Mandate to absolve from the guilt of perjury, imposing a salutary penance, Thomas Lanke, perpetual vicar of Mildenhale in the diocese of Norwich, who, in spite of the oath of personal and continual residence which he took in accordance with the constitutions of the legates Otto and Ottobon, absented himself for five months in the service of the then bishop of Norwich, and afterwards for six months at the advice of his physicians for the recovery of his health after a grave illness. To the bishop of Alet, and the dean and archdeacon of Emly. Mandate as below. The recent petition of Maurice Ocongalygh, priest, of the diocese of Limerick, contained that on the voidance of the perpetual vicarage of Kylldyma in the said diocese by the death of Walter de Walle, the late John de Geraldinis, archdeacon of Limerick, the collation and provision belonging by ancient custom to the archdeacon of Limerick, made collation and provision by his ordinary authority to the said Maurice, who had received papal dispensation; as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure; that subsequently (after Maurice had, in virtue of letters of the present pope [above, p. 167] ordering provision to be made to him of a benefice with or without cure, even if a canonry and prebend in a cathedral church, in the common or several gift of the bishops and the deans and chapters etc. of Killaloe and Limerick, and dispensing him to hold such benefice, obtained the canonry and prebend of Kyllydy in Limerick) on the voidance of the prebend of St. Munchin (Sancti Monchini) in the same church of Limerick by the death of Philip Ohanly, bishop Cornelius made collation and provision by his ordinary authority to Maurice, although not sufficiently dispensed for the purpose on account of the said defect; and that in virtue of the said collations and provisions he obtained possession of the said vicarage and prebend of St. Munchin, receiving, however, no fruits from the latter. Seeing that the collation and provision of the said prebend is therefore invalid, and seeing that, as the said petition added, Maurice doubts the validity of the collation and provision of the said vicarage, the pope orders the above three to collate and assign to him the said prebend of St. Munchin, value with the said canonry not exceeding 12 marks, and the said vicarage, value not exceeding 4 marks, whether they became void as stated, or because the vicarage became void because the said Walter held it for more than a year without being ordained priest, or whether they became void in any other way. He is hereby dispensed to hold the said prebend of St. Munchin and the said vicarage, and to resign them, simply or for exchange, as often as he pleases, and hold instead two compatible benefices. To the abbot of Balmurenach in the diocese of St. Andrews. Mandate as below. The recent petition of Andrew de Crumby, layman, of the diocese of St. Andrews, contained that upon the spontaneous confession of the late John Blich, layman, before the officers of the town of Hadingtony, where he was then living, that he owed a certain sum of money to the said Andrew, certain goods of John to the value of the said sum were by the said officers assigned (deliberata) to Andrew; that Thomas de Bening, layman, of the said diocese, pretending that the said John, who had then died, was indebted to him at the time of his death in a certain other quantity of money, and that Andrew was bound to pay it from the said goods, brought him before John, [now] bishop of Glasgow, then official of St. Andrews, who, without observing legal procedure, gave a definitive sentence against Andrew. At the said petition, adding that the nullity of the sentence can be made manifest from the acts of the cause, and praying the pope to commit the cause of nullity to some person in those parts, the pope orders the above abbot to summon those concerned, and decide what is just without appeal, enforcing his decision by ecclesiastical censure. To the inhabitants of the town of Nigwotonbusschel in the diocese of Exeter. Licence at their recent petition—containing that near (circa) their said town, which is within the bounds of the parish church of Taygcronregis (sic) in the said diocese, whereof they are parishioners, a chapel of All Saints, Highwike, has been erected and founded, with bell-tower, bells and font, in which they and the inhabitants of other neighbouring lands, on account of the distance of the said church, in some cases about three English miles, receive all the sacraments, but not burial, and that they are wont to carry their dead first to the said chapel and, after mass there and the customary oblations, to the said church for burial; and adding that on account of the tides and overflowing of rivers and the muddy roads in winter, and the intense heats in summer, they are subject to many inconveniences and dangers—to construct at the said chapel, which is served by a priest appointed by the perpetual vicar of the said church, a cemetery, and to have it blessed and the said chapel consecrated by a catholic bishop; saving the right of the said church and of any other. To Philip Standun, clerk, of the diocese of Dublin. Rehabilitation on account of the following. His recent petition contained that after having received papal dispensation, as the son of a priest and an unmarried woman, to be promoted etc. as above, f. 44, he was presented to archbishop Richard for the perpetual vicarage of Kyllachdrynyn in the diocese of Dublin by the Cistercian abbess and convent of Gracedieu (de Gracia dei) in the said diocese, to whom the presentation belongs by ancient custom, was instituted by the said archbishop and obtained possession; and that on account of a suit which arose meanwhile in those parts about the patronage between the said abbess and convent and a certain layman, he, fearing molestation, did not have himself ordained priest within the year and two months during which he was in possession. He is hereby rehabilitated, and is to resign. Sedes apostolica, pia mater.

