March 21. Royal warrant dated St. James's to Sir Edward Northey, Attorney General, to enter a noli prosequi to the information as to the Queen's moiety of the forfeiture against Sir William Hodges, bart., and Leonard Henchman, merchants, for the ship Nostra Seigniora del Soccoro laden with Canary wine on their account and seized by Capt. John Nash, an officer of the Customs (Commander of the Customs vessel at Gravesend), on pretence that the said ship cannot by law import the said goods, the Canaries being in Africa and the said ship not English, being Spanish built and manned by Spanish; the Customs Commissioners having reported that they think it a great hardship that the Spaniards should be prohibited from trading in their own ships with goods of their own growth and that in practice the Customs Officers have not taken advantage of the Navigation Act in such case; the like having been granted for the ship St. Joseph under like circumstances, "it being reasonable for us so to do for the encouragement of the Spanish trade." Royal warrant to the Auditors of Imprests to allow in the accounts of James Brydges as Paymaster of the Forces Abroad, to wit in his account for the Forces in Spain and Portugal anno 1708, the items as follows amounting in all to 15,959l. 0s. 10¼d., being disbursements by John Chetwynd, Envoy Extraordinary to the Duke of Savoy, he having in 1707 and 1708, by direction of the Queen, provided transport ships, corn, provisions and other necessaries in Italy for the transportation of several auxiliary troops in her Majesty's service upon their embarcation there for Barcelona. The receipts and acknowledgments of the respective contractors are first to be produced as also the acquittance of said Chetwynd for his disbursements for incidents. Further the said Paymaster General is hereby to be surcharged in his account with the several sums deducted as follows by him or his deputy at Barcelona from the pay of the said Auxiliary Troops in their passage from Italy, viz. 4,296l. 0s. 1d. from the Imperial Troops upon the first and second embarcation, and 1,312l. 0s. 9¾d. from the Palatine Troops. William Lowndes to Sir John Lambert et al. On Feb. 23, supra, p. 182, you were desired to pay in the remaining 20,000l. of the loan you agreed to make on her Majesty's tin. My Lords observe that the said loan is not yet made. I have to repeat to you the urgency of her Majesty's service for the said money, with my Lords' desire that you will forthwith make the said loan at the Exchequer. Disposition Book XXI, p. 67.
Letter of direction for 3,500l. to Visct. Ryalton, Cofferer of the Household: out of Civil List moneys: and is intended to answer such bills of exchange as shall be drawn for wine bought in Holland for her Majesty's service by Mr. [James] Heymans, Yeoman of her Majesty's cellar. Ibid.
William Lowndes to James Brydges, Paymaster of the Forces Abroad. The Treasury Lords desire that the royal warrant for 1,000l. to Lieut. Gen. Webb for royal bounty be satisfied out of the tallies and orders remaining in your hands on Malt anno 1711, such orders to be assigned to him with all accrued interest thereon from the dates thereof. March 21. Treasury warrant to the Queen's Remenbrancer for stay of process against the executors of the late Duke of Montagu on his accounts as late Master of the Great Wardrobe.
Prefixing: certificate by Auditor E. Harley that the said accounts are declared and passed up to 1705 Michaelmas, that for the succeeding year 1706 was declared before the late Chancellor of the Exchequer on Aug. 4 last "but not being passed [in] the other Offices must now be declared before the present Chancellor and the rest of the Treasury Lords. William Lowndes to Mr. Burchett, Secretary to the Admiralty. No directions have been given on my letter of the 13th relative to hemp contracts. I am to put you in mind thereof. I sent a copy to Mr. Sergison so that the service should not suffer in the meantime. Out Letters (General) XIX, p. 322.

Please give my Lords a particular account how much money has been already applied [to and] for the service of Spain and Portugal which must be put to the account of the 1,500,000l. voted by Parliament for the service of Spain and Portugal. Please propose to my Lords an apportionment of the remainder to the most necessary uses to which it was voted, including Gibraltar. Ibid.

My Lords have read your letter with the extracts of two letters from Lord Portmore of Nov. 19 and Dec. 22 last relating to bread and forage for the Troops in Portugal, wherein his Lordship represents the impossibility of the cavalry's subsisting there upon Dragoon's pay, wherefore you desire direction thereon and as to whether the two Regiments formed out of Spanish and Irish deserters shall be established of nine Troops as they stand upon the Estimate of [the English Forces in] Spain and Portugal or only of six Troops. My Lords desire you to report your opinion thereon so that they may lay same before the Queen for her pleasure. They also desire you to hasten your report on the particulars contained in general Stanhope's letter and on the case of [the two] Mr. Chetwynds. P.S. As to the exceedings in Portugal proposed by Lord Portmore my Lords would know whether the same was contained in the estimate laid before the House upon which the 1,500,000l. was voted for Spain and Portugal. March 23. Treasury warrant to the Clerk of the Pipe for a reversionary lease to John, Duke of Newcastle, of the Woods in Hermitage or Blackmore in the manor of Fordington, Co. Dorset, called the Princes Woods alias Eastwoods in the said manor and parcel of the Duchy of Cornwall and the lawn adjoinin containing 68 acres and the cottage in the tenure of George Fox: which said premises were at one time in the tenure of Sir Thomas Freak, Kt., by indenture dated 1624 Nov. 26 from Charles, then Prince of Wales, and afterwards demised to Denzill, Lord Holles of Ifield, 1663 July 10 for 99 years from 1662 Sept. 29 terminable on the lives of George Read of Martin, Co. Wilts, yeoman, Thomas Watts of Sidling, Co. Dorset, yeoman, and John King of Cerne Abbas, Co. Dorset, yeoman; of which the said Read is the only survivor: the present lease to be for 99 years terminable on the lives of the said Duke and George, son of George Budden.

