Scarborough Garison.

A Letter from the General, from Kingston, of 20 Augusti 1647, recommending the Consideration of the Necessities of the Garison of Scarborough, was this Day read: And

It is Ordered, That the Consideration of this Garison be referred to the Committee of the Northern Association, or any Four of them, as to this Business: Who are to consider, How sitting Accommodations may be made for the Lodging of the Soldiers, and for Repairing and Preservation of the said Place.

Message from Lords.

A Message from the Lords, by Mr. Page and Dr. Aylett;

The Lords have commanded us to deliver unto you an Ordinance for the Militia of Westminster, and Parishes adjacent: An Ordinance for the Militia of the Borough of Southwark, and Parts adjacent: An Ordinance for the Trained Bands and Auxiliaries of the Hamlets of the Tower, to be under the immediate Command of Sir Thomas Fairefax: In all which they desire the Concurrence of this House: An Order concerning the Mayor of Worcester; which first moved from this House; and they have agreed unto it, with some Amendments; in which they desire the Concurrence of this House.

Westminster Militia.

The Ordinance for the Militia of Westminster, and Parishes adjacent, was this Day read the First and Second time; and, upon the Question, passed.

Southwark Militia.

The Ordinance for the Militia of the Borough of Southwark, and Parts adjacent, was read; and, upon the Question, passed.

Trained Bands, &c.

The Ordinance for putting the Trained Bands and Auxiliaries of the Hamlets of the Tower under the immediate Command of Sir Thomas Fairefax, Constable of the Tower, was this Day read; and, upon the Question, passed.

Mayor of Worcester.

The Amendments to the Ordinance concerning the Mayor of Worcester were read; and all agreed, except the last; the which was changed into this Proviso; viz. "Provided, That this shall not extend to any Person or Persons, who have been or shall be unduly sequestered as Delinquents, and have been or shall be therefore discharged from the said undue Sequestration, by both Houses of Parliament, or by the Committee of the Lords and Commons for Sequestrations."

Reports deferred.

Ordered, That the Reports concerning Lieutenant Colonel Lilbourne, concerning Lancashire, and concerning the Allowances and Subsistence of Prisoners, be made peremptorily, in the first Place, at the next Sitting of the House: And Mr. Speaker is to put the House in mind of this Order: And that the Report concerning Lieutenant Colonel Lilbourne be made in the first Place.

Answer to Lords.

Mr. Sallwey carried to the Lords, for their Concurrence, the Amendments to the Lords Amendments to the Ordinance, That no Person in Arms, &c. shall be Mayor, Sheriff, &c: The Amendments to the Lords Amendments to the Ordinance concerning the Mayor of Worcester: The Ordinance concerning the Allowance assigned to the Ministers sent to Oxon.

Navy.

Upon the Report made from the Committee of the Admiralty and Cinque Ports;

It is Resolved, &c. That this House doth approve of the Number of the Ships reported from the Committee of the Admiralty and Cinque Ports, and now read, to be appointed and fitted for the next Winter's Guard, leaving out only the Ship Lion.

This House doth further approve of the Number of Men assigned by the Report to the said particular Ships; the Ship Lion being left out.

Ordered, That the Committee of the Navy do take care, and give Directions to the Victuallers, to make Provision of Victuals for the Men appointed for the Ships of the next Winter's Guard, for Six Months.

Ordered, That, in regard the Season of the Year is at hand, for making Provision of Beef and Pork for the next Summer's Fleet, that the Committee of the Navy do take care, and give Order to the Victuallers, to make Provision of Victuals for Four thousand Men, for Eight Months, for the next Summer's Fleet.

Resolved, &c. That Colonel Rainsborough, Sir Henry Vane, Sir Henry Mildmay, Henry Marten and Nathaniell Fienis Esquires, be added to the Committee of Lords and Commons for the Admiralty and Cinque Ports.

The Lords Concurrence to be desired herein.

Resolved, &c. That Colonel Rainborouge, Sir Henry Vane, Sir Henry Mildmay, Henry Marten and Nathaniell Fienis Esquires, be added to the Committee of the Navy.

Ordered, That it be referred to the Committee of the Admiralty and Cinque Ports, to consider of Commanders to command the next Winter's Guard; and to present the Names of them to this House, for their Approbation.

Mr. Bourchier.

Ordered, That Mr. Bourchier be, from this House, especially recommended to the Committee of the Excise, and the Committee of . . . Navy and Customs, for such Place within their Power or Cognisance, as shall first happen fitting for him: And the said Committees are respectively required to take care, that, when any shall become void, that the said Mr. Bourchier be duly thought on, and remembered to be thus recommended.

