Thursday, the 30th of April, 1657.

Forests and Chases.

RESOLVED, That it be referred to a Committee, to consider of the Clause in an Ordinance, intituled, An Ordinance for Sale of Four Forests or Chases, reserved for collateral Security to the Soldiers; beginning thus: viz. "And for the better quieting of Purchasers, their Heirs or Assigns, it is hereby ordained and declared, That all Honours, Manors, Lands, &c." and continuing unto the End of the said Ordinance; and to offer their Opinion therein to the House; Viz. General Disbrow, Colonel Jones, Mr. Grove, Mr. Tho. Gorges, Mr. Bampfeild, General Mountagu, Sir Charles Wolsley, Mr. Pedley, Colonel Grosvener, Mr. Whiteway, Major-General Bridges, Mr. Godfrey, Lord Commissioner Whitelock, Sir Thomas Pryde, Colonel Thistlethwaite, Sir Wm. Strickland, Mr. Maidston, Colonel Cooper, Lord Broghill, Mr. Crook, Mr. Crompton: And this Committee are to meet at Two of the Clock this Afternoon, in the Speaker's Chamber.

Chancery Court.

Resolved, That it be referred to a Committee, to take into Consideration the Regulation of the Court of Chancery; and to bring in a Bill in that Behalf, if they see Cause: Viz. to Sir Thomas Wroth, Mr. Godfrey, Lord Commissioner Whitelock, Mr. Bampfeild, Mr. Grove, Mr. Hoskins, General Disbrow, Colonel Gorges, Major-General Goff, Mr. Carey, Sir Thomas Pryde, Major Aston, Mr. Pedley, Mr. Disbrow, Major-General Haines, MajorGeneral Berry, Captain Blackwell, Major-General Packer, Mr. Attorney-General, Mr. Jenkinson, Major Burton, Mr. Drake, Sir John Trevor, Sir Lislebon Long, Mr. Francis Bacon, Colonel Cock, Mr. Secretary, Mr. Bond, Mr. Bennett, Mr. Moody, Colonel White, Colonel Zanchy, Lords Commissioners of the Great Seal, Sir Charles Wolsley, Mr. Brisco, Mr. Bodurda, Master of the Rolls, Lord Strickland, Mr. Gyles, Colonel Jones, Mr. Nath. Strickland, Mr. Solicitor, Attorney of the Duchy, Mr. Wall, Lord Broghill, Colonel Shuttleworth: And all that come to this Committee to have Voices: And this Committee are to meet on Monday in the Afternoon, at Two of the Clock, in the Duchy-Chamber: With Power to send for Persons, Papers, Witnesses, and Records.

E. of Derby's Estate.

Resolved, That one Act, intituled, An Act for settling Lands, late of James Earl of Derby, of the yearly Value of Five hundred Pounds, upon Charles Earl of Derby, and his Heirs, do continue and stand in Force, until other Order taken by the Parliament.

Resolved, That all and every the Acts and Ordinances before-mentioned, according to the true Meaning of them, with the Amendments, Alterations, and Additions aforesaid, in pursuance of the Resolutions before-mentioned; and according to the respective Limitations of Time before expressed, and no otherwise, nor in any other Manner; be continued, and stand in Force, and be effectual in Law.

The Clause of the Report, touching all other Acts and Ordinances, not confirmed, &c. being read;

And the Question being put, That the Twenty-eighth of April 1657 do stand in this Clause;

It passed with the Negative.

Resolved, That these Words; "The First Day of June," be inserted.

And the Clause so amended, being put to the Question; It was

Resolved, That all other Acts and Ordinances, and every Branch and Clause therein, not confirmed as afore said, made or passed after the Twentieth of April 1653, before the Seventeenth of September 1656, be declared to be, from and after the First Day of June 1657, null and void; and that all Acts done, or to be done, before the said First Day of June 1657, by virtue of them, or any of them, be ratified and confirmed to all Intents and Purposes.

E. of Pembroke's Debt.

An Order of the Lord Protector and the Council, dated the Eleventh of May 1654, upon the Petition of Algernon Earl of Northumberland, Thomas Lord Coventry, Philip Earl of Pembroke, Heir, and Wm. Earl of Salisbury, and others, the Executors, of Philip Earl of Pembrook and Mountgomery, deceased, touching a Debt, for which Bonds were given to Mr. Flyer and others, was this Day read.

Ordered, That this Business be referred unto a Committee, to examine the Business, and report their Opinion to the House, as well for the Indemnifying of the Persons engaged, as how the Remainder of the said Debt may be satisfied; and in the mean Time, that all Prosecution at Law against the Persons bound in the Bonds for the said Debt, or either of them, and against all and every their Heirs, Executors, and Administrators, . . . stayed: Viz. to Sir Christofer Pack, Lord Broghill, Alderman Foote, Mr. Floyd, Sir Rich. Onslow, Colonel Jones, Mr. Bond, Mr. Bodurda, General Disbrow, Lord Strickland, Sir Charles Wolsley, Colonel Thistlethwaite, Mr. Barington, Sir Thomas Wroth, Mr. Peckham, Mr. Hoskins, Master of the Rolls, Alderman Tigh, Captain Baines, Captain Hatsell, Mr. Downing, Major Beake, Lord Howard, Mr. Carter, Mr. Fowell, Mr. Banks, Captain Lilborne, Mr. Goodwin, Mr. Godfrey, Colonel Phillips, Colonel Wood, Mr. Timbs, Mr. Drake, Mr. Noell, Mr. Disbrow, Colonel Wilton, Mr. Williams, Mr. Recorder of London, Mr. Waterhouse, Colonel White, Captain Stone, Mr. Crooke: And this Committee are to meet on Tuesday next in the Afternoon, at Two of the Clock, in the Inner Court of Wards; and that they bring in their Report to the House, within Fourteen Days then after: With Power to send for Persons, Papers, Witnesses, Records.

Confirming Acts.

The Question being propounded, That, touching the Acts and Ordinances made from the First of April 1642, until the Twentieth of April 1653, this Answer be tendered unto his Highness, That this House doth conceive no Need of any Declaration or Confirmation, the same being valid in themselves, and ought to be so accepted and taken;

And the Question being put, That these Words, "Wherein as to the Matter of them, they are not contrary to the humble Petition and Advice," be Part of the Question;

The House was divided.

The Yeas went forth.

So it passed in the Negative.

And the main Question being put; It was

Resolved, That touching the Acts and Ordinances made from the First of April 1642, until the 20th of April 1653, this Answer be tendered unto his Highness: That this House doth conceive no Need of any Declaration or Confirmation; the same being valid in themselves, and ought to be accepted and taken.

Resolved, That this Proviso be added: "Provided, That this be not construed to extend to the Confirming of the Matter of any Act or Ordinance of Parliament, which is contrary to the humble Petition and Advice, presented to his Highness by the Parliament."

Resolved, That nothing in this Report be binding, or of Force, before the humble Petition and Advice be consented unto by his Highness.

Resolved, That the same Committee who did formerly attend the Lord Protector, touching the humble Petition and Advice, do attend his Highness with the several Resolves of Parliament touching the Matter; and to desire his Highness to appoint a Time, when the House may attend his Highness, for his positive Resolution and Answer to that humble Petition and Advice.

Ordered, That this Committee do meet this Afternoon, at Four of the Clock, in the Speaker's Chamber.

Report deferred.

Resolved, That the Report touching some Orders of the Long Parliament, be made by the Lord Broghill, Tomorrow Morning.