March 24. William Lowndes to the Navy Commissioners. My Lords have received from Secretary Lord Dartmouth a copy of the letter which, by the Queen's order, he has sent to the British Consuls at Naples, Genoa and Leghorn directing them to take care of the subsisting and returning home all her Majesty's subjects (being seafaring men) who shall happen into the hands of the enemy and be put on shore in these parts. Have you any objections against the Queen bearing the said charge out of the Navy money? Out Letters General XIX, p. 330.

Treasury warrant to the Auditor of the Receipt et al. to set apart, reserve and apply the overplus money of the fund settled and appropriated by the Act of 4 Anne [4–5 Anne, c. 18] (for paying 184,242l. 14s. 0d. in annuities purchased anno 1706), and which [overplus] amounts to 44,788l. 18s. 2¼d., for and towards making good the fund for paying and discharging the annuities not exceeding 72,187l. 10s. 0d. per an. which were purchased on the said Act for the service of the year 1707 under the Act of 5 Anne [6 Anne, c. 2].
Prefixing: certificate dated March 26 inst. by Lord Halifax, Auditor of the Receipt, that at Lady day last 1711 there remained in the Exchequer, of the fund settled and appropriated by the said Act of 4 Anne [4–5 Anne, c. 18] (for paying 184,242l. 14s. 0d. in annuities as above), the said sum of 44,788l. 18s. 2¼d. for the overplus of the said fund "being more than sufficient to satisfy and pay the annuities at that time due and payable out of the said fund and the arrears thereof and all charges thereon in paying and accounting for the same." Prefixing. a like certificate as above that the said overplus of 21,668l. 3s. 2¼d. remained at Lady day 1711 in the Exchequer on the said fund settled and appropriated by the said Act of 5 Anne [6 Anne, c. 2] being more than sufficient to satisfy and pay the annuities at that time due and payable out of the said fund and the arrears thereof and all charges in paying and accounting for the same. Letter of direction for 29,703l. to Robert Walpole, Treasurer of the Navy: out of Contributions remaining in the Exchequer on the Lottery Act anno 1711: and is to be applied to pay Michaelmas quarter 1709 to Portsmouth, Plymouth and Harwich Yards: and to be placed to account as part of the quota for the Wear and Tear of the Navy anno 1711. The Treasury Lords to George Smyth, Esq. It has been represented to her Majesty in Council that an offer has been made in the Admiralty Court by several merchants who have claimed 42,151 pieces of Eight on board two Genoese ships lately taken by two of her Majesty's men of war and carried to Port Mahon, that the said pieces of Eight shall be delivered to the order of her Majesty upon a sufficient deposit to be made in the said Court and that Lord Forbes, on behalf of himself and the rest of the captors, has consented thereto. By order in Council the Queen has directed the Treasury Lords to accept of the said offer and of any like proposals made or to be made by any other claimants of the said ships. Please acquaint the said Court accordingly at their first sitting. Out Letters (General) XIX, p. 328.
William Lowndes to Col. Hunter, Governor of New York. Informations have been laid before my Lords of great wastes and abuses committed in her Majesty's woods by Mr. Brydger, who was sent over with the character of Surveyor to take care of and preserve the said woods. My Lords transmitted the said informations to the Admiralty for their examination into that matter. Please make the strictest enquiry into the management and behaviour of the said Brydger and as to any such wastes committed by him or any others and report thereon to my Lords. Same to Mr. Wise. The Queen approves your proposal for taking out of the House Park at Windsor the twenty spotted deer which her Majesty intends to send as a present to the Emperor of Morocco. Ibid.

William Lowndes to the Navy Commissioners. The Treasurer of the Navy has adjusted his account with the Bank of England for interest due to them [the Bank] to the 21st inst. for moneys advanced by the Bank for the public services of the Navy and Victualling at different times: and has also adjusted with Mr. Thomas Carbonnel his account of discount and charges upon negotiating Exchequer Bills to raise money from time to time to repay the sums advanced by the Bank and to redeem the tallies or orders deposited with the Bank as security for such advances. The said total sum is to be paid over to Sir Theodore Janssen et al. for the value of 320,000 Crowns of 82 sols each, money of Piedmont, in their bills already given on Turin for the subsidy to the Duke of Savoy, at the exchange rate of 58 pence sterling per Crown, whereof 106,666 2/3 Crowns at 45 days, the like at 60 days and the like at 75 days date. Treasury warrant to the Customs Commissioners, Scotland, to pay the salary bill [not detailed] of the Customs, Scotland, for 1711 Lady day quarter so far as concerns the Commissioners and patent officers thereof: and as to the other officers to pay the persons who served therein to 1711 Lady day: but no officer to be paid for a longer time than he actually served: all notwithstanding that the lists thereof differ very much from each other and none of them clearly expresses how much therein belongs to persons serving but [or only] part of a quarter and how much to others who served the remainder thereof. Treasury reference to the Commissioners of Transports of the petition of the Masters of several ships hired into her Majesty's Transport service ever since May 1710, alleging that they were hired at the rate of 11s. per ton per month and accordingly victualled for six months; that having been detained at Spithead above eight months their provisions are spent and they are under a necessity of furnishing anew; that the difference between the discount of Transport Bills at the time they were first hired and at this present time has altered the price from 11s. per ton to 14s. per ton: therefore praying that they may either be allowed demurrage or the present rate of 14s. per ton, they having been obliged to sell the Bills they received upon their contract at the present discount to enable them to perform that service.