Irish Affairs.

Ordered, That the Letters from the Lord Broghill to the Lord Lisle be referred to the Committee for the Affairs of Ireland, at Derby House: Who are to consider of them this Afternoon.

Sir Robert Pye brings Answer, That the Lords will send Answer to the Message carried by him by Messengers of their own.

Mr. Sallwey brings Answer, That the Lords do agree to the Alterations in the Amendments, made by this House, to the Ordinance, That no Person, that hath been in Arms, &c. shall be Mayor, &c.; and to the Ordinance concerning the Mayor of Worcester; and to the Order concerning the Ministers sent down to the University of Oxon.

RESOLVED, &c. That the Great Seal of England be continued in the Custody of Edward Earl of Manchester, Speaker of the House of Peers pro tempore, and of Wm. Lenthall Esquire, Speaker of the House of Commons, in the same Manner, and with the same Powers and Authorities, as now it is, until the Tenth day of December next.

It is further Ordered, That the Commission for hearing Causes in Chancery be continued in the same Manner as now it is, for the same Term of Time, until the Tenth of December next.

Slighting City Lines.

A Message from the Lords, by Dr. Aylett and Mr. Page;

The Lords have commanded us to bring unto you Two Ordinances, both concerning the slighting the Works and Lines of Communication: The Lords have passed them; and desire the Concurrence of this House.

The Ordinance, now sent from the Lords, for selling the Materials belonging to the Forts and Works upon the Lines of Communication, was read; and, upon the Question, passed.

Removing Malignants.

Ordered, That the several and respective Committees of the Militia of London, Westminster, Borough of Southwark, and Hamlets of the Tower, do take care, and put in due Execution the several Ordinances, formerly passed both Houses, for putting Reformadoes and Malignants out of the Lines of Communication; and so far distant from these Parts as the said several and respective Ordinances do limit and appoint.

Copley disabled from being a Member.

The House being informed, That Colonel Copley, who was withdrawn, desired to speak something to the House;

He was called down: And Mr. Speaker acquainted him, That the House being informed, That he desired to speak something to the House, he had Liberty to speak.

Upon Colonel Copleye's Desire, the Depositions and Informations against him were again read by the Reporter: To which he gave his Answer in general; and to some in particular: And desired Time to examine his Witnesses; and that he may have Counsel: And then withdrew.

Resolved, &c. That Lyonell Copley Esquire be disabled from being a Member of this House.

Resolved, &c. That Lionell Copley Esquire be committed Prisoner to the Tower of London, during the Pleasure of this House.

Colonel Copley being called down again, and brought to the Bar by the Serjeant, and kneeling there, Mr. Speaker acquainted him with the Judgment of the House passed upon him, That he was disabled from being a Member of this House; and was committed Prisoner to the Tower, during the Pleasure of the House.

Army Estimates, &c.

Mr. Scawen reports from the Commissioners residing with the Army, an Estimate of the Forces now under Pay in this Kingdom, and of those that are to be continued in this Kingdom for the Security thereof; and of those that may be employed for the future Relief of Ireland; out of what Forces those that are to be employed for Ireland are to be completed; the Proportion of Arrears to be paid to the said Forces; and the Way for stating the Accompts, and settling the Certainty of the Arrears of the said Forces.

He further reported an Estimate of the monthly Charge of the Horse and Foot, to be employed for England and Ireland; and an Estimate of the Charge of the Advance Monies for the Forces that are to go for Ireland; and to disband the Train of Artillery.

The which said several Papers were all read; and ordered to be taken into Consideration, the first Business, on Tuesday Morning next.

Isle of White.

Ordered, That Mr. Bulkeley and Mr. Lisle, and the rest of the Gentlemen that serve for the Isle of White, do go down with the Governor, for the better settling him in the Government of the said Isle; and make their Return to the House again within One Week, if they have not Leave already to go into the Country.

Army Committee, &c.

