598. Report of Sir P. Yorke, Attorney General, and C. Talbot, Solicitor General, to the Lords of the Treasury on the petition of Francis Charteris. Petitioner was indicted at the general sessions at Hick's Hall, 1729, December 1, for rape of one Anne Bond, and convicted at the sessions of gaol delivery at the Old Bailey, l729(–30), February 25, and condemned to death. On the report of Justice Price, Justice Probyn, and Mr. Baron Thompson, Recorder of the city of London, the King granted his pardon on April 10. The pardon for the felony and attainder passed the Great Seal May 14, and restored all legal capacities to petitioner, but not his estate. Commissions have issued for the inquiry as to his estate in pursuance of directions from the Lords of the Treasury. The annual value of his real estate is 2,807l. 0s. 3d. and his personal estate is 63,035l. 4s. 5½d. Are of opinion that His Majesty may lawfully grant and restore same to petitioner. 3 pages.

Scrope to the Commissioners of Taxes, transmitting from the Lords of the Treasury a statement by the Auditor of Land Revenues as to the state of the accounts of the Receivers General of the public taxes which are behind and undeclared to the year 1728 inclusive, and as to several balances due on the account of divers Receivers General still unpaid, many of the said accounts for several years past not being stated at all for want of vouchers to be produced by the Receivers General themselves. Their Lordships direct the utmost diligence in bringing the seven accountants named to pass their accounts forthwith, and further demand a statement of the debts owing to the public from Benjamin Blundell and Mr. Diston, late Receivers General of taxes for Leicestershire and Middlesex. Order for the preparation of a sign manual for 1,500l. to be issued to Mr. Wither upon account for carrying on the work of laying the six ponds in Hyde Park into one, which His Majesty is pleased to have done.
Mr. Wither's report of the 6th instant on Mr. Whitworth's memorial for repairs in Bigshot and Sandhurst Walks, Windsor Forest, read and agreed to, whereby 10l. per annum is to be paid out of wood sales for the hire of a house for an underkeeper in Sandhurst Walk, and 472l. 10s. for repairing the lodge outhouses and rails belonging to Bigshot.
Charles Mason's petition read for stay of process against his estate in Shropshire for his account as late Treasurer and Paymaster of the Transport Office. Their Lordships adhere to their minutes of August 12 last.
The memorial of the Commissioners of the Customs for Scotland for disposing of the “Princess Louisa” sloop and employing two boats in lieu, with two surveyors and 12 able boatmen, read and agreed to.
Mr. Surveyor General's report of 1730, September 5, on the Earl of Cholmondley's memorial for filling up to 50 years his terms in sundry messuages, tenements and premises adjoining the Palace of Richmond, read and agreed to.
Auditor Lowndes's report of 1730, August 2, read and agreed to, and preparation of warrant ordered for 50l. to be allowed for rent of a house for keeping the court and prison within the liberty of the Tower of London, and 30l. for the expense of ironwork.
Thomas Aikinside, at the recommendation of Mr. Jenison, is to be a tidemaster at Newton in Northumberland, loco Samuel Simpson, deceased.
On reading the report of the Commissioners of Customs of 1729–30, February 5, touching the 200l. paid by Thomas Benson, late Secondary of Wood Street Compter, to the hands of a clerk of the Solicitor of the Customs instead of to Mr. Hawes, the Receiver General of the Customs, their Lordships are of opinion that prosecution should go on for recovery of same, which has some time since been levied by Sir Peter Delme and Sir Harcourt Masters, late Sheriffs of London, and is now deposited in the hands of the Chamberlain.
Sir Joseph Eyles' proposal for remitting the subsistence to Minorca and Gibraltar for two months from 1730, October 25, read and agreed to as follows:—

615. Report of Sir P. Yorke, the Attorney General, on the petition of Mr. Henry Hole of Barbadoes, merchant, for His Majesty's license to collect the effects unknown to the Crown belonging to Stede Bonnet, convicted of piracy, in order to satisfy a debt of 1,707l. Barbadoes money, with interest and costs, due to him from the said Bonnet. Petitioner recovered judgment against Mary Bonnet, Stede Bonnet's wife and attorney in 1717, June 14. But Stede Bonnet having been since convicted of piracy, petitioner is entirely without remedy for his just debt, unless His Majesty authorise him to collect debts due to Bonnet in the Leeward Islands. His Majesty may lawfully gratify petitioner's request, the proper method of doing it being by grant to petitioner under the Great Seal of Great Britain of all the debts in the Leeward Isles due to Bonnet at the time of his attainder, with power to sue and recover same, accounting to His Majesty for any residue above his just debt. 10 pages.

