March 16. Charles Bertie to the Customs Cashier. If you have not already brought in 200l. into the Exchequer for Visct. Falkland in pursuance of my letter of Nov. 10 last, Treasurer Danby directs you to forthwith bring it in notwithstanding my letter of the 5th inst. or any other restriction. Same to same to pay in their course, according to date, two tallies on the Customs, viz., for 1,000l. and 1,518l. 9s. 8d. to Lord Berkeley. If you advance the money Treasurer Danby will allow you 8 per cent. interest on it. Ibid.
March 17. Warrant from Treasury Danby to the Receipt to issue 2,680l. 18s. 0d. to Sir John Robinson by tallies upon John Vaughan, late Receiver of the last Eighteen months' assessment for South Wales and Monmouth ; and to be towards discharge of what remains due to said Robinson for the service of the Tower expenses [and] for principal and interest upon two orders registered in the Exchequer upon the fee farm sales, viz., one order No. 483 dated 1670, Dec. 12, for 2,375l. 2s. 9d., the other No. 500 dated 1671, June 12, for 1,387l. 4s. 0d. [?] Money warrant for 100l. to Mris. Margaret Broughton, now Lady Craven, for half a year on her pension of 200l. per an. March 17. Treasurer Danby's subscription of a docquet of a grant to Major Martin Beckman of the office of Chief Engineer of all his Majesty's castles, forts, blockhouses and other fortifications in England, Wales and Berwick on Tweed : all during pleasure and in reversion after Sir Bernard de Goome who [now] enjoys the same : with the fee of 13s. 4d. a day : to be paid out of the Crown revenues in co. Yorks by the Receiver thereof for the time being, and in default thereof out of the Exchequer quarterly : the said Beckman covenanting to keep an exact book and account of all engins and works to be made by him in the execution of this office. Royal sign manual for 111l. to Capt. Thomas Gardner as royal bounty for his good service in taking the late rebel Bacon in the Colony of Virginia. (Money warrant dated March 20 hereon. Warrant from Treasurer Danby to the sheriffs of Gloucester and Warwick to seize the estate and goods of Thomas Ward who was lately convicted at Gloucester assizes for high treason, and of William Berry (Bury) who was lately convicted at Warwick assizes for manslaughter. True inventories of same are to be made and returned to me. Warrants not Relating to Money VII. p. 170.
March 18. Col. Phelips and Col. Vernon petition[ed] the King for a lease of tithes due to the King out of the forest of Needwood : same was referred to Treasurer Danby, who referred it to Sir C. Harbord, who has made a report thereon. The Earl of Devonshire desires to be heard before any further progross be made upon this petition, and that notice be given to Mr. Roger Jacson at his Lordship's house in London. Caveat Book, p. 32.
A minute was entered 1676, June 28, by Treasurer Danby's order in these words, "Mr. Weare's grant to pass upon payment of the 1,300l., and if Sir Robert Vyner will consent to release him Treasurer Danby will move the King to release the 1,000l. on the Chimney money." [See p. 60 supra.] [A propos of this minute] Mr. Bradshaw desires to be heard before this 1,000l. be discharged, and that he may have notice given at his house in 2, Crane Court, in Fleet Street. Caveat Book, p. 33.