An Ordinance for appointing a Committee of the Army, and Treasurers at Wars, for the receiving, issuing, and bringing in, the Monies to be raised and levied by the Ordinance of Assessments of the Sixty thousand Pounds per mensem, for the Maintenance of the Forces for England and Ireland, was this Day read the First and Second time; and, upon the Question, committed to the Members of this House that are of the present Committee of the Army; with the Addition of Sir Wm. Allenson, Mr. Knightley, Mr. White, Mr. Saye, Colonel Harvey, Mr. Carew, Mr. Scott, Mr. Anlaby, Sir Michaell Livesay, Mr. Blakiston, Mr. Ball, Sir Wm. Strickland:

And this Committee has Power to treat with the present Treasurers at Wars, or any others whom they shall think fit, for the Raising of a considerable Sum of Money, upon the Credit of the said Ordinance of Assessments: And are to bring in the Names of such Persons as shall be willing to advance Monies upon the said Credit. And

It is further Ordered, That Sir Thomas Widdrington, Mr. Leman, and Mr. Luke Hodges, be of the Committee to be named for the Army in the said Ordinance: And the Care of this Business is more especially referred to Mr. Pury: And the Committee are to meet upon this Ordinance at the usual Place of Sitting of the Committee of the Army de die in diem; and report the same.

Ordered, That Mr. Pury do make the Report for raising Monies for Ireland.

Loan from the City.

The humble Petition and Answer of the Lord Mayor, Aldermen, and Commons, of the City of London, in Common Council assembled, to the Order of this House of the Third of this Instant September, requiring their positive Answer concerning the Loan of Fifty thousand Pounds, to be advanced and reimbursed out of the Arrears of their Assessments due to the Army, was read: And

It is thereupon Resolved, &c. That this House is not satisfied with the Answer of the Lord Mayor, Aldermen, and Common Council, of the City of London, concerning the Loan of the Fifty thousand Pounds to be advanced by them, and reimbursed out of the Arrears of their Assessments due to the Army; but doth order and require the Payment of the whole Arrears of their Assessments, being Sixty-four thousand Pounds; and doth expect, that the Sum of Fifty thousand Pounds be advanced by the said Lord Mayor, Aldermen, and Common Council, before the Eighteenth Day of this instant September, upon the former Proposition: And Sir Thomas Soame and Mr. Vassall are to acquaint the Lord Mayor, Aldermen, and Common Council, with this Order.

Pinade's Arrears, &c.

Resolved, &c. That the Sum of One hundred Pounds be charged upon the Receipts of Monies arising and coming in at Haberdashers Hall, and paid to Elizabeth Pinade Widow, Relict of Adjutant Pinade, deceased, upon Account, in lieu and in part of Satisfaction of her Husband's Arrears, due to him for his Entertainment in the Parliament's Service.

The Lords Concurrence to be desired herein.

Ordered, That the Treasurers at Christ Church, for Relief of Widows, and maimed Soldiers, do, weekly, pay unto Elizabeth Pinade, Relict of Adjutant Pinade, the Sum of Five Shillings, weekly, for the Maintenance and Support of her and her Children.

Latham's Petition.

Ordered, That Mr. Latham's Petition be read on Wednesday Morning next, the first Business.

Slighting City Lines.

WHEREAS the Committee of the Militia, London, appointed by Ordinance of Parliament the Second of this instant September, are directed, by several Ordinances of Parliament, then and since made, to cause the Forts and Lines of Communication to be forthwith slighted and demolished: For the better enabling of them to perform the said Work, it is Ordained, That all Housholders, and other Persons, within the Lines of Communication, and Parts adjacent, that are well-affected to the Freedom of Parliament and City, and Peace of the Kingdom, be and are hereby desired to begin on Monday next, and so to continue to come, or send what Men they can, with Tools, to such Parts of the Line as they shall be, from time to time, directed, by the said Committee, to perform the said Work, till it be finished: And the several Committees of the Militia, which are or shall be established within the Limits aforesaid, are required to be aiding and assisting in the doing thereof, in their respective Jurisdictions: And that this Ordinance be forthwith printed and published, the next Lord's Day, in the several Parish Churches within the Lines of Communication, and weekly Bills of Mortality, by the respective Ministers thereof: Who are hereby required to take notice hereof, and proceed accordingly.

WHEREAS the Committee of the Militia of London, appointed by Ordinance of Parliament the Second of this instant September, are directed by several Ordinances of Parliament then and since made, to cause the Forts and Lines of Communication to be forthwith slighted and demolished: For the better enabling them to perform the said Work, it is Ordained, That the said Committee shall cause all the Materials belonging to the said Forts and Lines to be forthwith sold; and the Proceed thereof to be employed toward the Accomplishing of the said Work, and such other publick Service as they shall see necessary for the Discharge of the Trust committed unto them.

Westminster Militia.

