with their Counsel accordingly.
E. Macclesfield versus Sir A. Fitton and Joliff.
The House being moved, "That a Day of Hearing may be appointed, in the Cause wherein the Right Honourable the Earl of Maclesfeld is Plaintiff, and Sir Alexander Fitton and Thomas Jolliff Esquire are Defendants (a Day having been appointed for the Defendants to answer, which they have not yet done):"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Wednesday, the 24th Day of April Instant, at Ten of the Clock in the Forenoon; and that the said Sir Alexander Fitton and Thomas Jolliffe do put in an Answer to the said Appeal on or before Wednesday next.
E. Anglesey to attend.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Right Honourable the Earl of Anglesey be, and is hereby, desired to attend this House To-morrow, at Ten of the Clock in the Forenoon.
E. of Chesterfield, Leave to be absent.
ORDERED, That the Earl of Chesterfeild hath Leave to go into the Country, for his Health, for some Time.
