By memorial of Feb. 3 last the Customs Commissioners
have represented to the Treasury Lords
that by the Act for preventing frauds [14 Car. II,
c. 11] ships of war, whether foreign or belonging
to the King, are liable to the same search as merchant
ships : notwithstanding which there are frequent
complaints that the commanders of men-of-war
refuse the officers of the Customs to visit their
ships, and at that time complaint was made from
Bristol port that Capt. Audley, commander of the
Smyrna frigate, so refused to suffer the officers at
the Pill to visit said ship or her long boat, whereby
opportunity was given to convey, from Virginia
ships then lying in that port, what quantities of
tobacco they pleased. Please represent this matter
to the Admiralty Lords that they will be pleased
to give order that all ships of war may be visited
by the Custom House officers. |

the petition of John Cornish, owner and master
of the Happy Return of Plymouth, setting forth
that said vessel, being laden with provisions for
Barbados, was put into the Plymouth list of ships
permitted to go to the West Indies under the Order
in Council of Nov. 18 last [? Nov. 15 last, see supra,
p. 888], but just before the sailing of the West
India [merchant] fleet petitioner fell sick, so that
his vessel could not sail ; but he is since recovered,
and his vessel still laden and ready to sail ; therefore
praying leave to pass with protection for only
three men : said petition being referred to the
Treasury Lords by the Queen in Council Mar. 30
last.

Royal warrant to the Attorney or Solicitor General
for a great seal to contain an indenture of contract
between the King and Queen of the one part and
Isaac Pereyra of the parish of St. James's, Westminster,
gent., of the other, for the supply of bread
by said Pereyra to the Army in Ireland, viz. for
not more than 66,000lb. weight of bread per day
for 12 months (or for nine months, as the King
shall direct by his royal sign manual before May 10
next) from 1690, Oct. 10 : the consideration to be
12,000l. [in cash] paid to him by Charles Fox and
Thomas Coningsby, Paymasters of the Forces in
Ireland, and 113,468l. 15s. 0d. delivered to him by
them in orders registered on the Additional Excise,
making together 125,468l. 15s. 0d. ; being at the
rate of five farthings for every pound weight of
bread : the bread to be three-fourths of wheat
meal and one-fourth of rye meal, and to be made
into loaves of 3lb. weight or such other weight as
the King shall direct : the wheat and rye to be of
the growth of England and Wales and to be transported
from such places as shall be convenient
between St. Ives in Cornwall and Carlisle in Cumberland,
unless he be authorised to receive any other
wheat or rye by royal sign manual or by warrant
of the Commander in Chief of the Army. (The
formal portions of this indenture as to accounts,
carriage, magazines, convoys etc. are repeated
from the similar contract of the precedent year,
supra, pp. 639-41, and specify biscuit as well as

Royal warrant to the Clerk of the Signet for a privy
seal for a discharge as follows of the 25,000l. imprested
to the Earl of Portland as follows for the
King's gardens. By patent of 1689, June 8, an
office was created, to be called the office of Superintendent
of all the Gardens belonging to the royal
palaces and houses of access : and said office with
the fee of 200l. per an. was conferred on William,
Earl of Portland : and between [1689] May 11 and
1690, April 1, various sums to a total of 14,500l.
were imprested to him for said office, and from
1690, April 1, to 1690-1, Mar. 7, other sums to a
total of 10,500l., making 25,000l. in all. Some
doubt has arisen in auditing said imprests, as to
whether said Earl (who by his office is to supervise
the said works and allow or disallow the charges
thereof) ought to be the accomptant, by reason
that his own allowance would then be the proper
voucher to his own accounts. Auditor Brook
Bridges has therefore proposed that Caspar Frederick
Henning (who has received and paid all the moneys
issued as aforesaid from time to time by the said
Earl's directions) be made the accomptant and
that said Earl be discharged of all said imprests.
This proposal is hereby approved and authorised.
The said Earl is therefore to be discharged of said
imprests and the imprests are to be charged upon
said Henning to render an account thereof. |

who with John Milner did on the 4th July, 1689,

of a seizure of wool and on the 10th January following
Tookey paid in a further 10l. for the King's moiety
of a boat ; making 35l. in all ; and the Customs
Commissioners report that he industriously behaved
himself in the said service. |

Appending : (a) petition to the King from Sir Thomas
Domvile, shewing that James Talbot, Redmund
Mullady, James Aylmer etc., in consideration of
6,000l. paid them by said Domvile, conveyed to
him and his heirs the manor, castle, town and lands
of Templeoge, John Duffs Town, Fryers Town
and some houses in the city of Dublin and other
small parcels in the adjacent counties, all valued
by them at 600l. per an. ; with condition for voiding
the sale if the 6,000l. be repaid with interest before
1688, Dec. 20 : but said mortgage was never repaid
and the interest is over four years in arrear, and
they are and have been all along in actuall rebellion
against his Majesty : that petitioner legally entered
on said lands and was possessed thereof till the late
King, by reason of petitioner's deserting his service,
declared his possession to be void and, by patent,
granted same to [the said] James Talbot et al. and
their heirs. Therefore petitioner prays a grant of
the equity of redemption. |
