To the dean and the archdeacon of Killaloe (Launien. [sic]), and John Macconmara, a canon of the same. Mandate to collate and assign to Denis Okeayn, priest, of the diocese of Limerick, who alleges that whilst on his way to the Roman court he was plundered by robbers near the pope's city of Viterbo, the perpetual vicarage of the parish church of Hardkane in the said diocese, yearly value not exceeding 5 marks sterling, void by the death of Cornelius Okeayn extra R.c., although John Omurayn (?), priest, of the said diocese, has detained possession for between two and five months without any title, from fear of whose power the said Denis dares not meet him within the city and diocese of Limerick; summoning and removing the said John. To Tancretus Obygill, (fn. 2) Donatus Odochartaydh, and Patrick Ocianan, canons of Derry (Daren., recte Deren.). Mandate, as below. The recent petition of John Micgillabridi, clerk, of the diocese of Raphoe, contained that after he had been dispensed on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, in virtue of which he had himself promoted to minor orders; and after he had got provision made to him by authority of the ordinary of the rectory of the parish church of Cyllmacne(n)ain in the said diocese, of lay patronage, and had had possession of it for some months, in self-defence he wounded with a knife which he was carrying a certain priest of the said diocese who assaulted him, and drew blood, thereby incurring sentence of excommunication, etc., from which, after he had made his peace with the said priest, and had made satisfaction to him for the injury inflicted on him and for damages, he obtained absolution from the ordinary, continued the said possession for a year and more, and, in the absence of the said impediment and of any other lawful impediment, and without having obtained any canonical dispensation therefor, did not have himself promoted to the priesthood. (fn. 3) The said rectory being therefore void by the said non-promotion, although the said John, without acquiring any new title, or obtaining canonical dispensation, has wrongfully detained it for between one and two years after the lapse of the said year, thereby incurring disability; and the said petition adding that if a canonry were erected in the church of Raphoe and the said rectory into a simplex prebend thereof for the lifetime of the said John, divine worship would be increased in the said church of Raphoe, the pope hereby orders the above three to absolve him,ad cautelam, from the said sentence of excommunication, etc., enjoining a salutary penance, etc., dispense him on account of irregularity, and rehabilitate him, and in that event to summon the chapter of Raphoe, and erect in that church a canonry, and erect the said rectory, with consent of the patrons, into a simplex prebend for the lifetime of the said John, and collate and assign them, thus erected, yearly value not exceeding 9 marks sterling, to the said John, but before they proceed to execute these presents, he is to give up to them the said rectory. To the abbot of Balmurenoch in the diocese of St. Andrews, and the treasurers of Aberdeen and Brechin. Mandate to collate and assign to Hugh Douglas, priest, of the diocese of Brechin, M.A., who alleges that he is of noble birth, even of a race of earls, the parish church of Conwicht in the diocese of St. Andrews, yearly value not exceeding 30l. sterling, void because William Achlek, after obtaining canonical collation thereof, held peaceful possession for more than a year without having himself promoted priest, and without any canonical dispensation, and so long void that by the Lateran statutes its collation has lapsed to the apostolic see, although the said William has, without having acquired any new title, and without any right, detained possession of the said church for between six and seven years after the said voidance and lapse, taking the fruits; the said William being summoned and removed. To Donatus Odochartaydhet [sic], (fn. 4) and William Okeruallan, and Patrick Okianan, canons of Derry (Daren. recte Deren.). Mandate, as below. The pope has been informed by Felim Odonayll, clerk, of the diocese of Raphoe, that Thady Othomgh’, rector of the parish church de Eahinis in the said diocese, of lay patronage, is a notorious fornicator, is irregular, and is a perjurer, and is defamed as such in those parts. The pope, therefore, hereby orders the above three, if the said Felim [sic] (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents related in the third and fourth degrees of affinity, to be made a clerk, after which he had himself made a clerk, and who alleges that in the city and diocese of Raphoe there are no ecclesiastical persons, outside the church of Raphoe, to whom such a cause can lawfully be committed), will accuse the said Thady before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to erect a canonry in the said church of Raphoe and, provided that the patrons consent, erect the said rectory into a simplex prebend for the lifetime of the said Felim, and to collate and assign them, thus created, (fn. 5) yearly value not exceeding 5 marks sterling, to the said Felim, inducting him, and removing [the said Thady and] any other unlawful detainer, etc. The pope further specially dispenses him to be promoted to all, even holy orders, and receive and retain the said erected (fn. 6) canonry and prebend, notwithstanding the said defect, etc. Vite etc. [5¼ pp.] |

To the abbot of SS. Peter and Paul's, Armagh, and Patrick Ohaegha and Donald Mackasyg, canons of Armagh. Mandate to collate and assign to Eugene Makayl, clerk, of the diocese of Clogher (Chocoren. [sic]) (who is in his twenty-fourth year, and was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents, to be made a clerk, after which he had himself made a clerk, and who alleges that there are no [ecclesiastical] persons in the city or diocese of Clogher to whom this matter (hoc) can be committed) the deanery of Clogher (Clochoren.), a major dignity with cure, yearly value not exceeding 12 marks sterling, void because Bernard Macunchinan (who is to be summoned and removed) after obtaining collation by papal authority, held the said deanery for more than a year without having himself ordained priest, without dispensation and after being lawfully monished, although, without acquiring any new title, he has detained possession for some years after the said voidance. The pope further dispenses the said Eugene to be promoted to all, even holy orders, and to receive and retain the said deanery, notwithstanding the said defects of age and birth, etc. Vite etc. [3 pp.] |