Mandate, recapitulating the preceding (with the variant Kyllachdrynyn alias de Castronovo, and mentioning that the vicarage became void by the death of Maurice Standun) to collate and assign to the above Philip, upon his resignation, the said vicarage, still void by the above non-promotion, value not exceeding 16 marks. As soon as he obtains it under these presents, he is to have himself ordained priest at the first statutory time; if not, he shall be deprived, and it shall be void co ipso. Vite etc. (Ja. xxii. Mandate, at the recent petition of Peter de la Hay, donsel, and a number of the parishioners of the parish churches of Aghton and Bubbewith in the diocese of York—containing that they are often prevented from being present at divine offices in the said churches, especially in winter by floods, snow and hail; and adding that near (circa) the bounds of the said parishes a chapel of St. James was of old founded and dedicated—to grant that they may, during the said hindrances, cause mass and other divine offices to be celebrated by a fit priest in the said chapel; saving the right of the said churches and of any other. The present pope lately dispensed him to hold for five years St. Sampson's together with any other benefice with cure or otherwise imcompatible, even if another parish church etc. [above, p. 176]; and subsequently prolonged by a further year the said period, which was not expired, and during which he had obtained the parish church of Fytylton in the said diocese. At the petition of Oliver (who is of noble birth, and holds also a canonry and the prebend of Major Pars Altaris in Salisbury, value not exceeding 30 marks) containing that the end of the said year is at hand, and that he has resigned neither of the said two churches, value together not exceeding 70 marks, the pope hereby prolongs the said year by five. Mandate, at the recent petition of the parishioners of Fysshlace in the diocese of York, dwelling on the bounds of the said parish, containing that they dwell in places which are often watery and miry and remote from the said church, whose parish is a wide one, and sometimes cannot go without danger to the said church to receive the sacraments and baptize their children; and that they propose to found and erect a chapel of Holy Trinity near the said bounds, within the parish, having a font and parochial insignia, and to endow it for a priest to celebrate mass and other divine offices and administer sacraments and sacramentals—if the said parishioners assign such endowment, to license them to found and erect the said chapel, and cause it and its cemetery to be consecrated by a catholic bishop, etc.; saving the right of the said church. Exhortation to all faithful to give alms towards the building and conservation of a stone bridge over the river Tweed (de Tweda) by the town of Melros in the diocese of Glasgow, for want of which, especially in flood time, people have been drowned; with relaxation, during three years, of a hundred days of enjoined penance to penitents who do so. The pope inhibits the sending of these presents by questuarii, and declares that, if this be done, they shall be null. Ad constructionem et conseruacionem poncium.

