Prayers.

Pension to Gardiner.

ORDERED, That the Council of State do give Order for the present Payment of the Pension of Twenty Shillings a Week, to Maurice Gardiner Merchant: And that the Petition of Maurice Gardner, of London, Merchant, be referred to the Committee of Inspections; to examine the Matter of Fact; and consider, How the Petitioner may be relieved; and report their Opinion therein to the Parliament.

Sir A. Dick.

Ordered, That the Protection formerly granted to Sir Andrew Dick, for Six Months, be, and is hereby continued for Six Months longer: And that Mr. Speaker do sign a Protection, accordingly.

Army Appointments.

A List of the Names of Officers in Colonel Smithson's Regiment, late Colonel Robert Lilburne's was read; and are as followeth; viz.

Sir Arthur Hesilrig reports, the several Lists following; viz.

A List of Names of Officers of Colonel Thomas Saunders' Regiment: Which was read.

A List of Colonel Nathaniel Whetham's Regiment: Which was read.

A List of Names of Officers in the Regiment of Colonel George Twisleton: Which was read.

He also reports, that John Greene may be CaptainLieutenant, and Mathew Boynton Cornet, in Colonel Matthew Alured his Regiment:

And that Colonel Thomas Eyre be Governor of HurstCastle in Hampshire.

And that John Stiler may be Captain in Colonel George Fleetwoode's Regiment in the Room of Captain John Dober; and that Barnaby Lisle may be an Ensign in the said Regiment, in the room of Joseph Jones:

And that Major Henry Wansey be Governor of the Isle of Guernsey; and to be Captain of a Foot-Company in the said Island:

And that the respective Officers in Colonel Henry Lillingston's Regiment, hereafter expressed, be reported to the Parliament, for their Approbation; viz.

Colonel Lambert.

Mr. Nicholas Love reports from the Council of State, That the Council is informed, That Colonel Lambert is, or lately was, secretly in London; with the Council's Opinion, That, in order to the Commonwealth's Service, he may, by their Order, be summoned, under Penalty, to appear before the Council of State, on Monday next; and give Security before the Council, to do nothing to the Prejudice of this Commonwealth; and forthwith, after such Security given, to depart the Town, to Holmby; and not to remove thence without Order from the Parliament.

The Question being propounded That the Parliament doth agree with the Council of State, That Colonel Lambert be summoned under a Penalty, to appear before the Council of State, on Monday next; and give good Security before the Council, to do nothing to the Prejudice of this Commonwealth; and forthwith, after such Security given, to depart the Town to Holmby; and not to remove thence without Order from the Parliament;

And the Question being put, That that Question be now put;

It passed with the Negative.

Ordered, That it be referred unto a Committee, who are to withdraw, to prepare Summons, upon the Debate in the House, to summon Colonel John Lambert: Viz. unto Mr. Say, Lord Lisle, Mr. West, Sir Peter Wentworth, Mr. Dormer, Mr. Love; or any Three of them.

Irish Affairs.

Ordered, That Lieutenant-General Ludlow do give an Account to the Parliament of the Affairs in Ireland, on this Day Sevennight.

Elections.

The House resumed the Debate upon the Report touching the Qualifications.

The First Paragraph was read.

Resolved, That all and every Person and Persons, seised of an Estate or Freehold, in Possession in his own Right, or in Right of his Wife, of the clear yearly Value of Forty Shillings by the Year, above all Reprizes, shall be capable to elect Members to serve in Parliament for the respective Counties in England and Wales, so as he or they be not disabled by this Act.

The next Paragraph was read.

The Question being put, That this Clause in this Paragraph; viz. "And forasmuch as the Good and Welfare of the People of this Commonwealth, doth depend, next under the Blessing of Almighty God, on the Constitution of Parliaments; and because it is the Duty of this Parliament, as much as in them lieth, to provide for the certain Choosing, Meeting, and Sitting of Parliaments, with such Qualifications, and other Circumstances of Freedom, Choice, and Equality, in Distribution of Members, as may most conduce to the lasting Freedom and Good of this Commonwealth;" do stand in this Paragraph;

It passed with the Negative.

Resolved, That these Words, "advised, or any ways," be added, in this Clause, next after the Word, "assisted;" and that these Words, "and are hereby," be added next before the Word "disabled."

And the said Clause, so amended, being put to the Question, was agreed upon: And so It was

Resolved, That such Person and Persons, who have advised, aided, or any ways assisted or abetted the Rebellion of Ireland; and those who do or shall profess the Popish Religion; be, and are hereby disabled, and made uncapable, for ever to be elected, or to give any Vote in the Election of any Member to sit or serve in Parliament.

And the next Paragraph being read;

Resolved, That these Words; viz. "unless he or they have since been restored, and made capable, by this Parliament;" be added, next after the Words "since the First Day of January 1641;" and that the rest of the Clause following be omitted.

Resolved, That these Words; viz. "or been employed by Commission from this Parliament, since the 7th of May 1659, and have since continued faithful to the Parliament;" be added to this Clause, next after the Words "capable, by this Parliament."

Ordered, That this Debate be adjourned until Tomorrow Morning, Eight a Clock.