Declaration by Treasurer Danby. By the patent of 1677, May 3, John Portman, of London, goldsmith, is granted an annual rent of 4,605l. 13s. 0d. out of the Excise with the usual covenant relating to the interests of his creditors. The difference between him and Ezekiel Lampen was heard before me Treasurer Danby Dec. 14 last, said Lampen alleging 5,900l. to be due upon a bond of 1668, May 4, by Portman to Lampen as the executor of William Cloberry and 200l. upon a bond of 1676, Aug. 1, by Portman to Lampen. The interest of said 5,900l. for 1671, July 23 (to which date Portman alleges he paid interest thereon) to 1677, Dec. 25, amounts to 2,003l. 14s. 8d. ; the interest on the 200l. to same date amounts to 16l. 16s. 0d. making thus a total of 7,420l. 10s. 8d. out of which Lampen is to allow to Portman 231l. 8s. 4d. due to Portman from Lampen about 1671, Oct. 24, for the balance of a distinct account between them, not relating to the executorship, and 900l. for which a legatee of said Cloberry's has accepted said Portman's security and discharged Lampen thereof, and several sums amounting to 675l. which Portman has paid to Lampen for interest between 1675, July, and 1677, July. These deductions leave a balance of 5,614l. 2s. 4d. I therefore hereby declare in writing at the request of said Lampen (who has represented to me that the said assignment is still denied and delayed to him) that said Lampen ought to have an assignment of a proportionable part of Portman's annual rent of 4,605l. 13s. 0d., viz., for the said 5,614l. 2s. 4d. from Dec. 25 last and I hereby order said Portman to make such assignment and if not so made and registered before Lady day next then the Auditor of the Receipt and Clerk of the Pells are to take notice hereof and enter the same before them. Warrant from same to the Customs Commissioners to employ Bassingborne Goodwyn as a landwaiter in London port, loco James Wright. Out Letters (Customs) IV. p. 27.
Same from same to same to permit (notwithstanding any former directions) the Earl of Feversham to ship for France four horses, Customs free, same being intended as a present to his brother, the due Duras. Ibid.
Same from same to the Excise Commissioners to pay 948l. to Charles Duncombe, being the last half year's payment of interest due March 1 inst. for the sum of 31,600l. lent and advanced by him on the credit of tallies on the Excise : which said interest is payable half yearly as by the privy seal of 1676-7, March 14. March 19. Warrant from Treasurer Danby to the Customs Commissioners to employ Time. Hamlyn as Collector of Plymouth port. loco Capt. William Coleman who is commanded into his Majesty's service at sea, and has desired said Hamlyn to be established in his collection at Plymouth. Out Letters (Customs) IV. p. 27.
Charles Bertie to the Receivers of Excise to pay a tally on the Excise for 500l. for a quarter on the Earl of Plymouth's late pension of 2,000l. per an. Out Letters (General) p. 233.
Privy seal for 219l. 10s. 7d. to Edward Hawley, ut supra, p. 915, under date Feb. 16. (Warrant from Treasurer Danby dated March 20 to Sir Edmund Jennings, Kt., late sheriff of co. Yorks, to forthwith pay 219l. 10s. 7d. to said Edward Hawley, said sum remaining due on said Jennings' account for the year ended 1676, Sept. 29, and being for the revenue arising out of Recusants' estates charged within said account.) March 20. Warrant from Treasurer Danby to the Customs Commissioners to deliver, Customs free, a suit of clothes embroidered with silk lately sent from Paris to Monsieur de Ruvigny and seized at Dover ; and a watch and a pair of gloves taken from him and seized at Sittingbourne. Same from same to same to open at the Earl of Bath's house at St. James's, and to deliver, Customs free, some hampers, etc., containing the wearing apparel, etc., of Lord Lansdowne, who is lately come from France : same having been brought from France in the packet boat to Dover, and now coming up to the Custom House in London port. Same from same to same to employ Nicholas Davis as a tidesman in extraordinary, London port, when there is occasion for his service ; he being recommended to Treasurer Danby by the Earl of Northampton. Ibid.
