Privilege.

FORASMUCH as this House was this Day informed, that one John Browne, who, by Order of the 13th of July last, was to be taken into Custody by the Serjeant at Arms attending this House, for his Abuse of Mr. Phillips, a Member of this House, had, merely to defeat the said Order, procured a colourable Execution to be taken out against him; whereupon he hath rendered himself a Prisoner in Ivelchester Gaol, on Purpose that he may not be brought up to answer his said Misdemeanor at the Bar of this House.

Ordered, That the Serjeant at Arms attending this House, or his Deputy, do bring up the said Browne in Custody, to answer the said Misdemeanor: And the Officer, in whose Custody he is, is to deliver the said Browne unto the Serjeant attending this House, or his Deputy; together with the Writ, or Warrant, whereby he is committed: And the said Browne is to bring with him the Execution upon which he hath caused himself to be so committed.

Then the House resolved into a Committee, to resume the Debate of the Bill for raising the Eighteen Months Assessment.

Then the Speaker again took the Chair.

And Sir Robert Atkins made Report from the Committee of the whole House, several Amendments and Provisoes to be added to the said Bill, and the Preamble thereof: Which said Amendments and Provisoes were severally read.

And the First Amendment being in the Bill, Page 11, L.4, fill up the Blank with "the 20th of January;" the same was read the Second time.

Resolved, That this House doth agree with the Committee to the said Amendment.

And the Second Amendment being also in the Bill, P.12, L.11, after the Word "Offices," add "usually rated;" the same was also read the Second time.

Resolved, That this House doth agree with the Committee to the said Amendment.

And the Third Amendment being in the Bill, P. 17, L. ult. add between the Word "House" and the Word "Chest," "and upon Warrant under the Hands and Seals of Two or more of the said Commissioners, any;" the same was also read the Second time.

Resolved, That this House doth agree with the Committee to the said Amendment.

And the Fourth Amendment being also in the Bill, Page ult. L. ult. add "or unto either of the Universities, or unto any Colleges, Schools, Alms Houses, or Hospitals; the same was also read the Second time.

Resolved, That this House doth agree with the Committee to the said Amendment.

And the First Proviso, reported to be added to the said Bill, being, "Provided always, that nothing in this Act contained shall be construed to alter, change, determine, or make void, any Contracts, Covenants, Agreements, or Usages whatsoever, between the Landlord and Tenant, touching the Payment of Taxes or Assessments; any thing herein before-mentioned to the contrary notwithstanding;" the same, being twice read, was, upon the Question, agreed unto.

And the Second Proviso, reported to be added to the said Bill, being, "Provided always, and be it further Enacted and Declared, by the Authority aforesaid, That, for the avoiding of all Obstructions and Delays, in collecting the Sums by this Act to be raised and assessed, all Places, Constablewicks, Divisions, and Allotments, shall pay and be assessed, in such Hundred, Rape, and Wapentake, as the same have heretofore usually been assessed in, and not elsewhere;" the same, being twice read, was, upon the Question, agreed unto.

And the Third Proviso, reported to be added to the said Bill, being, "And be it further Enacted, by the Authority aforesaid, That if any Action, Plaint, Suit, or Information, shall be commenced or prosecuted against any Person or Persons, for what he or they shall do in Pursuance or in Execution of this Act, such Person or Persons, so sued in any Court whatsoever, shall or may plead the General Issue Not Guilty; and, upon any issue joined, may give this Act, and the Special Matter, in Evidence: And, if the Plaintiff or Prosecutor shall become Nonsuit, or forbear further Prosecution, or suffer a Discontinuance, or if a Verdict pass against him, the Defendants shall recover their Treble Costs; for which they shall have the like Remedy, as in any Case where Costs, by the Law, are given to Defendants;" the same, being twice read, was, upon the Question, agreed unto.

And the Fourth Proviso, reported to be added to the said Bill, being, "Provided also, and it is hereby Enacted, That no further Aid or Supply of Money to the King, by Parliament, in Charge of the People, shall, at any Time hereafter, be granted or levied, by way of monthly Assessment;" the same, being twice read, was, upon the Question, agreed unto.

And the Fifth Proviso, reported to be added to the said Bill, being, "Provided, that no Auditor of his Majesty's Exchequer, or other Officer, shall, upon Allowance to be made to any Person or Persons, assessed within this Act, for any Fee-farm Rent, due to his Majesty, or the Queen Dowager, take or receive any other Fee for the same, than the Sum of Four-pence, for any Debt upon such Allowance;" the same, being twice read, was, upon the Question, agreed unto.

And the First Amendment in the Preamble, being P. 1. L. 3. after "Act of," add "free and general Pardon, Indemnity, and;" the same was read the Second time.

Resolved, That this House doth agree with the Committee to the said Amendment.

And the Second Amendment in the said Preamble, being P. 1. L. 6. after "Purposes," add "under the late tyrannical and usurping Powers;" the same was read the Second time.

Resolved, That this House doth agree with the Committee to the said Amendment.

And the Third Amendment in the said Preamble, being Page 1. L. 11. to put out the Word "Two," and insert, instead thereof, "and also at Jamaica, Three;" the same was read the Second time.

Resolved, That this House doth agree with the Committee to the said Amendment.

And the Fourth Amendment in the said Preamble, being P. 1. L. 14. instead of the Word "Spouse," insert "Consort;" the same was read the Second time.

Resolved, That this House doth agree with the Committee to the said Amendment.

Resolved, upon the Question, That such of the Members of this House, as are of his Majesty's most honourable Privy Council; together with the Lord Bruce, do wait upon his Scared Majesty; and do present unto him the humble Desires of this House, That Threescore thousand Pounds, of the Eighteen Months Assessment, be distributed, as his Majesty, in his Princely Wisdom, shall think fit, amongst such of his Majesty's loyal and suffering Subjects, who have faithfully and constantly served his Majesty, and his Royal Father, in the Wars, that are most necessitous: And, when the Bill for raising the said Eighteen Months Assessment, is sent up to the House of Lords, the said Members of this House are then to wait upon his Majesty with this Message. And the several Members of this House, who serve for the respective Counties, are to deliver in to the Clerk Assistant, now attending, before the House shall sit To-morrow Morning, the Names of Commissioners to be added to the said Bill; to the End the same may then be added, and the Bill be perfected, before this House do proceed to any other Business.

Mr. Speaker to reconcile a Quarrel.

Ordered, That Mr. Speaker be desired to reconcile Mr. Lovelace, and the Party with whom he hath been at Difference: And that the said Mr. Lovelace be thereupon freed from the Custody of the Serjeant at Arms attending this House.

Relief of Loyalists.

Resolved, That all that come to the Committee for Relief of his Majesty's loyal and suffering Subjects, shall have Voices at the said Committee.

And then the House adjourned till To-morrow Morning, at Eight of the Clock.
