To Patrick Rode, priest, of the diocese of St. Andrews, M.A. Reservation and assignment (seeing that he has this day ceded to the pope the suit pending in the Roman court between him and David de Crainach, priest, of the diocese of Aberdeen, about the chancellorship of Brechin, and all right therein or thereto, and that the pope has granted provision of the said chancellorship to the said David) in order that he (who is a priest, is of noble birth, has come thrice from Scotland to the Roman court, and possesses no benefice) may not suffer too great loss from the said cession, of a yearly pension for life (or until provision has been made to him, and he has obtained possession of a benefice of a yearly value of 50 marks of the money current in Scotland) on the fruits etc. of the said chancellorship of 20 marks of the said money, which is said to exceed by five or six florins the third part of the said fruits etc. (fn. 5); to be paid by the said David, who has consented, and by his successors, in equal portions at Whitsuntide and Martinmas in the city of Brechin. To Walter Hyhert (rectius Lyhert), rector of Hygham in the diocese of Bath and Wells, S.T.B. Grant as below. His recent petition contained that formerly, on the voidance of the wardenship (custodia) of the house or hospital of St. Anthony in the city of London, for scholars and poor, by the resignation of John, [now] bishop of Worcester, then of lower rank (tunc in minoribus constitutus), to Henry, king of England, the said king, in accordance with immemorial custom, admitted the resignation and granted the wardenship, which is without cure, to Walter, in virtue of which he obtained possession and still holds it, but now doubts whether the grant holds good. The pope therefore grants to him, who holds the above church of Hygham, the provostship without cure of the royal college called 'Oriell'' in the university of Oxford, and the said wardenship, value not exceeding 50l., 10l. and 40l. sterling respectively, that he may lawfully retain the said wardenship. To James Ouchtre, priest, of the diocese of Dunblane, bachelor of canon law. Rehabilitation, at his recent petition, containing that formerly, after he, who is of noble birth, had been dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, he was so promoted and obtained the perpetual vicarage of Moneuard in the diocese of Dunblane, resigned it and, without obtaining any other dispensation, obtained the perpetual vicarage of Muthil, resigned it for exchange, and obtained that of Kyppen, both in the said diocese, and that he and John de Toulons resigned the said vicarage of Kyppen and that of Stratychtin respectively, in the diocese of St. Andrews, for purpose of exchange to Michael, bishop of Dunblane who, having power from the late Henry, bishop of St. Andrews, carried out the exchange, in virtue of which he obtained the said vicarage of Stratychtin and had held it for some time when he resigned it for exchange with the parish church of Terwet in the said diocese of St. Andrews, but, the said exchange having been for certain reasons cancelled (recisa), returned to the said vicarage of Stratychtin, and has detained it thenceforward for about five years, taking the fruits of Muthil, Kyppen, Stratychtin and Terwet successively. Rehabilitation, at his recent petition, containing that after the pope lately ordered provision to be made to him, who is by both parents of noble birth, of the rectory of Roba in Kera in the diocese of Tuam alias Mayo, with cure and of lay patronage, then void by the death of Magonius Yhoumys, and dispensed him, being then in about his twenty-second year, to receive and hold it, he obtained it and continued to hold it even after reaching the lawful age, without being ordained priest and without any other dispensation, and has done so for more than a year but less than two years since the lapse of the time allowed by the said dispensation. The recent petition of Andrew de Tulach, archdeacon of Orkney, contained that formerly, when he was holding the perpetual vicarage of Lochrewton, and Alexander de Methfan that of Cowlle, in the dioceses of Glasgow and Aberdeen, Alexander's brother promised Andrew a yearly pension in order that he should resign Lochrewton for exchange with Cowlle, which pension Andrew, having made the said resignation, received for some years; that, in order that Gilbert Vaus should resign his canonry of Caithness and prebend of Canesbi for the said vicarage of Cowlle, whereof Andrew was then in possession, to Andrew's brother (ipsius germano), Andrew promised him a yearly pension, which he paid for some time, committing simony and thereby incurring ecclesiastical sentences etc.; that subsequently, upon the expected voidance of the precentorship (cantoria) of the church of Moray, then held by Ingram [now] bishop, then elect of Aberdeen, by the present pope's promotion of him to that see and his impending consecration, the pope ordered it, a non-major dignity with cure, to be granted in commendam to Thomas, bishop of Orkney, at the same time