636. The Agents for Taxes deliver in a representation, dated 17th instant, informing of the proceedings in Wilkinson's case.Their Lordships are of opinion that the Agents, with the Remembrancer, should fix a peremptory day for disposal of the estates.
The same Agents are also to pursue the Attorney General's opinion with respect to the fixing and ascertaining the charge on Wilkinson with respect to the duties on houses, to try the validity of the estate settled by Wilkinson on his son Andrew's marriage.
The Agents also present Mr. Attorney General's opinion on Mr. Allen's case, late receiver for Norfolk, with the alterations necessary in the bond to be given by the new receiver.
The Agents are to attend Mr. Scrope and consider with him whether the country or the collectors may not come in as creditors under a commission of bankruptcy, to recover the money wrongfully received by Allen.
Orders for the following issues out of the supplies, 1730: for the Hessians, in further part, 10,000l.; to the Treasurer of the Ordnance, 20,000l.

Order from the Lords of the Treasury for the execution of a warrant, dated 1730, September 19, from the Duke of Grafton to the Duke of Montagu, for the delivery to Grey Maynard of the following for the Prince of Wales's bedchamber at St. James's, viz. a new bed of yellow Genoa damask with four posts, a counterpoint of the same with a complete set of bedding, two pairs of window curtains, valances and cornices to draw up, an armed chair, a drawing chair, and six square stools stuffed and covered with the same damask and trimmed with silk arras of the same colour, For the drawing-room: two pair of crimson taffeta window curtains to draw up, with cornice and valance, an armed chair, and six square stools, to be covered with the old damask window curtains now in the room; a hanging pier glass in a gilt frame, table and stands ditto; four pairs of large glass sconces with gilt frames, two arms each. The Presence Chamber: a hanging pier glass in a walnut-tree frame, table and stands ditto, a chimney glass with a walnut-tree frame, six pairs of wrought brass arms.

Same from same for execution of same, of date 1730, September 19, from the Duke of Grafton to the Duke of Montagu, for the supply of the following to Grey Maynard for His Majesty's service at Windsor, viz. a leather mattress stuffed with hair, an otter-down quilt covered with white satin and lined with a taffeta of the same colour, 3½ yards by 3½ yards.the squares of the quilting 10 inches each for the King's bed, two night chairs for their Majesties, and 107 yards of white silk taffeta for window curtains in the Queen's bedchamber. Likewise to give orders for repairing the carved work and gilding of two table frames in the Queen's apartment at So. James's, and to repair the frames and seats of 12 walnut-tree matted chairs, 12 maplewood chairs with matted seats, three cane chairs, six stools covered with yellow worsted camlet, and a little chair in the Duke's apartment at St. James's. Also to order the upholsterers, joiners, and cabinet makers to take down the King and Queen's damask bed and all the furniture in their apartment at St. James's, the Duke's bed, &c. and his servants', the woman of the Queen's bedchamber's bed, and to put up the furniture again after the lodgings are whitewashed.

642. Statement of opinion by the Attorney General, Sir Philip Yorke, on certain cases submitted as follows, on the position of the collectors in part of Norfolk who had made payments amounting to 4,000l. to Wm. Allen, late Receiver General of the Taxes there, for the first quarter of 1730:—
(1.) Have the collectors who paid than money to Allen a right to come in under the commission of bankruptcy, in order to their receiving a satisfaction for same in proportion with Allen's other creditors?
(2.) Will it be proper for His Majesty's Commissioners for the Affairs of Taxes to intermeddle in this affair on the collectors' behalf? 1 page. [Treasury Board Papers CCLXXIV. No. 45.] |

Desires copies of all papers relating thereto, especially Mr. Jonathan Perrie's memorial, to be laid before the Chancellor of the Exchequer as soon as he comes to town.

Same to the Barons of the Exchequer in Scotland, transmitting certain observations of the Lords of the Treasury on the abbreviate account of receipts and payments on His Majesty's revenue of Excise, Scotland, for the quarter ended 1730, Michaelmas, and concerning the claim of 4,983l. 7s. 8¾d. for many years continued and brought forward as remains in cash undisposed, notwithstanding that the Fish Debentures and the annuity for the Equivalent are postponed in their payments for want of moneys sufficient to answer same. Desire the application of the said remains to improve the credit either of the said Fish Debentures or the Equivalent Fund.
