ORDERED, That Mr. Skutt, a Member of this House, shall have Leave to go into the Country.

Barton's Claims.

The humble Petition of Colonel Wm. Barton was this Day read: And

Whereas the Sum of Three thousand One hundred Forty-three Pounds Eleven Shillings Ten-pence is due to Colonel Wm. Barton, for Money lent by him to the Service of the Parliament, upon the Credit of an Ordinance, enabling Sir Thomas Middleton to take Subscriptions, for the Raising of Forces for the Reducing the Six Counties of North Wales, and for Prevention of the Access of Irish Forces into those Parts; together with Interest for the same, comprised until the First of January 1646: And whereas the Sum of One thousand Five hundred Twenty-four Pounds Eighteen Shillings appears to be due to the said Colonel Wm. Barton, for his Pay in the Service of the Parliament, as the same is audited by the Committee for taking the Accompts of the Kingdom, whereof Five hundred Ninety-six Pounds Fourteen Shillings is to be respited upon the Publick Faith; the which being deducted, leaves the Debt due, and presently payable, unto Colonel Wm. Barton, at the Sum of Four thousand Seventy one Pounds Fifteen Shillings Ten-pence:

It is Ordered, upon the Question, That the said Sum of Four thousand Seventy-one Pounds Fifteen Shillings Tenpence be paid unto the said Colonel Wm. Barton by the Committee at Goldsmiths Hall, out of the Fines and Compositions of Sir Piercy Herbert Knight, Sir John Owen Knight, Wm. Salisbury, of Reake, Esquire, Mr. Wm. Price, late Knight for Merionethshire, Roger Mostien and John Bodevile Esquires, or any one or such of them whose Fines are not yet particularly assigned: And that for the Payment of the Sum of Five hundred Ninety-six Pounds Fourteen Shillings, respited upon the Publick Faith, he shall have and hereby hath the Publick Faith of the Kingdom: And that the Acquittance of the said Colonel William Barton shall be a sufficient Warrant and Discharge to the Committee at Goldsmiths Hall, and the Treasurers there, for the Payment of the said Sum of Four Thousand Seventy-one Pounds Fifteen Shillings . . . . accordingly.

Ordered, That the Lords Concurrence be desired herein.

Oxford University.

Mr. Rous reports, from the Committee, the Amendments to the Ordinance for the better Regulating the University of Oxon; and likewise the Names, to be inserted in the Ordinance, of Persons to be Visitors of the said University: The which were twice read.

The Question being put, Whether Mr. Edward Corbett, Mr. Henry Wilkinson, Dr. John Wilkinson, Mr. Edward Reynolds, Mr. Robert Harris, Mr. Francis Cheynell, Mr. John Wilkinson, Mr. Christofer Rogers, shall be named in this Ordinance for Regulating the University of Oxon, to be Visitors of the said University;

It passed with the Affirmative.

The Question being put, Whether the Question shall be put upon Mr. Apletree;

It passed with the Negative.

The Question being put, Whether the Question shall be put upon Mr. Vincent Barry;

It passed with the Negative.

The Question being put, Whether Mr. John Pulleston, Mr. Wm. Pryn, Sir Wm. Cobb, Mr. George Greenwood, Mr. Wm. Coe, Mr. Wm. Tipping, Mr. John Mylles, Mr. John Packer, Mr. Bartholomew Hall of the Middle Temple, Sir Nathaniell Brent, Mr. Thomas Knight of Lincolnes Inn, Mr. John Heling of Greies Inn, shall be Visitors of the University of Oxford;

It passed with the Affirmative.

The Amendments passed upon the Question.

Resolved, &c. That the Number of the Members of this House that shall be of the Committee in this Ordinance, shall be Twenty.

Resolved, &c. That Sir John Danvers, Sir Christofer Yelverton, Mr. Selden, Mr. West, Mr. Rous, Mr. John Crew, Sir Wm. Lewes, Mr. Whitelock, Sir Thomas Widdrington, Mr. Poole, Sir Peter Wentworth, Colonel Leigh, Mr. Nath. Fienis, Mr. Walter Long, Sir Phil. Stapilton, Mr. Wheeler, Mr. Swynfen, Mr. Sam. Browne, Mr. Love, Sir Wm. Brereton, Members of the House of Commons, shall be of the Committee named in this Ordinance.

Resolved, &c. That the Lords to be of this Committee named in this Ordinance, shall be named here.

