Extension of the faculties, except only those concerning benefices, which the pope recently granted to him for his mission to Charles, king of France, (fn. 2) so that they may apply to the realm of England, to whose king, Henry, the pope is also sending him on arduous business of the pope and the universal church. To William Croyser, archdeacon of Teviotdale, papal nuncio. Faculty, at the recent petition of abbot Patrick and the convent of Holyrood—containing that the late Jordan, cardinal bishop of Albano, called cardinal Orsini (de Ursinis), after divers inquiries and processes in regard to the charges made against the said abbot, by John de Kers, a monk (sic) of Holyrood, deprived the abbot, whereby he and the convent incurred the sentences contained in the said processes; and praying for a remedy, alleging that there is no truth in the said charges—to make inquiry into the said charges, and if he find that the abbot has been falsely accused, to annul the said processes and sentences, absolve the abbot and convent from all sentences of excommunication etc. incurred in virtue of the said processes, dispense them on account of irregularity and rehabilitate them. The said abbot is, however, to take anew to the above William an oath to be faithful and obedient to the pope and the Roman church, and to resist all attempts against the honour, dignity or estate of the pope and the apostolic see. Faculty to him, whom the pope is sending as his nuncio to Scotland, to absolve John, bishop of Glasgow from all sentences of excommunication etc., howsoever incurred even by contempt of papal mandates, and to absolve him from the crime of perjury incurred by not observing promises made under oath, to dispense him on account of irregularity, and to rehabilitate him. The bishop is to take oath to him that he will be faithful and obedient to the pope and his successors, and will oppose the enemies of the pope and the Roman church. Cum te de cuius fidei. (Poggius. To the bishop of Moray, and Master William Croyser, archdeacon of Lothian, apostolic notary and nuncio. Mandate as below. The recent petition of John, Cistercian abbot of Kynlos in the diocese of Moray, contained that although he obtained peaceable possession of Kynlos and for ten years and more has laudably governed it, recovering at great labour and expense many of its alienated goods, and abstaining from perjury and every other appearance (specie) of evil, nevertheless, upon Henry Butie, a Cistercian monk of Cupar in the diocese of St. Andrew's, falsely suggesting to the pope that the said abbot was publicly keeping, and committing incest with certain women related to one another by kindred (invicem consanguineas), had alienated certain goods of his monastery, had been false to his oath, and been guilty of divers other crimes, the pope ordered the precentor of Moray, in case the said Henry would accuse the said abbot before him, to summon the abbot and others concerned, make inquiry, and if he found the said charges true, to deprive the said abbot, and in that event to make provision of Kynlos to Henry. At the said petition, which added that Ingram Lyndesay, precentor of Moray, has not yet begun to proceed to the execution of the said mandate; seeing, too, that the said abbot holds the said precentor suspect, the pope revokes the said precentor's commission, and orders the above two to summon the said Henry and others concerned, make inquiry, and if they find Henry's statement false, and the said abbot's true, to impose on Henry perpetual silence, and not to allow the said abbot to be molested by him or any other in regard to the aforesaid. To James, bishop of Dunkeld, residing in the Roman court. Mandate to carry out the exchange desired by Walter Stewart, archdeacon of Aberdeen, of the said archdeaconry, a non-major, non-elective dignity with care, value not exceeding 50l. sterling (provision of which the pope made to him on its voidance by the death of Thomas de Tynyngan, a papal chaplain, previous to which it was reserved to the pope, and possession of which he has not yet had) and Laurence Piot, canon of Glasgow, of his canonry and prebend of Cardios (rectius Cardros) therein, value not exceeding 20l. sterling.
