July 1. Royal warrant dated Windsor to the Attorney or Solicitor General for a great seal for a grant to James Trefusis of the use and exercise for seven years of the invention for fishing and taking up treasure out of the sea within the British seas ; being an engine invented of covering vessels and pipes whereby they are enabled to work several fathoms under water for divers hours together without any want of air : William III having granted a patent 1691 Oct. 17 to the said Trefusis, John Honichurch, Nicholas Honichurch and Joseph Williams for said engines which grant will determine on the 17 Oct. 1705 and the said Trefusis has represented that none of the said patentees except himself hath worked the said engine and that he hath yet made no profit thereof and that he is discouraged to proceed in the use thereof by reason that the said letters patent contain no grant of the goods the patentees shall gain by their diving. In the herein patent he, his agents &c., are to be granted the right to possess themselves of such treasure recovered by means of the said invention ; on payment of one fifth thereof to the Crown. Royal warrant dated Windsor to the Clerk of the Signet for a privy seal for a pension of 1000l. per an. as from 1704 Sept. 29 to Charles, Duke of St. Albans, in lieu of a renewal of the logwood [Duties] farm granted to him 1676 Sept. 13 ; Charles II having intended a 99 years' renewal thereof in Jan. 1684 but the same being prevented by the said King's death : and her present Majesty doth not think fit to grant any new lease of the said Duties. June [? sic for July] 3. Same to John How, Paymaster General of Guards, Garrisons and Land Forces to pay 144l. 8s. 4d. to the Earl of Essex out of savings by respits on the Regiment of Dragoons under him between 25 Dec. and 24 Feb. last for the respits on 104 men lately detached out of his Regiment ; it appearing that the Officers had actually listed 87 [new] men from the time the detachment was made to the said 24th Feb. whose pay for said time together with the offreckonings of the said detachment came to 144l. 8s. 4d. July 3. Same dated St. James's to Thomas Jones Esq., to take the custody of Ludlow Castle as Keeper thereof loco William Gower whose appointment under the sign manual of Aug. 26 last is hereby determined : with the fee of 20l. per an. and the further sum of 10l. per an. for provision of fuel : to be payable out of the revenue of North or South Wales as from 1704 June 24. Same dated Windsor to Treasurer Godolphin to pay 3180l. to Bernard Smith for organs by him set up in the Royal Chapels at Whitehall, St. James's and Windsor : it being certified by Dr. Ralph Battle, Sub-dean of the Chapel Royal, Peter Hume and Dr. John Blow, our principal organist, that they have carefully viewed and considered the said organs and compared them as well with those made by other artists as with several made by said Smith and sold to other persons and that they value the organ at Whitehall at 1500l. that at Windsor at 990l. and that at St. James's (when completed by putting in the trumpet stop and that called Cremona and the pipes gilt) at 690l. Same to the Postmasters General to discharge Daniel Richards, formerly Postmaster of Carmarthen for many years, of the debt of 73l. 6s. 11d. : by reason of his poverty and that his salary of 48l. was small for the charge and pains of his office, riding with the mail from Carmarthen to Langhorne [Laugharne] and Llanindevery [Llandovery] which is a long stage and bad roads "the allowance to your several deputies who have riding work being in most places little more than a reimbursement for their necessary charges in keeping horses for the performance of their duty." Same to same for a same for 100l. per an. to the Corporation of Lyme Regis for 19½ years from 1705 Xmas for repair of the cobb pier there : as granted by Charles II 1684 Dec. 23 for 21 years : to be paid by the collector of the port of Lyme Regis out of the Exchequer ; the Customs and Subsidies out of which the said allowance was formerly paid having been of late years appropriated by Acts of Parliament to other uses. Livesay in the West Indies, the necessity of sending the muster rolls by the pacquet boats, the charge whereof will be 8l. per month (one month with another), and that the Regiments should not bear the charge thereof. Somerset, Receiver General of Taxes for said County, anno 1703, shewing that since Lady day last he delivered 13,000l. to Richard Veale of Exeter merchant, he being reputed the most substantial man in those parts for returning of moneys and having formerly returned several considerable sums [for petitioner into the Exchequer] and had articles and a bond from said Veale and four more substantial persons in 20,000l. but the said Veale has absconded : therefore praying three weeks time to enable him to realise on the effects of said Veale and his sureties. Same to the Attorney General of the petition of Lord Bophin shewing that an Act of Parliament [1 Anne St. 2 c 18] passed for granting the petitioner's estate upon payment of 25,000l. at three several payments, and upon failure to be vested in the Crown : that he has paid all but the last, but upon several payments of which application of Lieut. Gen. Stewart the estate is re-vested in the Crown by reason of the failure of the last payment : and her Majesty hath directed that he [petitioner] shall not receive the rents : therefore praying that said direction may be recalled and that he may be left to law in respect to the debt owing to Lieut. Gen. Stewart and Lady Purbeck. Ibid.