Privy seal to empower the Lord Treasurer to pay interest at 6 per cent. and gratuity not exceeding 2 per cent. for all moneys borrowed and to be borrowed for his Majesty's service ; his Majesty's affairs frequently requiring the advance and loan of money which cannot be borrowed without greater encouragement than the usual interest of 6 per cent. per an. Royal warrant for a privy seal for a grant, pardon and release to Henry, bishop of London, of the sum of 254l. 17s. 1d. which by his composition with the Crown for the First Fruits of his bishopric is to be paid by him at Lady day coming. Privy seal for 2,862l. 0s. 5d. to Sir Henry Barnard, Kt., as the purchase price of a perpetuity of 171l. 14s. 4d. granted (by patent of July 7 last) to said Barnard and his heirs out of the Excise as in satisfaction of 2,862l. 0s. 5d. owing by the King to said Barnard for principal and interest : the King being pleased at said Barnard's suit to purchase off the said rent. The said purchase money (with common interest computed from Dec. 25 last to Sept. 19 next) is to be paid out of the Exchequer without accompt but care is to be taken that the said Barnard shall assign and transfer said rent to whom his Majesty shall direct by his royal warrant, such assignment to take effect from Christmas last. Same for 30l. to Sir Edward Griffin to be by him paid to Edward Glyn for half a year to Christmas last on said Glyn's 60l. per an. as by the privy seal of 1676, Sept. 30. Same for 366l. to Thomas Chudleigh for six months on his ordinary Sept. 11 last to March 13 inst., as Secretary to his Majesty's Extraordinary Embassy for the treaty of Peace at Nimuegen ; and also for 61l. for his extraordinary expenses therein 1676, June 30 to Dec. 30 as by a bill thereof [missing] allowed by Secretary Williamson the 15th inst. (the sum of 1,500l. 12s. 0d. [sic for probably 15l. 12s. 0d.] for Exchequer fees being deducted and not to be allowed). Ibid.
Warrant from Treasurer Danby to the Auditor of the Receipt to pay 3,000l. to Col. John Birch for the loyal indigent officers (as by the Act of 14 Car. II. for 60,000l. to such officers) paying same out of the arrears of the Eleven Months' tax due from Sir Lyonell Walden, Receiver General of that tax for co. Huntingdon, as by the patent directing the payment to said Birch for said officers of all such moneys as are or shall come into the Exchequer : the said Act of 14 Car. II. having provided that all moneys of the Eighteen Months' assessment in the counties of Cornwall, Rutland, Monmouth, Lancaster, Westmorland and Anglesea should be paid to some Treasurer to be distributed to the said indigent officers : and it appears that Charles Grills, late Receiver General of the said tax for co. Cornwall did notwithstanding the said Act pay into the Receipt 2,600l. part of the said tax and Ralph Buckley, Esq., late Receiver General of same for Anglesea did similarly pay into the Office of the Great Wardrobe 400l. 7s. 4d. both which sums amounting to 3,000l. 7s. 4d. the King directs to be paid to the use of the said loyal, indigent, commission officers. Warrant dormant from Treasurer Danby to the Receipt for tallies of assignment to be levied from time to time upon the Farmer of imported salt for so much money as shall be acknowledged by Henry Slingsby to have been paid to him direct by said Farmer in accordance with the patent of 1672, May 22, granting to said Slingsby 800l. per an. out of the rent of the farm of imported salt in lease to Sir Thomas Strickland. March 22. Royal warrant to the Clerk of the Signet for a privy seal for 93,000l. to the Treasurer of the Navy for building six ships third rates as part of the 30 ships [as provided for by the Act for the Seventeen Months' Assessment] said sum being made up as follows, viz., 66,000l. for the hulls, masts and yards, 19,170l. for the rigging, ground tackle and boats, 7,830l. for the boatswains' and carpenters' sea stores : the several orders for said sum are to specify the services for which the money is issued, and are to be registered in course upon, and in accordance with, the said Act. Same to same for a same for sums not exceeding 400,000l. in all to Lemuell Kingdon for the service of a war against the French King : to be payable "out of any money that shall be paid into the Exchequer (by loan or otherwise) upon account of the Poll Bill or any other Act for appropriating money to the use of the said war ... which use is to be expressed in all orders for that sum." Warrant from Treasurer Danby to the Barons of the Exchequer to take the security of (and thereupon to swear in) Timothy Thornbury as Collector of the Customs and subsidies of leather, hides, pelts, lead and tin in London port, the patent of 1672. Dec. 19, having granted said office to William Thornbury and Timothy Thornbury for the life of them and the longer liver, which said William Thornbury is lately dead. March 23. Same from same to the Customs Commissioners to employ John Hodges as a tidesman in extraordinary, London port, when there is occasion for his service : he being recommended to Treasurer Danby by Dr. Bagshaw "but not so mentioned in the letter." Out Letters (Customs) IV. p. 28.
