Mandate, at the recent petition of Patrick Yclinnan and other friars of the third order of St. Francis, called the order of Penitence in Ireland — containing that formerly Walter de Burgo, lord of Congnacnicuile, chief of his sept (capitaneus sue nacionis nuncupatus), and his brothers, of the diocese of Tuam, and a number of other faithful of those parts gave to the said Patrick, friars and order, certain possessions and lands in the said and other dioceses, for the founding of houses and monasteries and churches, and that in one of the said possessions, within the said diocese, Patrick and the said friars have begun to build, with licence of the ordinary, a house or monastery with church, bell-tower, bell, cloister and other
offices—if he find the facts to be as stated, to confirm the said possessions to the said Patrick, friars and order, and to grant them licence to complete the said building, with church, cemetery, bell-tower, bell, houses and other offices, to retain and inhabit the same, to receive and retain gifts of lands etc., to beg alms and convert them to the said building etc., and to say and celebrate divine offices according to the manner of the Roman court. The above dean is to further grant that the friars and sisters of the said order in Ireland, who hear divine offices and receive the sacraments in their own churches, cannot be compelled by parish priests and others to do so elsewhere. Mandate, at the petition of William Pulard, a Friar Minor of the house de la (sic) lymclayr in the diocese of Annadown, containing that once, when he was in priest's orders, he and several others, clerks and laymen, playing at a game in which the players held a long thin blunt-pointed stick (virgam longam subtilem et in anteriori parte obtusam), which they threw (ribrarent) one after the other, he accidentally struck on the temple near the ear one of the players, Donald Ohaschin, a layman, and that the blow produced a small wound from which, after half a year, during which Donald went about eating and drinking, thanks to his own bad treatment and the unskilfulness of his surgeons, he died; and adding that William was not otherwise guilty of Donald's death —if he find the facts to be as stated, to rehabilitate him, dispense him on account of irregularity, and dispense him to minister in his orders. Dispensation to him (who after having, when a clerk, entered and made his profession as a canon of Holyrood, and caused himself to be promoted to all holy orders, received successive papal dispensations, as the son of a married man and an unmarried woman, to be promoted (i) to all administrations and offices of his order, (ii) to benefices wont to be governed by canons of his order, (iii) to dignities, even abbatial, of his order, after which dispensations he obtained the perpetual vicarage of St. Cuthbert near the said town, wont to be governed by canons of his order, and, resigning it, was appointed abbot of Holyrood, subsequently resigning the abbey to bishop Henry and having a yearly life pension of 30l. (cf. f. 184d) of old sterlings reserved to him by the said bishop, to be paid by the abbots for the time being, and obtaining from abbot Patrick the priory of St. Mary de Trahile, of the said order, in the diocese of Whiteherne, an administration without cure, which he has likewise resigned to the said abbot) to hold any benefice with or without cure, wont to be governed by Augustinian canons, and to resign it, simply or for exchange, as often as he pleases. To the bishop of Alet, the abbot of Kelso (Calcouien.) in the diocese of St. Andrews, and the archdeacon of Glasgow. Mandate as below. The recent petition of Henry de Driden, canon of Holyrood, Edymburgh, licentiate of canon law, contained that on the voidance of the perpetual vicarage of Faukirk in the diocese of St. Andrews, wont to be governed by canons of Holyrood, by the resignation to bishop Henry, of James Cameron, canon of Holyrood, abbot Patrick and the convent, in accordance with ancient custom, presented him to the said bishop, who instituted him, by virtue of which presentation and institution he obtained and holds possession, but doubts whether the said presentation etc. hold good. The pope, having learned that the said vicarage is still void, hereby orders the above executors to collate and assign to the said Henry (who is a priest, and who when a clerk etc., as in the preceding mandate, which is here recapitulated, with abridgement, as far as the end) the said vicarage, value not exceeding 20l. of old sterlings, whether it became void as stated, or in any other way; notwithstanding that a yearly life pension of 20l. Mandate, at the recent petition of William, Benedictine abbot of Kelso (Calkouien.) in the said diocese, immediately belonging to the Roman church—containing that in the parish church of St. James, Roxbuich (sic), in the diocese of Glasgow, a perpetual chaplaincy was founded by the late Roger de Aldton, layman, and that divine office was long celebrated by a chaplain at certain times of the year for the welfare of the souls of the said founder and his wife and friends, but that on account of the ruin of the said church in the border wars the saying of the said office has been long neglected and is not likely to be soon resumed—if the rector and the founder's heirs consent, to grant licence to the said abbot to cause the said office to be celebrated in a fit chapel of his monastery by a secular or regular priest, even a priest of the monastery, appointed by the said abbot (who asserts that to him belongs by ordinance of the said founder the choice of a chaplain), until the said church returns to its due state and the said chaplaincy to its wonted revenues, applying all the revenues of the said chaplaincy to such priest. Licence, at their recent petition (containing that out of reverence for St. Thomas the Martyr a great multitude resorts thither from divers parts of the world, and that there has been at times, by reason of pestilences and other misfortunes, a lack of ministers, especially of those in holy orders and the priesthood) that during five years any of the monks may be promoted to the subdiaconate, the diaconate and the priesthood on attaining their seventeenth, nineteenth and twenty-second year respectively, by any catholic bishop, without requiring licence of the ordinary.