Then the House proceeded to the Naming of the Lords: And they were all, by Mr. Speaker, particularly put to the Question; and were as followeth:

Algernon Earl of Northumberland, Henry Earl of Kent, Philip Earl of Pembroke and Mountgomery, Theophilus Earl of Lincoln, Wm. Earl of Salisbury, Robert Earl of Warwick, Edward Earl of Manchester, Wm. Lord Viscount Say and Seale, Philip Lord Wharton, John Lord Roberts.

Then the Ordinance was put to the Question; and, upon the Question, with the Amendments, passed; and was ordered to be sent unto the Lords for their Concurrence.

Mr. Rous is appointed to carry it to the Lords for their Concurrence.

Church Government.

Ordered, That, on Wednesday next, peremptorily, the first Business, the House do take into Consideration the Obstructions in the Government of the Church: And that Mr. Speaker do put the House in mind hereof.

Resolved, &c. That the House do meet this Afternoon at Two of Clock, to take into Consideration the Ordinances for putting Ministers into Churches: And that no other Business do intervene.

Oxford University.

Resolved, &c. That it be referred to the Committee for the University of Oxon, to take such Order in this Business, concerning the Proctors of the University, as to them shall seem best and most sitting.

Massie's Brigade.

An Ordinance for the Payment of the Sum of Five hundred Pounds, by the Committee at Goldsmiths Hall, unto Colonel Edward Massy, out of the Fines of Sir John Pettus, Mr. Wm. Cullam, Sir Edward Thomas, or one of them, for the Relief of some Soldiers, late of Colonel Massie's Brigade, in the West, in lieu of Five hundred Pounds ordered to be paid unto the said Colonel Edward Massy, for the Uses aforesaid, out of the Fines of such Delinquents as the Committee of the West should nominate unto the said Committee at Goldsmiths Hall, the which proved ineffectual, was this Day read; and ordered to be carried to the Lords, for their Concurrence, by Colonel Harvey.

Bishop's Delinquency.

Mr. Rigby carried to the Lords, for their Concurrence, an Order for taking off the Delinquency and Sequestration of Mr. Henry Bishop, upon the earnest Desire of the Colony of Virginia.

Business deferred.

Resolved, &c. That on Saturday come Sevennight, the House do take into Consideration the Business concerning the Writs of Habeas Corpora, issued out by the Judges, for Returning of Prisoners that are Prisoners of this House: And that, next to that Business, the House do take into Consideration the Report concerning the Lady Wilde and Mr. Reeve.

Privilege.

Resolved, &c. That Mr. Holles and Mr. Selden do go unto the Judges of the King's Bench To-morrow Morning, while they are sitting; and acquaint them, That Sir Hugh Pollard is a Prisoner of this House; and that the Business concerning him is at present under the Consideration of this House; and therefore that they should forbear any Proceedings in this Business.

Delinquent Ministers, &c.

Ordered, That, To-morrow, after the Business of Excise, the House do take into Consideration the Ordinance for preventing Delinquents Ministers to return to their Churches; and all Delinquent Lawyers, and Delinquent Attornies, to practise.

Delinquent Patrons.

Ordered, That the Committee where Mr. Rigby has the Chair, appointed to consider how the Churches where Delinquents are Patrons, upon Vacancy, may be filled, be revived: And that they do meet de die in diem; and, with all convenient Speed, report it to the House.

Message from Lords.

A Message from the Lords, by Sir Edward Leech and Mr. Page;

The Lords have commanded us to deliver unto you a Report, from the Committee of the Admiralty, for the Hiring of certain Merchant Ships to be of this next Summer's Fleet: The Lords do agree to the Report; and desire the Concurrence of this House.

They have sent an Ordinance for the Vacating of the Patents of some Clerks of the Privy Council: Wherein they desire the Concurrence of this House.

They have commanded us to deliver unto you Three Petitions; One of Captain Wm. Gregory, which they especially recommend to the Consideration of this House, in regard he hath deserved very well of the Parliament; One of James Love, especially recommended; One of Mr. Edward Goodwyn, especially recommended.

They have commanded us to put you in mind of an Ordinance, for the Removing of the Library at Lambeth to Cambridge. Of the Petition of one Marke Hawkins; of Dr. Gibbons: Which they desire you to take into Consideration.

They desire a Conference, by Committees of both Houses, concerning an Ordinance they formerly sent unto you, for putting down all Country Committees, To-morrow at Eleven of Clock, in the Painted Chamber, if it may stand with the Conveniency of this House.

Navy.

