To the abbot of Westminster without the walls of London. Mandate, at the recent petition of Thomas Taylard, priest, of the diocese of Lincoln (containing that formerly, after Martin V's confirmation of all sentences etc. promulgated by popes against simoniacs, and his reservation to himself and his successors of absolution therefrom, and after the present pope's like confirmation and reservation, upon the voidance of the parish church of Berowghy in the said diocese, certain of Thomas's kinsmen or friends without his knowledge gave and assigned to the patron some silver vessels (fn. 2) to the intent that he should present Thomas to the ordinary, which he did, the said ordinary instituting him and Thomas taking possession; after which the said kinsmen or friends informed Thomas of the said gift and assignment, which he ratified, paying to them a certain quantity of money by way of recompense), to absolve Thomas from the said sentences etc. incurred, enjoining penance, dispense him on account of irregularity contracted and rehabilitate him. In the event of the above abbot's so doing, the pope hereby grants indult that Thomas may, without resignation and without fresh presentation and institution, continue to hold the said church. Confirmation etc. as below. The recent petition of the dean and chapter of the church of Salisbury contained that a custom was lately observed in the said church that canons and persone with dignities, (fn. 3) before being admitted to personal residence, made a feast in which some laid out 100l. and more; and that the dean and chapter commuted the said feast or the cost thereof into other works of the fabric, and the sustentation of the persone residing and keeping hospitality, and made a statute and ordinance that henceforth in perpetuity, at the time of their admission, simple canons should, on account of their prebends, pay to the dean and chapter for the said purposes etc. 107 marks sterling, 6s. 8d. of the money current in those parts, and canons holding dignities 157 marks 6s. 8d., on account of their dignities [Statuta et Consuetudines Eccl. Cath. Sarisberiensis edd. E. A. Dayman & W. H. R. Jones, Bath, 1883, pp. 92, 93.] The pope hereby confirms the said commutation, statute and ordinance, and moreover, potiori pro cautela, ordains that henceforth all who by reason of simple prebends, and all who by reason of a prebend and a dignity, wish to be admitted to residence shall at the time of admission or before pay to the dean and chapter for the above purposes 107 marks 6s. 8d. and 157 marks 6s. 8d. respectively. To John Penbroke, clerk, of the diocese of Meath. Rehabilitation, at his recent petition containing that the late archbishop of Armagh or his vicar-general in spirituals was ordered to dispense him by papal authority, on account of his illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure; that before the said mandate could be executed by the said archbishop, who died before it was presented, or by his vicar, the said John, believing that it could be executed, presented the letters thereof to John Lyde, prior of the Augustinian monastery of Loueth in the said (sic) diocese [of Armagh], one of the guardians of the spirituality of the church of Armagh; and that, after the said prior had executed the said letters, John had himself, in ignorance of the law, promoted to all, even holy orders, ministered therein and obtained, collated to him by authority of the ordinary, the chantry of Holy Trinity in the parish church of St. Nicholas in the Shambles, in the diocese of London. Besides rehabilitating him, the pope grants that the said collation and obtaining shall hold good from the date of these presents, as if he had been sufficiently dispensed, and specially dispenses him to minister in his orders and hold the said chantry. Per hoc presens publicum instrumentum,' which the pope has caused to be examined in his chancery, drawn up in the year of the Incarnation 1435, August 12, indiction 13, the 5th year of pope Eugenius, by and in the presence of John Ydill, clerk, of the diocese of St. Andrews, notary public by imperial authority, in the presence of, as witnesses, Sir William Hernwart, vicar of F(er)nuel (fn. 4) in the diocese of Brechin, Sir Richard Dot, vicar of Balhelwy in the diocese of Aberdeen, and Sir Patrick Nicholaii, priest and notary public, and many other witnesses [not here named], and sealed with the seal of John, bishop of Brechin, and the common seal of the chapter of Brechin, whereby the said bishop John, Master Cuthbert, dean, Sir Gilbert, precentor, and other canons and prebendaries of Brechin, in chapter-house on the above date assembled, (having been duly summoned by the said dean, as was testified by the said bishop, by other canons and by Sir John Strile [rectius Steile], notary public), ordained, upon exposition being made by the said bishop of the poverty of the said church and its entire lack of vestments and other needful ornaments, that for buying and renewing the same each new bishop, dean and canons should pay as follows from the first fruits of their benefices, giving good security before their reception by the chapter and taking oath to the dean, or, in his absence, to the senior member of the chapter, (fn. 5) to wit, the bishop, as prebendary of Brechin, 10 marks of the money current for the cope (cappa) of his said prebend, (fn. 6) the dean, precentor, archdeacon, vicar [and the prebendaries of] Lethnot [and] Glenb(er)wy[n] (fn. 7), each 5 marks, and all others holding dignities and prebends, each 40s. Appointment — seeing that, as Charles, king of the French, has signified to the pope, he has recovered from his adversaries the city of Evreux and a great part of the diocese, and holds suspect, on account of his adhesion to the said adversaries during their occupation, bishop Pasquerius [de Vaux] (fn. 12), who does not reside in the said city and still adheres to the said adversaries—of the said William (who is a priest, has made an open profession of the said order, and is by both parents of noble race, at the petition of the said king, who asserts that William is the uncle of Robert de Floquez, lord of le Chatillon (de Castilione) in the diocese of Bourges, the said king's captain and bailli in those parts) to be administrator in spirituals and temporals, during the pleasure of the pope and the apostolic see, as far as regards the said city and the other places in the said diocese which are and shall be under the temporal dominion of the said king; with the necessary faculties etc. Romanus pontifex in quo. Mandate, at the petition of Magonius Megaerathai, layman, and Derborgyll ni Ykeallay, of his diocese (containing that they, he being aware and she unaware that they were related in the second and third degrees of affinity, contracted marriage per verba legitime de presenti and had offspring therefrom, and that he meanwhile committed fornication, once only with a daughter of Derborgyll's sister, and with another woman, wherefore he and Derborgyll are related in the second and fourth degrees of affinity) to absolve Magonius from excommunication incurred, enjoining upon him penance, and afterwards, if it seem expedient, and after temporary separation, to dispense Magonius and Derborgyll to contract anew and remain in the said marriage, decreeing the said and future offspring legitimate. Dispensation to him (who was formerly dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself made a clerk, and who is in or about his twenty-first year) to hold any benefices compatible with one another and with the said benefice, of any number and kind, with or without cure, even if canonries and prebends, dignities, etc., and to resign all, simply or for exchange, as often as he pleases. After attaining his twenty-third year he may hold one of the said benefices which shall be with cure and be a parish church, or a perpetual vicarage or a dignity etc., and may have himself promoted to all the said orders.