Relaxation, during ten years—the pope having learned from Thomas Brygman, perpetual vicar of Foston in the diocese of York, that the buildings of the said church are very ruinous, and that it lacks a tower for hanging bells and for ringing to divine office, and that the parishioners, on account of divers burdens imposed by king Henry for his wars, and of the mortalities which have afflicted those parts, are too poor to repair the said buildings and build a tower—of two years and two quarantines of enjoined penance to penitents who on the principal feasts of the year and that of the dedication, the octaves of certain of them and the six days of Whitsun week, and of a hundred days to those who during the said octaves and days, visit the said church and give alms for the said repair and building. Mandate—at the recent petition of James, earl of Ormond (Ermonie), containing that on account of the dissolute, unreligious and immodest life of the nuns of the Augustinian monastery of St. Mary the Virgin de Belloportu alias Kylkylchyn, in the diocese of Ossory, of which he is one of the founders, very many inconveniences and scandals have arisen, and worse are feared; and praying for the suppression of the dignity of abbess and of the said order in the said monastery, the creation and endowment of secular benefices, and the perpetual reservation, for alternate turns, of the patronage to the said earl and his successors and heirs, earls of Ormond—to summon those concerned, and if he find the facts to be as stated, and if the consent of those interested be forthcoming, to decree that no one is to be received henceforth as a nun of the said monastery and, as soon as the present abbess and nuns have ceased to be, whether by being transferred to other monasteries of their order or otherwise, even by their death, to suppress and extinguish the dignity of abbess and the said order, erect the monastery church into a secular church, and, if he think good, into a collegiate church, institute and endow with the rents etc. three such benefices, make statutes etc., and reserve the patronage for alternate turns, as requested, the patronage for other turns being reserved to the bishop himself and his successors. Mandate—at the recent petition of James, earl of Ormond, containing that he proposes to institute and endow in the church of Ossory eight prebends for eight canons, and desires the collation of such canonries and prebends to be reserved in perpetuity to himself and his successors and heirs, earls of Ormond—after the said earl has assigned a sufficient endowment, to create the said canonries, and to grant the earl licence to institute the said prebends, and to reserve the collation, as desired. Decree, at his petition—containing that in consequence of the said chancellorship, which is a non-major dignity, he has to pay, on account of the prebend of Brikels- worth in the diocese of Lincoln and five chapels annexed to the chancellorship, and on account of the repair of the buildings of the said chancellorship, prebend and chapels, episcopal rights and divers other burdens, and that the said chancellor- ship has for some time past been impoverished by wars [and] pestilences which for many years have raged in those parts—that the said chancellorship shall during the life of John, who is a member of the pope's household, be deemed a compatible benefice, the pope's will and order being that it shall be held by him, without any papal dispensation, together with any other benefice with cure or otherwise incompatible. V, p. 497], rector called master of the poor hospital at Sandon in the diocese of Winchester—containing that formerly, on his admission as rector called warden of the poor hospital of St. Thomas the Martyr in Southwek, London, in the said diocese, he, like other priests his predecessors, took oath to live under the rule of St. Augustine, that he was afterwards, with consent of bishop Henry, transferred to the said hospital of Sandon, and that he fears that he is still bound by the said oath—if he find the facts to be as stated, to absolve Henry from the said oath, and grant him indult to live according to the custom of Sandon. Mandate, at the recent petition of John Kyrkby, rector of Skelton in the diocese of Carlisle—containing that lately, on the voidance of the said church, which is of the patronage of laymen, a certain layman promised to obtain his presentation, on condition of John's promising by oath, in the event of his obtaining the church in virtue of such presentation, to resign it when asked by the said layman; that John took the said oath, and that the said laymen duly secured his presentation by the patron, after which he was instituted, obtaining and holding the said church, as he still does, in virtue of the said presentation and institution; and adding that John, who has not yet been asked to resign, repents of his said oath and promise, which he proposes in no wise to observe—to relax the said oath, so that John shall not be bound to observe it against his will, a salutary penance being enjoined. Indult that the dean of his chapel and other priest or priests of his chapel or household appointed by the said dean may, as often as necessary, hear the confessions of all the members of the duke's household and grant them absolution, even in cases in which the ordinaries can do so, enjoining a salutary penance, and may commute vows of pilgrimage and abstinence of the duke and his consort and the said members of his household, except only vows of the Holy Land (ultramarino), SS. Peter and Paul and St. James; with exemption from all jurisdiction of any ordinaries, during the pleasure of the apostolic see, of the said dean and priests and other clerks of the said chapel and household. The pope lately [above, p. 442] dispensed him, then holding Teueryngton, value not exceeding 26 marks, to hold therewith for life any other benefice with cure or otherwise incompatible, and to resign both, simply or for exchange, the letters of dispensation mentioning that he was a bachelor of theology, which he was not, but which he has since become, but not mentioning that he was holding the hospital of SS. James and John, Ayno, in the diocese of Lincoln, wont to be assigned as a perpetual benefice, value not exceeding 15 marks. The pope therefore grants to Robert, who is also M.A. and of noble race, that the said letters shall hold good from the present date, notwithstanding the said omissions.
