Prayers.

Privilege.

ORDERED, That * Appleyard be sent for in the Custody of the Serjeant at Arms, attending this House, for his Breach of Privilege, in proceeding to Tryal against a Tenant of Mr. Cooke, a Member of this House, concerning Tythes, after he had Notice given, that Mr. Cooke was concerned in the Title.

Defaulters to Call of the House.

Ordered, That Sir Wm. Hickman, Mr. Jones, Sir John Fagg, and Sir Norton Knatchbull, be excused for not attending the House on Monday last, and struck out of the List of Defaulters.

Corporations.

Ordered, That these Members following be added to the Committee appointed to inspect the Act for the better regulating Corporations; viz. Sir Courtney Poole, Colonel Strangwayes, Sir Hen. E. of Portland's Estate.

A Bill for settling an Annuity of Three hundred Pounds per Annum upon Charles Earl of Portland, and for the Benefit of Willoughby Whitelock, Bulstrode Whitelocke, and Carleton Whitelocke, Infants; and for Confirming of Agreements made, to compose Suits in Law against them; was this Day read the Second time.

Resolved, &c. That the said Bill be committed to Mr. Geo. Mountague, Sir Lanc. Lake, Mr. Clifford, Sir Tho. Lyndsey Level.

Ordered, That the Petition of Mr. Nathaniell Staughton be referred to the same Committee to which the Bill of Sir Wm. Killigrew, and Sir Henry Heron, for the Draining of Lyndsey Level, is re-committed; to take the said Petition and Claim of Mr. Staughton into Consideration.

Preventing Popery, &c.

Sir Robert Atkyns reports from the Committee to which the Bill to prevent the Growth of Popery was re-committed, several Amendments to be made, and Provisoes and Clauses to be added, to the Bill: Which he read with the Coherence, in his Place; and after delivered the same in at the Clerk's Table.

The Amendments, Provisoes, and Clauses, were read the First time.

The First Amendment to the Third Folio of the Bill, being to leave out the Two last Lines, and the Fourth Folio wholly, and all the Fifth Folio, until you come to the Words "all which Forfeitures;" and to insert what is contained in Five Sheets of Paper; was read the Second time: And the First Paragraph of the Five Sheets was also read the Second time.

Ordered, That, after the Word "Wales," in the Sixth Line of the First Folio, these Words be added, "and Town of Berwick upon Tweed."

Resolved, &c. That the First Paragraph, so amended, be agreed to.

The Second Paragraph was read the Second time.

The Question being put, To agree to this Paragraph;

The House was divided.

The Yeas went out.

And so it passed in the Negative.

Resolved, &c. That it be re-committed to the former Committee to bring in a Clause to supply the Paragraph rejected upon the present Debate of the House; and that the Committee be revived for that Purpose: And they are to meet To-morrow at Two of the Clock in the Afternoon, in the Place formerly appointed.

Marq. of Winchester's Award.

Upon Information, That one John Parry, a Scrivener, had in his Hands a Deed of Uses of a Fine, and Two Recoveries, and other Writings, concerning the Estate of the Marquis of Winchester, which are necessary to be used before the Committee to which the Bill concerning the Lord Marquis of Winchester, and the Lord St. John, is committed;

Ordered, That the said John Parry do forthwith, upon Sight of this Order, deliver into the Hands of Mr. Hungerford, Chairman of the said Committee, or such Person as he shall appoint to receive the same, all such Deeds and Writings as he hath in his Custody, concerning the Lord Marquis of Winchester, or the Lord St. John.

Committees on Revenue.

Ordered, That the Committees for the King's Revenue do sit this Afternoon.

Leave of Absence.

Ordered, That the Lord Herbert, and Mr. Fowell, have the Leave of this House to go into the Country.
