Grant and ordinance, motu proprio, concerning the taking of first fruits during the voidance of the see of Norwich. On its voidance by the death of John [de] Ely, a dissension arose between the prior and chapter of Norwich and Walter, archbishop of Canterbury, and his successor Simon, about the exercise, during voidance, of the bishop's spiritual jurisdiction in his church, city and diocese, which dissension was closed by an amicable composition between the prior and chapter and archbishop Simon. The pope has recently learned that it was therein ordained that from all proceeds, arising during voidance of the see, of visitation and of inquisition into crimes, the archbishop should take two parts and the prior and convent one; that, although in the said composition no mention was made of the taking, during voidance of the see, of first fruits, due to the bishop, from void benefices, from tithes, pensions, etc., some archbishops have since taken and usurped the whole of them; and that, unless remedy is provided by the apostolic see, dissensions will probably arise. The pope therefore grants and ordains that of such first fruits the archbishop shall in future take two parts and the prior and chapter one. Further, if the archbishop or, during voidance, the chapter of Canterbury, or during the absence of the archbishop from his province, his vicar general or the official of Canterbury, do not within fourteen days institute persons presented for institution to void churches etc. in the diocese of Norwich, during voidance of the see, the prior of Norwich may do so. His recent petition adds that in the said second letters no mention was made of his defect of age nor of the fact that at their date he held the archdeaconry, on account of which, as also because the said prebend is sacerdotal, he fears molestation.
