Report concerning Lodington, E. Warwick's Servant, being arrested.
Upon Report made by the Earl of Bolingbrooke, from the Committee of Privileges, "That their Lordships have, according to the Directions of this House, taken into Consideration the Criminal Part of the Business concerning the Arrest of Thomas Lodington, a menial Servant to the Earl of Warwick, as it reflects on his Lordship and his Privilege; and were thereupon of Opinion, That Samuell Atkins, by whose Means Lodington was detained in Prison by laying his Execution on him for Two Hundred and Three Pounds, and speaking slighting Words of the Earl of Warwick, should, by Order of this House, have made Submission at the Bar of this House as a Delinquent, for intrenching on the Privileges of a Peer of Parliament: But the Earl of Warwick (who is the Lord concerned) informing the Committee, that the said Atkins had already submissively applied himself to him, and further that (setting aside this Business) he was a Person who had been in eminent Public Service for His Majesty both before and since His coming in, and therefore desired of their Lordships that Favour, that he might be passed by, if the Committee think fit: The Committee are of Opinion that (as a Salvo to any Breach of Privilege to be made of the like Nature hereafter) this should be reported; yet that, as a Respect to the Motion made by the Earl of Warwicke, the said Atkins may be passed by, if this House thinks fit."
Hereupon it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Samuell Atkins, upon the Reasons aforesaid, shall be discharged and freed from any further Trouble concerning this Business.
Report concerning Fees upon Translation of Bishops, and Lords Descents, to be paid to the Officers of the House.
The Earl of Bolingbrooke reported, "That the Committee for Privileges, in Pursuance of the Order of this House, dated the Fourth of this Instant May, directing them to consider, whether any Bishop being translated to another Bishopric, and every Temporal Lord being created to a higher Temporal Honour, or to whom it descends, is to pay Fees again to the Officers of this House, according to the Rates mentioned in the Roll of Fees heretofore allowed by the Lords Spiritual and Temporal in Parliament assembled, the First of May, 1640: Who have considered of the same; and do find, That the said Roll, wherein the several Fees due to the Officers of this House are contained, were then examined and tried by the Sub-committee of Privileges, and approved of; and by the Sub-committee reported to the Grand Committee of Privileges, and by them read over, examined and approved of; and by the Grand Committee reported to the House; and after reading of the said Roll there, and a mature Consideration had thereof, it was allowed of, and confirmed by the Lords Spiritual and Temporal, as appears by the Record of this House, and subscribed with the Hand-writing of the then Earl of Warwick, as the Chairman of the Committee for Privileges: But, by reason there was no Lord present at the Committee who had sat in that Parliament begun the Thirteenth Day of April, 1640, the Committee desired the further Direction of the House what to do therein."
The House hereupon being satisfied, by divers Lords who were present when this Business was agitated in the said Parliament 1640, that the same was done and settled by that Parliament upon a very strict Inquisition and Examination, and mature Deliberation:
It is now ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Fees comprised in the said Roll are hereby ratified and confirmed.
Introduction of Peers, who come in by Descent.
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That it is referred to the Committee for Privileges, to consider whether there ought to be any Induction of any Peer to sit in this House that comes in by Way of Descent; and if they find that there is, then to consider in what Manner it ought to be done; and to report their Opinions hereof to this House.