THE Lords and Commons, in Parliament assembled, taking into their serious Consideration the State and Condition of the Kingdom of England, and particularly of the City of Westminster, and Parts adjacent, within the County of Middlesex, hereafter mentioned, do Ordain and Declare, and be it Ordained and Declared, by the Authority of Parliament, That Sir Gregory Norton Knight, Humfrey Edwards, John Trenchard, Cornelius Holland, John Browne Clerk of the Parliament, Wm. Ball, Richard Keble, George Manley, Josias Berners, Richard Graves, Nicholas Marten, John Hall, John Haylin and Edward Dendy junior, Esquires, Wm. Parker Doctor in Physick, James Prince, Silvanus Taylor, George Crompton, John Robinson, Noah Bancks, Peter Lindsey, Richard Bigge, Raph Farmer, Nicholas Bond, Arthur Squib, John Honner, Richard Bates, Samuell Smith, John Clendon, Francis Blake, Ralph Grey, John Frampton, Edward Neale, William Dashwood, William Duppa, Wm. Stone, and Waller Frost, or any Seven or more of them, be and are hereby made, constituted, and appointed, a Committee for the Militia of and within the City of Westminster, and the Liberties thereof, the Parishes of Mary Savoy, Clement's Danes, Giles in the Fields, Andrews Holborne, Sepulchres, James Clerkenwell, Mary Islington, and Gyles Criplegate, in the County of Middlesex, and every of them: And shall have Power, and are hereby authorized, to assemble and call together all and singular Person and Persons within the said City, Liberties and Parishes, that are meet and fit for the Wars, and them to train, exercise, and put in Readiness; and them after their Abilities, and Faculties, well and sufficiently, from time to time to cause to be arrayed and weaponed; and to take the Musters of them in Places most fit for that Purpose: And that they shall have Power to lead, conduct, and employ, the Persons aforesaid, arrayed and weaponed, for the Suppression of all Rebellions, Insurrections, and Invasions, that may happen within the said Parts: And likewise shall have further Power and Authority to lead, conduct and employ, the Persons aforesaid, arrayed and weaponed, as well within the said Parts, as within any other Part of this Realm of England, or Dominion of Wales, for the Suppression of all Rebellions, Insurrections, and Invasions, that may happen, according as they shall, from time to time, receive Directions from the Lords and Commons, assembled in Parliament: And that the said Committee, or any Seven or more of them, as aforesaid, shall have Power and are hereby authorized, to constitute and make Colonels, Captains, and other Officers: And shall have Power to remove . . . displace Colonels, Captains, and other Officers, from time to time, as they, or any Seven or more of them, as aforesaid, shall see Cause, and think fit: And that the said Committee, or any Seven or more of them, as aforesaid, shall have the same Power and Authority, within the said Parts, as any Committee for the Militia of the City . . London had the Twentieth Day of July, Anno Domini 1647, by any Order or Ordinance of Parliament: And that all and every Person and Persons who shall act or do any Act or Thing whatsoever, by virtue of this or any former Order or Ordinance of Parliament, concerning the said Militia, shall be saved harmless, and indemnified concerning the same, by Authority of Parliament: And shall have the Benefit and Advantage of the Ordinances of the Lords and Commons, lately made, for saving harmless and indemnified all Persons as have acted . . and for the Service of the Parliament. And this present Ordinance is to continue, until it shall be otherwise ordered by both Houses of Parliament.

Trained Bands, &c.

BE it Ordained, by the Lords and Commons, in Parliament assembled, That the Trained Bands and Auxiliaries of the Hamlets of the Tower shall be under the immediate Power and Command of Sir Thomas Fairefax Constable of the Tower, and his Lieutenant, as they were lately under the Militia of London: And that the said Sir Thomas Fairefax Constable of the Tower, and his Lieutenant, shall have Power to name a Sub Committee for the Militia of the Hamlets, as the Militia of London lately had.

Southwark Militia.

Hickox, Mr. Samuell Hyland, Mr. Thomas Cooper, Mr. Francis Prichard, Mr. John Humphry, Mr. Wm. Smiter, Mr. John Sandon, Mr. George Pashfield, Mr. James Burton, Mr. Samuell Lynne, Mr. Ambrose Andrewes, Mr. Robert Baynard, Mr. Richard Luen, Mr. Peter Delanoy, Mr. Gowen Goldegay, Mr. Wm. And this present Ordinance is to continue, until it shall be otherwise ordered by both Houses of Parliament.

Publick Creditors.

Ordered, That it be referred to the Committee of the Army, to treat with the Committee of the Arrears, or with the Gentlemen who are Lenders of the Two-and-thirty thousand Pounds, upon the Credit of the Ordinance of Assessments of the Sixty thousand Pounds per mensem, for the Maintenance of the Forces of England and Ireland; for the Forbearance thereof for Two Months longer.