Money warrant for 610l. 8s. 8d. to Paul Pauly, Esq., for two years' interest upon three orders of loan, viz., No. 1080 and No. 1081 registered on the Hearthmoney, and No. 1079 registered on the Wine Act in the name of John Wadlow and John Sayers, same being by several assignments come to the [possession of the] said Pauly and transferred to the Hearthmoney, representing in all a principal sum of 5,087l. 6s. 4d. March 25. Treasurer Danby's subscription of a docquet of a grant of the fee of 20d. a day and 16l. 2s. 6d. per an. to Francis Garrard [appointed] one of his Majesty's Musicians in ordinary loco John Mason, deceased : to be payable quarterly at the Exchequer and during pleasure. Privy seal empowering and directing Treasurer Danby to forthwith issue forth Commissions, deputations and authorities under his hand and seal to such persons as he think fit to be Receivers General within the respective counties, cities, towns and other places of England, Wales and Berwick of the moneys granted by the Act for a Poll : with such powers and instructions as he shall think necessary : taking care that such persons be not such as are provided against by the said Act. Warrant from Treasurer Danby to the Customs Commissioners to take care for the execution of an order of the King in Council concerning the embargo.
Prefixing : Said order in Council dated Whitehall, March 25. By an order of Council of the 20th inst. the King commanded an embargo of all ships and vessels whatsoever outward bound, until further pleasure. Upon further consideration of that matter this day had at the Board the King declares that the said embargo was intended to be only on such ships as belong to or are sailed by his Majesty's subjects ; which [ships] notwithstanding are to be permitted to trade from any one port to another in England and Wales on security given not to trade elsewhere. And in case of extraordinary occasions and such as concern his Majesty's service his Majesty is pleased to leave it to the Admiralty Lords to grant passes to such ships as they shall judge requisite to proceed in their voyages notwithstanding the said embargo.

Money warrant for 3,451l. 15s. 4d. to Sir Robert Vyner, his Majesty's Goldsmith, without accompt, for several parcels of gold, gilt and white plate by him delivered into the Jewel House from Dec. 10 last to the 1st inst., and for money disbursed by him for the service of that Office Oct. 10 last to Jan. 10 last : as by bill thereof signed by Sir Gilbert Talbot, Master of the Jewels and Plate. March 25. Warrant from Treasurer Danby to the Receipt to take in loans on the late Act for the Poll, giving out immediately tallies of loan for same (the privy seal [infra p. 946] is now passing to authorise the drawing and registering of orders pursuant to the said Act) : Treasurer Danby being informed that several persons are ready forthwith to lend money upon the credit of said Act. Treasurer Danby to Thomas Aram, gent., to deliver over to Henry, Earl of Peterborough, Robert, Viscount Yarmouth, Henry, Lord O'Brien of Ibrackan, Sir Francis Compton, Bernard Greenvile Henry Fanshaw and Percival Brunskell, all books and papers in your possession relating to the fines, issues, amerciaments, recognisances and other forfeitures imposed in any Courts of Justice in England and Wales : the King having revoked the grant to you of the Surveyorship and Receivership of said fines, and having granted the said office or offices to said Earl of Peterborough et al as above. March 26. Charles Bertie to the Auditor of the Receipt to pay (and to the Customs Cashier to bring in without respect to the weekly payments) 369l. to Mr. Packer upon any orders in his name for extraordinaries of the Works : said sum to be employed for erecting a court in Westminster Hall for the trial of the Earl of Pembroke. Money warrant for 1,500l. to Sir John Kirke for last Lady day quarter's wages and board wages to the Band of Gentlemen Pensioners : to be paid out of any any money that is or shall be brought into the Exchequer from First Fruits and Tenths. Warrants not Relating to Money VII. p. 172.
