Lord Holles takes the Oaths.

This Day Denzell Lord Holles took the Oaths of Allegiance and Supremacy, and made and subscribed the Declaration, in Pursuance of the Act for the more effectual preserving His Majesty's Person and Government, by disabling Papists from sitting in either House of Parliament.

Popish Recusants, to disable from exercising Trades, Bill.

Hodie 3a vice lecta est Billa, "An Act disabling Popish Recusants to exercise certain Trades and Occupations."

The Question being put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. with it.

A Message was sent to the House of Commons, by Sir William Beversham and Sir Edward Lowe:

To deliver the Bill for disabling Popish Recusants to exercise certain Trades and Occupations, and desire their Concurrence thereunto.

The Lord Bishop of St. David's is added to the Committee for the Journal Book.

Ld. Holles, Privilege: Returned as a Defaulter, for not paying Poll-money.

Upon Information given to this House, "That Denzell Lord Holles, a Peer of this Realm, is returned into the Court of Exchequer (amongst other Defaulters), for not paying the Money assessed upon him at Aldenham, in the County of Hertford, by virtue of the late Act of Parliament, for raising Money by a Poll; whereas the said Lord Holles, as a Peer, ought only to be assessed by the Peers named Commissioners in the said Act; and hath been assessed by the said Commissioners, and hath paid the Sum assessed, to the proper Collector appointed by their Lordships, by Authority of the said Act:"

Sir J. Whitewrong & al. sent for about it.

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That so much of the Schedule of Defaulters returned into the said Court of Exchequer, in which the Lord Holles is named, as relates to the Lord Holles, be forthwith vacated, by virtue of this Order; and that Sir John Wittewrong, Edward Brisco, and William Hutchinson, Commissioners (amongst others) for the said County of Hertford, being the Persons who subscribed the said Schedule of Defaulters returned into the Exchequer, be, and are hereby, required to appear at the Bar of this House, within Three Days next after Notice given them respectively of this Order, to give an Account of their so doing; and hereof they may not fail.

Whitaker to be attached.

Edward Whitaker, being called for, to answer the Charge against him sent up from the Mayor of Worcester; but being not to be found:

It is ORDERED, That, if the said Edward Whitacre come not and render himself before the House rises, he shall be attached: And he not coming; it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Serjeant at Arms attending this House, or his Deputy, do forthwith attach the Body of Edward Whitaker of London, Gentleman, and bring him in safe Custody to the Bar of this House, To-morrow Morning, to answer to the Informations put into this House upon Oath against him; and this shall be a sufficient Warrant on that Behalf.

To Sir Geo. Charnock Knight, Serjeant at Arms attending this House, his Deputy and Deputies, and to all His Majesty's Officers Civil and Military, to be aiding and assisting in this Service.

Middledorp et al. Hamburgh Merchants, versus Regem.

This House being moved, on the Behalf of Peter Midledorp and other Hambrough Merchants, who are at great Charge in keeping Witnesses in attending upon their being heard before this House, concerning a Vessel, called The Prosperous of London, richly laden, which Ship is condemned in the Court of Exchequer; from the Judgement of which Court they have addressed to this House, and therefore pray they may be heard concerning the same:

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear Counsel, at the Bar, on both Parts, concerning the said Ship and Lading, on Monday next, at Three of the Clock in the Afternoon; whereof the said Peter Midledorp and other Petitioners, are to cause timely Notice to be given to the other Person or Persons concerned therein, to the End they may attend accordingly.

Preservation of the King's Person, and securing the Protestant Religion.

The House was adjourned into a Committee during Pleasure, to proceed further in considering of Heads for preserving the Person of His Majesty and His Kingdom, and securing the Protestant Religion.

The House being resumed;

The Earl of Bridgwater reported, "That the Committee, having proceeded further, are of Opinion, That an Act, or some Clause of an Act, may be prepared, to provide, that all such Persons as shall be perverted from the Protestant Religion to Popery shall be shipped away, never to return into this Kingdom; nor shall inherit the Estates of their Ancestors here, but the Estates to go to the next of Kindred to them, who are Protestants:

"That all the Laws now in Force concerning either Persons perverting, or Persons perverted, from the Protestant Religion to Popery, be continued in the same Force they now are:

"And that the Judges, who shall be appointed to frame these Heads into an Act, take Care that nothing therein to be contained may interfere with any of the Laws now in Being concerning this Point."

To all which the House agreed; and ordered the House to be put again into a Committee Tomorrow Morning, to proceed in the same Business.
