E. of Arundel's Bill.

The Marquis of Dorchester reported from the Committee, the Bill for restoring the Earl of Arrundell to the Dukedom of Norff. as fit to pass, with some Alterations and Amendments; which were read Twice, and approved of, and the Bill ordered to be engrossed.

Committee to attend the King about it.

ORDERED, That these Lords following are appointed to wait on the King, to know His Pleasure concerning the passing of this Bill; videlicet,

E. of Arundel's Condition to be considered.

ORDERED, That the present Condition of the Earl of Arrundell is referred to the Consideration of the former Committee concerning the Bill; and whether his Lordship may be brought into England in Safety, in relation to his Health.

L. Mohun, Privilege in Stepkin's Cause.

ORDERED, That the Lord Mohun shall enjoy the Privilege of a Peer, in not answering a Suit of Law, depending between his Lordship and Stepkin, in the Common Pleas.

Trinity House and Mountjoy.

Upon hearing the Counsel of Montjoy, and the Counsel for The Trynity House, concerning the Order of this House, made the 13th June last:

It is ORDERED, That the said Order concerning the Possession is continued, for the quiet Performance of the Service, without Prejudice to the Title of any Person, until there be a Trial at Law concerning the Right.

L. Mohun, Privilege in Fettiplace's Suit against him.

Whereas there is now a Cause depending, upon a Lease of Ejectment, in the Common Pleas, at the Suit of Edmund Fettiplace Esquire Plaintiff, against Warwick Lord Mohun Defendant, a Peer of this Realm; which Cause is intended to be brought to a Trial this Term against him, contrary to the Privilege of Parliament:

It is ORDERED, by the Lords in Parliament assembled, That there shall be no further Proceeding in the said Cause, against the said Lord Mohun, during this Parliament, unless his Lordship shall be contented to wave his Privilege: And therefore all whom it may any Way concern, are to take Notice of this Order, and yield their Obedience accordingly.

Mountjoy versus Trinity House, concerning the Ballast Office.

Upon hearing the Counsel of the Executors and Assigns of William Mountjoy Esquire deceased, Plaintiffs; and of the Masters and Wardens and Assistants of The Trynity House at Deptford Strand, Defendants, this Day at the Bar, concerning the Order of this House, dated the 13th Day of June last past:

It is ORDERED, by the Lords in Parliament assembled, That the said Order is hereby continued, for the quiet and peaceable Possession of the Lastage and Ballast Office; this House declaring, that the said Order shall not prejudice or determine the Right on either Side, but to be for the quiet Carrying on and Performance of the Service belonging to the same; the Right and Title whereof this House leaves to a Trial at Law.
