Declaration, at the recent petition of John Kyrkeby, rector of the parish church of Wythyndon [sic] in the diocese of Worcester, bachelor of canon law, (containing that a number of parish churches of the said diocese, called prebendal, canonically annexed and united to the prebends of the Benedictine church of Worcester whilst it was secular, one of which is the said church of Wythyngdon, are, by reason of such unions and annexations, by some reputed compatible, and that each of the said several churches has been wont to be held with an incompatible benefice without papal dispensation and by toleration of the ordinary, their holders having been wont, without having been or being compelled to keep personal residence therein, to appoint a perpetual vicar therein) that by reason of the said union and annexation the said church, value not exceeding 30l. sterling, is compatible, and can be held together with any other benefice having cure or otherwise incompatible, even if it be another parish church or a perpetual vicarage or a dignity etc.; provided that the church of Wythyngdon and such incompatible benefice be not defrauded of their due services, and that the cure of souls in such benefice, if any, and in the said church be not neglected, and that the said church be served in masses and other divine offices by a fit priest, whose needs shall be fittingly ministered to from its fruits etc. Ad. fut. rei. mem. Grant, at his recent petition (containing that he formerly built to the honour of God and His Mother the Virgin Mary a chapel at the place of Pendele within the bounds of and about a mile distant from the church of the parish of Aldebury in the diocese of Lincoln, because the road from the said place to the said church is muddy and dangerous, especially in wintry and rainy weather) that in time of need, when the said chapel has been sufficiently endowed, a fit priest chosen by the said donsel, and after his death by his sons and lawful male descendants, may in the said chapel celebrate masses and other divine offices, hear the confessions of all the inhabitants of the said place and others who are there for the time being, and, only in cases granted or permitted to rectors of parish churches, grant them absolution and enjoin penance, administer the sacraments of Eucharist [and] Extreme Unction and Confirmation (fn. 12) and other sacraments and sacramentals, and bury the said inhabitants etc.; and that the said inhabitants may lawfully go to the said chapel for the said masses and divine offices, even on Sundays and other feast days; saving the right of the said church etc. Magne devotionis affectus. To Thomas Tanfeld, rector of Odyngton in the diocese of Lincoln, S.T.B. Dispensation as below. Lately (upon its being set forth to the pope on his behalf that after he had been dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, but insufficiently so, inasmuch as he was the son, not of an unmarried but of a married woman; and after grant was made to him by the said authority to minister in minor orders and in those of subdeacon and deacon, to which he had had himself promoted, and to be promoted to the priesthood, and, after dispensation was made to him anew, to hold such benefice even if with cure, after which second dispensation he, having been promoted to the priesthood, obtained the parish church of Gateshed in the diocese of Durham) the present pope dispensed him to hold four other benefices with or without cure compatible with one another and with the said church, even if parish churches or [perpetual] vicarages or canonries and prebends, administrations or offices, and to resign all, simply or for exchange, as often as he pleased, and hold instead five other mutually compatible benefices, after which, as his recent petition contained, he resigned the said church and obtained that of Odyngton. The pope now, at the said petition of Thomas, who is also M.A., and is dean of the chapel of John, cardinal priest of St. Balbina's, and holds the said church, value of exceeding 20l. sterling, abolishes all disability contracted on account of the foregoing, decrees that the collations made to him of the said church of Odyngton, and of any other benefices which he obtained compatible therewith, shall hold good, and dispenses him to hold the said church and such collated benefices as he possesses and any other benefices with or without cure of any number and kind, compatible with one another and with the said church and collated benefices, even if canonries and prebends, dignities etc., and to resign all, simply or for exchange, as often as he pleases; with further grant that in future dispensations etc. he need make no mention of his said defect.
