E of Bristol takes the Oaths.
This Day John Earl of Bristol took the Oaths of Allegiance and Supremacy, and made and subscribed the Declaration, in Pursuance of the late Act for the more effectual preserving His Majesty's Person and Government, by disabling Papists from sitting in either House of Parliament.
Thimbleby to be discharged upon Bail.
Upon reading the Petition of John Thimelby Esquire, now Prisoner in The King's Bench, as being charged to be knowing of the horrid Design against His Majesty's Person and Government; shewing how unexpressibly he is prejudiced, in his Health and otherwise, by his Imprisonment; and that he will be ready to attend this House upon any Summons:
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, upon the Prayer of the Petitioner, that he may be set at Liberty for the Recovery of his Health, That the said John Thimelby shall be brought to the Bar of this House, by the Keeper of the Prison of The King's Bench, to enter into Recognizance to His Majesty, for his Appearance upon Summons; and this shall be a sufficient Warrant on that Behalf.
To the Keeper of the Prison of The King's Bench, his Deputy and Deputies, and every of them.
Whitaker committed.
Whereas Edward Whitaker was this Day brought to the Bar, by the Serjeant at Arms attending this House, to answer to the Informations against him; which he denies, alledging that he hath Witnesses to clear himself from the Matters charged on him:
Upon Consideration had thereof, it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Edward Whitaker may and shall have an Order for summoning his said Witnesses, to be heard viva Voce, on the Second Day of the Sitting of the Parliament next after Christmas, if he desires it; at which Time also the Witnesses who have informed against him shall be summoned to be heard viva Voce; and that in the mean Time the said Serjeant at Arms shall deliver the said Edward Whitaker into the Prison of Newgate, there to remain in safe Custody till further Order; and this shall be a sufficient Warrant on that Behalf.
To Sir Geo. Charnocke Knight, Serjeant at Arms attending this House, and to the Keeper of Newgate, and their respective Deputies, and every of them.
Stratford versus Cooling.
Whereas, upon reading the Petition of Samuell Stratford, and the Suggestions therein specified, an Order was granted to the Petitioner, on the 7th Instant, "That Joseph Cooling Esquire, Marshal of The King's Bench, should put in better Bail, for answering a Judgement obtained by the said Samuell Stratford against the said Joseph Cooling, for Two Hundred and Two Pounds, besides Costs, upon the said Joseph Cooling's bringing in the said Judgement into this Court by His Majesty's Writ of Error, granted for that Purpose:"
It appearing this Day, upon the Report of the Lord Chief Justice of the Court of King's Bench, "That his Lordship had before taken sufficient Bail in the Petitioner's Case, and that the Suggestions in the said Petition are false;" it is ORDERED, That the said Order of the 7th Instant, made in this Case, be, and is hereby, set aside.
Grosvenor, Leave to go out of the Kingdom.
Upon reading the Petition of Richard Grosevener Esquire; shewing, "That, in Obedience to His Majesty's late Proclamation, he hath removed himself above Ten Miles from London; and, being desirous not to give any Disquiet to His Majesty's Peace, or the Government, therefore praying, that he may have Leave to depart out of this Kingdom:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Richard Grosevener be, and is hereby, authorized and permitted to repair to any of His Majesty's Sea Ports of this Kingdom, and to pass thence into France, Holland, or any other Foreign Parts out of His Majesty's Dominions, within Ten Days next after the Date hereof, without the Lett, Stay, or Interruption, of any Person or Persons whatsoever; and this shall be a sufficient Warrant on that Behalf.
Thomson released;
Upon reading the Petition of James Thomson, Prisoner in The Gatehouse, for dangerous Words by him uttered; in which Petition he acknowledgeth his Offences for which he was committed, and Sorrow for the same; and prayeth that he may be discharged from his Imprisonment:
Upon Consideration had of the Submission of the said James Thomson; it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said James Thomson be forthwith discharged from his present Imprisonment in The Gatehouse for his said Offence; and this shall be a sufficient Warrant on that Behalf.
To the Keeper of the Prison of The Gatehouse, his Deputy and Deputies, and every of them.
and Leave to go out of the Kingdom.
Whereas James Thomson, being a Prisoner in The Gatehouse for dangerous Words by him uttered, hath, by his humble Petition, acknowledged his Offence and Sorrow for the same, and made his Submission to this House, and is thereupon this Day discharged from his Imprisonment for the same, hath humbly prayed that he may have some small Time given him, to adjust his Accompts here with his Creditors, and to depart into Flanders:
It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said James Thomson be, and is hereby, authorized and permitted to stay in Town, for the Space of Ten Days from the Day of his Enlargement out of Prison, for adjusting his Accompts with his Creditors, and no longer; but repair immediately to some of His Majesty's Sea Ports of this Kingdom, and pass thence into Flanders; which he is hereby authorized to do, without the Lett, Stay, or Interruption, of any Person or Persons whatsoever.
Barnesly, a supposed Priest, recommitted to Worcester Gaol.
Whereas Henry Barnesly, who was by Order of this House sent for from the Gaol in Worcester, was this Day brought to the Bar, by the Serjeant at Arms attending this House, and there examined, being supposed to be a Popish Priest:
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Henry Barnesley shall, by the said Serjeant at Arms, or his Deputy or Deputies, be returned into the Gaol in Worcester, there to remain in safe Custody till he shall be thence delivered by due Course of Law; and this shall be a sufficient Warrant on that Behalf.
To Sir Geo. Charnock Knight, Serjeant at Arms attending this House, and to the Keeper of the Gaol in Worcester, and their respective Deputies, and every of them.
