Mandate to collate and assign to John de Heton, priest, of the diocese of Aberdeen, the still void parish church of Eglismaqwhy in the diocese of St. Andrews, value not exceeding 25 marks sterling, collation and provision of which he formerly received from bishop Henry on its voidance by the resignation of Richard de Cornel. To the archbishop of Canterbury. Mandate as below. The recent petition of Ralph Webbe, perpetual vicar of St. Martin's in the Fields near Charringcrosse in the diocese of London, contained that the master and brethren of the Augustinian chapel or hospital of St. Mary Rouncevall (Rouncidivallis) by Charringcrosse, [under pretext] of certain pretended letters of Boniface IX, usurp and unduly detain possession of tithes, oblations and other parochial rights belonging to the said vicar; that the said archbishop is holding under arrest, pending a further inquiry, the said letters and others asserted to have been granted to the said master and brethren by the apostolic see, suspecting them to have been forged, which forgery also appeared prima facie from an examination which the pope has caused to be made by certain abbreviatores of papal letters, of authentic copies, whose tenor, form and style differ from those common to the papal chancery. The pope, at the said petition, orders the archbishop to send the said letters without delay to the papal chancery for examination, to assign to the said master and brethren a period within which they shall appear before the pope to receive justice, and, if the forgery be manifest to the archbishop, to sequestrate the said tithes etc. until the pope informs him whether the said letters are genuine or not. To the bishop of Dunblane and the officials of Dunkeld and Brechin. Mandate to collate and assign to Alexander de Caryutors, priest, of the diocese of St. Andrews, the still void perpetual vicarage of Linctrethyn in the said diocese, value not exceeding 16l. of old sterlings, which, being in the gift of the bishop, he formerly accepted, and of which he had provision made to him, on its voidance by the death of John Stele, under a mandate of provision by the present pope of a benefice with or without cure, wont to be assigned to secular clerks, in the gift of the bishop and the prior and chapter of St. Andrews. He doubts whether his acceptance and the provision made to him of the said church hold good. The collation is to be made whether the church became void as above or by the death or resignation of the late David de Fauconer, or otherwise. Vite etc. (Ja. xx. Quarto Kal. Mandate (at the petition of Thomas Rosell[is], canon of Dublin, containing that in his cause long ventilated in the apostolic palace before divers auditors against John Whythede, clerk, of the diocese of Dublin, about the canonry and prebend of Glemethan in Dublin, which Thomas accepted and provision of which he had made to him in virtue of certain papal letters, and of which John took possession, he obtained three definitive sentences adjudging the canonry and prebend to him, imposing perpetual silence on John and condemning him in costs, letters executory of which sentences he has obtained, addressed to the above three) to proceed to the execution of the said sentences against any other intruders, present or future, as far as regards possession, as if they had been delivered against them. To the archdeacons of Cork and Cloyne, and the chancellor of Cork. Mandate (at the petition of Robert Holhgan alias de Cork, rector of Compton Basset in the diocese of Salisbury, abbreviator of papal letters, containing that the cause which lately arose between him and Richard Pellyn, dean of Cork, about the perpetual vicarage of Kynsall in the diocese of Cork, was, although it had not lawfully devolved to the Roman court, committed by the present pope, at the instance of the said dean, to Martin, bishop of Coria (Caurien.), then holding by the pope's order the place of a papal auditor, who has proceeded short of a conclusion; and adding that the cause could be better judged in those parts than in the said court, to which Richard's proctor agrees) to hear further the said cause, which the pope hereby calls up to himself, and to decide it. Mandate, as above, f. 98, at the petition of Thomas Rosellis, archdeacon of Kells (de Kenlis) in Meath, containing that in his cause long ventilated in the apostolic palace before a certain auditor against Robert Sutton, clerk, of the diocese of Meath, about the said archdeaconry with the annexed parish church of Nobire in the said diocese, provision of which was made to Thomas, and possession of which Robert unlawfully detained, he obtained a definitive sentence by which the archdeaconry was adjudged to him and perpetual silence imposed on Robert, who was condemned in fruits and costs, letters executory of which sentence he has obtained addressed to the above three. To the bishop of Dunkeld, the abbot of Balmurinoch in the diocese of St. Andrews, and the dean of Dunkeld. Mandate—at the recent petition of William Young (Juvenis), rector of the parish church of Futhenevyn in the diocese of Brechin, containing that although the lands of Duwe in the said diocese are situate within the bounds of the said church, and the tithes therefrom belong to the rector of the said church, Malcolm de Aula, rector of Tannadas in the same diocese, falsely claiming that the said lands are in the bounds of his said parish, has taken the said tithes for some years; and praying for the commission in those parts of the cause which he proposes to bring against the said Malcolm—seeing that in the said diocese there are no judges, besides the above abbot, competent to be judges in the cause, to summon the said Malcolm and others concerned, and hear and decide the cause without appeal. If the abbot cannot take part, the other two or one of them shall act as executors. Exhibita nobis. |