Treasury reference to the Attorney General of the petition of Samuel Barnardiston and Arthur and Mary Barnardiston, children of Arthur Barnardiston, deceased, shewing that their said father supplied his father-in-law, Sir Richard Lloyd, deceased, with 13,980l. 9s. 8d. [for which] Lloyd assigned divers lands extended by Charles II which were the lands of Alexander Butterworth et al ; but petitioners found the whole estate insufficient to satisfy said debt and attempted the recovery of the possession of the said extended lands but were defeated by reason of some mistake in the patents of demise : therefore praying that said patents may be amended. Warrant by Treasurer Godolphin to John Parkhurst to allow in account to Peter Jennings, Agent for Prizes in America from 19 Nov. 1696 to January 1697-8, the charges expended by him in that service in registering his commission amounting to 67l. 5s. 0d. and 3 per cent. on his receipts which amounted but to 181l. 2s. 0d. But as to the 100l. craved by him for his voyage, pains and agency you certify that it was never the custom of the Commissioners of Prizes to give allowances to any agents in foreign parts by way of yearly salary but only a quantum meruit for the service they performed, which was usually 2½ per cent. on the money they received for prizes : but in regard the petitioner was at great trouble in putting matters into a method, settling correspondences and acquainting himself with the ways and ports of the country and had no sooner so done than he was superseded and thereby deprived of the advantage he might have expected therefore he may be allowed his charges in the service and also 3 per cent. or something more than the common recompence. On the 25th May 1704 a proclamation was issued offering 100l. reward for discovery and arrest of the author, printer and publisher of the libel entitled 'Legion's ... address to the Lords,' Parliament being then in recess. On the 8th June Mr. James Rawlins a printer and Mr. Peirce, an exchange broker, absconded, being accused the one for printing and the other for handing the said libel to the press. On the 27th June the said Rawlins was arrested and committed to Northampton gaol. On the 23rd Oct. being the first day of the term an information was brought in the Queen's Bench against Rawlins the printer for the said libel. On the 1st Feb. following 1704-5, "the Sheriffs of London and Middlesex allowed the common panel of juries, so that Rawlins for libelling the House of Commons and others of the same faction that are under prosecution, may expect tender usage from their brethren, but the Queen [and her government may expect] little justice." (See Hist. MSS. Reports XV, iv, pp. 145, 159. Luttrell Diary V, 433, 439). This affair may have arisen out of the petition of Daniel Brown and 5 others presented to the House of Commons on the 7th Feb. 1703-4 against a patent granted for the sole printing of law books, of which patent William Rawlins and Samuel Roycroft were farmers "who exact 5s. in the pound generally more than is usually demanded by other printers, and thereby the master printers who are very numerous are deprived from exercising a great branch of their trade" (Commons Journal XIV, 323-4) At the time of the presentation of this petition the House of Commons was engaged in proceedings against the 'Observator' for its 'further Remarks on occasional Conformity' and as a part of the proceedings the House was considering a Bill to prevent the licentiousness of the press. The reply of Rawlins and Roycroft to the above petition is printed in the Journals under date 15 Feb. 1703-4. (Ibid., p. 339).