March 27. Warrant from Treasurer Danby to the Customs Commissioners to deliver, Customs free, some trunks and hampers belonging to Dr. Lloyd, chaplain to the Princess of Orange and a box containing plate and chapel furniture belonging to the Duke of York : said particulars being now coming from Holland. The Royal Africa Company of England by their petition this day made at the board complain that the Customs officers have of late stopped the provisions shipped by the petitioners for the preservation of the soldiers in their respective garrisons and of the negro servants carried thence to the Plantations as also the materials intended for building and repairing their forts, all which not only the petitioners but also the former Company of Royal Adventurers have hitherto sent out Customs free, as the East India Company have likewise done for what they send on such occasions to the limits of their charter : and therefore pray the discharge and Customs free shipment of such provisions and materials. Royal warrant to the Attorney or Solicitor General for a great seal for confirming to Ferdinando Stanley (in recognition of his services and sufferings in the late Civil Wars, which have been fully attested under the hands of many persons of honour) his title and estate in the manor of Broughton, co. Lanes, and quieting him in the possession thereof which has been so long enjoyed by him and his ancestors : said title having been enquired into on the petition of said Stanley, and it appearing from the Attorney General's report thereon that said Stanley makes out his title thereto by grant thereof to Henry Standley, his grandfather, from Henry, Earl of Derby, to whom William Standly, Lord Mounteagle, conveyed the same in 17 Eliz. ; that two several settlements thereof have been since made, one in 24 Eliz. upon the father of said Ferdinando Standley in tail, and the other in 1 Car. I. by the said father upon himself ; that some years since an information was exhibited in the Exchequer by Sir Jeffery Palmer, late Attorney General, on the Crown's behalf, suggesting that the reversion of the said manor was in the Crown by an attainder of Sir James Harrington in the time of Hy. VII., to which the said Ferdinando put in his answer and denied the fact suggested and set forth his title and that he and those under whom he claims have been in possession ever since Hy. VIII. ; whereupon no further proceeding has been had and it does not appear to the present Attorney General that any reversion is in the Crown. (Cancelled and another warrant drawn the same day for 104l. 3s. 1½d. for same as by the letters patent granting said Bishop the fee of 1s. and allowance of 1s. 3d. a day ; and 146l. 15s. 7½d. by virtue of the letters patent dormant of 1660, Sept. 28 as a further reward of his service for attending the said House and to make his fee and allowance equal with [those of] the rest of his Majesty's Serjeant at Arms. Same from same to the Customs Cashier to receive 7,153l. 1s. 11d. in bonds on the Customs of East India commodities (and which are not to be applied to the satisfaction of the loan of 60,000l. lately made to the King by said Company) and to deliver same to the Treasurer of the Navy for the service of the Navy, taking from him tallies to that sum struck on Richard Mounteney, late Cashier of the Customs. Treasurer Danby to Sir William Jones, Attorney General to non pros the indictment brought by Richard Strong and others (who were lately fined at a sessions at Beaminster, co. Dorset, for a riot and assault upon Thomas Temple, surveyor, and other officers of Weymouth port) against said Temple et al : same being merely to vex said Temple : said Strong and his accomplices being known to be notorious offenders in defrauding the King and abusing his officers. Warrant from same to serjeant John Ramsey to arrest [the abovesaid] Richard Strong for resisting a seizure made by Francis Bennett, landwaiter of Weymouth port, of a cask of Canary wine, said Strong having locked said Bennett in a cellar for an hour, during which time Bennet believes there was a great deal of wine run : several other complaints having been made of the insolent practices of said Strong in relation to the revenue.