The Report from the Committee of the Admiralty, for Hiring of certain Merchants Ships, for the next Summer's Fleet, was read; and ordered to be taken into Consideration To-morrow Morning.

Clerks of Privy Seal.

An Ordinance for Vacating of the Patents of the Places of John Castle Esquire, Wm. Watkins, and Thomas Watkins Clerks of the Privy Seal, was this Day read the First and Second time; and, upon the Question, committed unto Mr. Burrell, Mr. Knightley, Colonel Harvey, Mr. Maynard, Mr. * Bacon, Mr. Robinson, Mr. * Allen, Mr. Swynfen, Sir Wm. Allenson, Mr. Salwey, Sir John Curson, Sir Robert Harley, Mr. Tate, Mr. Holles, Sir Henry Heyman, Sir John D' Ancers, Sir John Dryden; or any Three of them: Are to meet upon it To-morrow, at Eight of Clock, in the Court of Wards.

Lambeth Library.

The Ordinance, formerly sent from the Lords, for granting and confirming to the University of Cambridge the Library of Richard Bancroft, late Archbishop of Canterbury, over the Cloysters in Lambeth House, was this Day read: And, with the Leaving out of one Clause; viz. "and all other Books, Writings, and Things, of or belonging to the Library of the Archbishops of Canterbury at Lambeth;" the Ordinance, upon the Question, passed. And

It is Ordered, That it be returned to the Lords with that Amendment.

Ordered, That the Committee for the Library at Lambeth do peruse the Books of Dr. Richard Bancroft, late Archbishop of Canterbury, bequeathed to the University of Cambridge, to see if there be any that do concern the State: And Mr. Nathaniell Fienis, Mr. Strickland, Mr. Bois, Mr. Gott, and Sir Henry Heyman, are added to this Committee, as to this Business.

Dover Water Bailiff.

The Ordinance for bestowing the Office of his Majesty's Water Bailiff, and Keeper of the Prison of the Town and Port of Dover, in the County of Kent, upon Mr. Edward Goodwyn, sent from the Lords, was this Day read; and, upon the Question, passed.

Navy.

Mr. John Rolle reported from the Committee of the Admiralty and Cinque Ports, the Names of Thirteen Merchants Ships, bearing upon them, in the Whole, One thousand Five Men, with the Names, to be employed towards the Completing of the next Summer's Fleet; with the Names of the particular Captains, and Burdens of Ships, and Number of Men; the which was the same with the Report sent from the Lords: The which was read: And

It is Resolved, That this House doth concur with the Lords therein.

Conference agreed to.

Resolved, &c. That the House doth agree to a Conference, To-morrow at Eleven of Clock, in the Painted Chamber, by Committees of both Houses, as is desired by the Lords.

Answer to Lords.

Answer returned by the same Messengers; That this House has considered their Lordships Message; and does agree with the Lords in the Report concerning the Thirteen Merchants Ships, hired for the next Summer's Fleet: To the Ordinance for Edw. Goodwyn to be Water Bailiff, and Keeper of the Prison of the Town and Port of Dover: To the Conference to be To-morrow at Eleven of Clock, as is desired: To the rest, they will send Answer by Messengers of their own.

Ivy Rectory.

AN Ordinance for constituting Mr. John Bancks Rector of Ivy Church in the County of Kent, formerly sent from the Lords, was this Day read; and, upon the Question, passed: And

It is Ordered, That Mr. Bancks presently quit the Place of one of the Six Preachers in the Church of Canterbury, which he now hath.

It is further Ordered, That the Person that shall be preferred to the Church of St. John's, in the Isle of Thanett, which Mr. John Bancks is now to quit, shall have the Preacher's Place in Canterbury, which Mr. Bancks is now likewise to quit; and shall perform the Duty of one of the Six Preachers there.

Minhencott Rectory.

An Ordinance for appointing Mr. Samuell Austen Rector of Minheneott in the County of Cornwall, formerly sent from the Lords, was this Day read; and, upon the Question, committed unto Mr. Sandis, Mr. Nicoll, Mr. Wheeler, Sir Robert Harley, Mr. Morley, Mr. Grimston, Mr. Blakiston, Sir John Francklyn, Mr. Scawen, Mr. Buller, Sir Robert Pye, Sir Richard Skevington, Mr. Walther Long, Mr. Knightley, Mr. Bond, Mr. Waddon, Mr. Massam, Sir John Barrington, Sir Richard Lucy, Mr. Maynard, Mr. Edw.
