Mandate, at the recent petition of John Tanner, canon of Cloyne, to confirm the appropriation made for John's life, by the late Gerald, bishop of Cloyne, with consent of the chapter, of the parish church of Yoghwl in the diocese of Cloyne, to the prebend of Cachyrwltan in Cloyne, value not exceeding 20 and 3 marks respectively, both of which John held, as he still does, the said church being served by a vicar. To the abbot of Newbotill in the diocese of St. Andrews. Mandate (at the petition of Patrick Stephani, priest, of the diocese of St. Andrews, containing that he and John de Dalchet, priest, agreed to exchange their respective benefices, namely the parish church of Penikuke and the perpetual vicarage of Lesewade in the said diocese, the latter of which is of greater value than the former, on condition that they should continue to receive for life the fruits of their said respective benefices, even after the exchange should be effected; that the exchange was carried out by bishop Henry, to whom Patrick took oath that there was no fraud or simony or other unlawful compact on his part, and who was ignorant of the above compact; and that Patrick has held possession of the said rectory for six months) to absolve Patrick from excommunication incurred and from the crime of perjury, enjoining a penance, rehabilitate him and dispense him on account of irregularity. He is to resign the vicarage. Sedes apostolica, pia mater.

Mandate (Alexander Scerar, priest, of the diocese of Aberdeen, having reported to the pope that Hugh de Wellys, rector of Durrys in the diocese of St. Andrews, induced John Dermont to resign his perpetual vicarage of Kynnerny in the diocese of Aberdeen to the ordinary in favour of Alexander de Balcassy, priest, of the said diocese, Hugh's singular friend, in return for a yearly sum during John's life of 8 marks of silver to be paid by Hugh), if Scerar will accuse Hugh before the said official, to summon those concerned and decide the matter without appeal, and if Hugh be removed from Durrys on account of the above simony, to collate and assign it, value not exceeding 20 marks sterling, to Scerar. To Gilbert Cauen, rector of Carnemol in the diocese of Whitehern, bachelor of canon law. Dispensation to him (who is a priest, and whom Benedict XIII dispensed to hold for three years with Carnemol one other parish church, requiring him to exchange within the said period one or other for a benefice compatible with the remaining church, and, if not, to resign such other church; after which dispensation, as his recent petition contained, he obtained the parish church of Purton in the said diocese, which he has held with Carnemol under the said dispensation), the said three years being nearly at an end, to hold together for four more years the said two churches, value altogether not exceeding 80l. sterling. Within the said period he is to exchange, as usual; if not, he is to resign Carnemol. Litterarum etc.

Exhortation to all faithful to help in building the bridge which Andrew de Hawyke, rector of Liston in the diocese of St. Andrews, proposes to build between Edinburg and Linlithc[o]w over the river Aumonde, which flows near the church of Liston, and for want of which many people are drowned or exposed to danger; with relaxation, during fifteen years, of three years and three quarantines of enjoined penance to penitents who do so. The pope inhibits the sending of these presents by questuarii, and if this be done, they are declared void. Universis … Quoniam ut ait apostolus. [See f. 183d.]

Indult motu proprio to him who, being a notary apostolic, has lived for some time in the Roman court not without great expense, and to whom the pope has recently [below, Reg. CCIX, f. 117d] made provision of the see of Hereford, the fruits of which are insufficient, to retain during the pope's pleasure, even after his consecration, his canonries and prebends of Strensale in York, Swerdes in Dublin and Stodeley in Rypon. To John Mayev (sic), rector of Yelvertoft in the diocese of Lincoln, bachelor of canon law. Prolongation by five years of the period of seven years, the end of which is at hand, for which he, who is of noble birth, received papal dispensation to hold with Yelvertoft, value 60 marks, which church he still holds, any other benefice with cure or otherwise incompatible, even if another parish church or a perpetual vicarage or a dignity etc., and to resign both meanwhile, simply or for exchange, as often as he pleased, and hold two similar or dissimilar benefices, even if parish churches, but not major or principal dignities etc., with the condition of exchanging within the said period one of such benefices for another one compatible with the one retained or, if not, of resigning such other; after which dispensation he obtained the deanery of Blofelde in the diocese of Norwich, resigned it after about four months, and obtained the parish church of Abyndon alias Abyngdon in the diocese of Lincoln, value not exceeding 30 marks, which he has held with Yelvertoft for five years. Within the said further period of five years he is to resign whichever he chooses of the two incompatible benefices for a compatible one, etc. Nobilitas generis, litterarum etc.

To Andrew de Hawyke, priest, of the diocese of St. Andrews. Absolution, dispensation on account of irregularity, and rehabilitation on account of his having, following the common opinion of the realm of Scotland, adhered to Benedict XIII even after the definitive sentence of the Council of Constance against him; of his having, in ignorance of the decree by which the said realm gave its obedience to the present pope, repaired as envoy of Robert, duke of Albany, governor of the realm, to the said Benedict, from whom as soon as he heard of the said decree he departed, without finishing his business, and returned to Scotland; and of his having subsequently paid to Edward de Lawedre, priest, of the said diocese (to whom the pope granted provision, see above, p. 136, of the parish church of Liston in the same diocese, which Andrew held as he still does, as being void by Andrew's adhesion etc., as above), a sum of money in order that Edward should, as he has this day done to the pope, give up the said grant. Dispensation to him—who is a priest, and a secretary and continual member of the household (familiaris continuous commensalis) of Robert, duke of Albany, governor of the realm of Scotland, and who was dispensed by Benedict XIII to hold for three years the above church with another benefice with cure or otherwise incompatible, under which dispensation be held, as he still does, Mukyrsy (also written Murkyrsy) together with the parish church of Forteviot in the diocese of St. Andrews—the end of the said period being at hand, to hold together for seven years the said two churches, whose value does not exceed 60 marks of old sterlings, or, if he resign them, two other incompatible benefices, or, if he resign one of the said churches, one other incompatible benefice. He is to exchange within the seven years, or resign, as usual. Further. he is within a year to satisfy the ordinary with regard to the alleged dispensation by Benedict XIII; if not, the present letters shall be null. Vite etc.

Mandate (at the petition of Gilbert Machperson, bachelor of canon law, rector of St. Columba's in Glascot in the above diocese, which church has been wont to be governed by a rector and by a perpetual vicar, containing that the fruits of the rectory, value not exceeding 40l. sterling, are too slight to enable him to keep hospitality after the custom of the realm of Scotland, and to give meat and drink to all comers) to incorporate, unite and annex to the rectory the perpetual vicarage, with cure and value not exceeding to a non-resident 15l. and to a resident 20l. sterling, of the said church, void because Martin Makillandis held it for a year and more without having himself ordained priest and without dispensation.