granting that bishop faculty to resign it without the Roman court to any canon of a cathedral church or other dignitary, and for such canon or dignitary to admit such resignation and carry out an exchange for any benefice with or without cure; that bishop Thomas, in virtue thereof, resigned to John, bishop of Moray, his commenda of the said precentorship, which had been duly made to him on its becoming void by the said promotion and by the said elect's consecration at the apostolic see, that the said Andrew resigned the said canonry and prebend, and that the said bishop John, under pretext of the said faculty, made collation and provision to Andrew of the said precentorship, and granted the said canonry and prebend in commendam to bishop Thomas; that under pretext of the said collation and provision Andrew obtained possession of the precentorship, and has held together for some time the said vicarage of Cowlle, canonry and prebend and precentorship, still detaining the precentorship, and taking the fruits of them. The pope therefore orders the above to absolve Andrew, who is by both parents of noble birth, from the said sentences etc., enjoining penance, dispense him on account of irregularity contracted by celebrating mass etc. when under the said sentences, and rehabilitate him. (fn. 15) The recent petition of Richard Caunton', provost called master of the college called the cantaria iniciati of St. Mary the Virgin near the church of St. Davids, and of the fellows thereof contained that they and their predecessors have possessed, and still possess, in virtue of legacies, grants in frank almoin and appropriations, many and divers lands etc., parish churches, chapels, tithes etc. granted to the said college or to the master and fellows of its chantry by divers lords, founders of the said college or chantry; and especially the priory of Whytwel and the chapel there, situate within the parish of the church of St. Davids, granted by the late Adam, bishop of St. Davids, and the chapter of that church, with certain tenements etc. and rents, namely of Porthmawre Llaythdir Harneglo Redegele Landredyan and other lands etc. and liberties; the temporal court and jurisdiction and cognizance of pleas etc., and the prison belonging of old to the said priory and prior of Wythwel, with the chapel there and oblations made in the said chapel and college, all their rights, customs and appurtenances in the lordship of Pebidiauk in the diocese of St. Davids, likewise the parish churches of St. Ishmael and Llangonnor in the lordship of Kedwely, Malros, Haroldston on the sea, St. Bernachius's, Neverne and Kilcom in the said diocese, with the patronage of the vicarages of the said churches, with all their lands, houses, glebes, possessions, rights, customs and appurtenances; and especially the glebe or lands of the said parish church of Neverne commonly [called] 'Clastir' in the barony of Kemmeys in the said diocese, namely a certain immunity called the Nothvabernach alias the sanctuary of St. Bernachius, where those who wish to dwell, and who flee for sanctuary to the said church or lands or glebe, and especially to the said 'Clastir,' enjoy safety and liberty without any hindrance etc.; that they intend to have and continue their title, right and claim in and to the aforesaid; that the said college possesses many privileges etc., granted to the said master and fellows etc.; and that all bailiffs, sheriffs etc. of the lordships of Pebydiauk, Pembroke, Kemmeys, Kedwely or of the county of Carmarthen, and all others who impugn etc. the said college or churches or their cemeteries, lands, possessions etc. and especially the immunity or sanctuary of the said 'Clastir,' and the precincts of the said college or priory or chapel of Wythwel, force away and arrest, molest etc. refugees therein, take away tithes etc. or hinder them from being paid, detain lands etc. belonging to the said college, violate its rights and privileges etc., break the enclosures and bounds of its lands, drive away the animals of the said master and fellows etc., or aid and abet any of the foregoing, are ipso facto excommunicate, and cannot be absolved until they have made satisfaction. Mandate, at the recent petition of David Gundini, a canon of Ossory (containing that formerly Thomas, bishop of Ossory, inasmuch as the fruits etc. of David's prebend of Clonhymyry in the said church were not worth more than 3 marks sterling, united thereto, with consent of the chapter, the rectory of the parish church of Kylmabuyg in the diocese of Ossory, which has a perpetual vicar, on its voidance by the death of Thomas Cardiiff, in virtue of which David took possession and still holds it to his uses, taking fruits therefrom, which are few; and adding that some hesitate as to the validity of the said union), if he find the facts to be so, to unite the said rectory, value not exceeding 3 marks sterling (besides which David holds the rectory of Beuwle alias Onync in the said diocese, value not exceeding 4 marks) to the said prebend, as long as David shall hold it.
