To the abbot of St. Mary's, Monasteranenagh (de Magyo), and the prior of St. Mary's, Rathguella, in the diocese of Limerick, and John Maclannacayd, canon of Limerick. Mandate, as below. The pope has been informed by Thomas Geraldi de Geraldinis, canon of Limerick, that William Oflinagayn, perpetual vicar of Baileroibeid, in the diocese of Limerick, openly keeps a concubine, and committed simony in order to get collation of the said vicarage; and has also learned that the perpetual vicarage of Senguallayin in the said diocese has been so long void that its collation has lapsed to the apostolic see, although John Purcel, priest, of the said diocese, has without canonical title detained it for between four and six years. At the recent petition of the said Thomas (containing that the fruits etc. of his canonry and prebend of Ardchanne in Limerick, value 5 marks sterling, are insufficient for his maintenance, and praying for the union thereto for his lifetime of the said vicarage of Senguallayn, value 8 marks sterling) the pope hereby orders the above three, if Thomas will accuse the said William before them, to summon William, etc., and if they find the foregoing to be true, to declare the said collation null and void [and remove William]; and in that event to summon the said John, etc., and if they find the foregoing to be true, and the said vicarage of Senguallayn to be void, to collate and assign the said vicarage of Baileyorehid (sic), value 4 marks sterling, to Thomas, and also to unite the said vicarage of Senguallayn, even if void by the deaths of Cornelius Ygiy or William Ygyllahnayn, to the said canonry and prebend for the lifetime of Thomas, who is hereby specially dispensed to hold for life with the said vicarage of Bayleroybehyd any one other benefice, or without them any two other benefices, with cure or otherwise incompatible, and to resign or exchange them, etc. Ad ea ex paterne caritatis officio. To the bishops of Aleria and Orkney, and the dean of Glasgow. Mandate, as below. The pope lately, on the voidance of the preceptory of the house of St. Anthony near Leith, O.S.A., in the diocese of St. Andrews, by the death of John without the Roman court, ordered the above three to cause Alexander Haliday, priest, of the said diocese, to be received as a canon of the monastery of St. Anthony, in the diocese of Vienne, cause the habit to be given to him, and receive his profession; and also ordered, by other letters, collation and provision to be made to him of the said preceptory. His recent petition contained that a cause arose between him and the late John Logan, clerk, who claimed the preceptory and prevented the provision to Alexander from taking effect; that the pope at Alexander's instance committed it, although not lawfully devolved to the apostolic see, to the late Bartholomew de Bellincinis, a papal chaplain and auditor; that Logan's appeal from Bartholomew's definitive sentence was committed by the pope at Logan's instance to the late Nicholas Edam, and then to Master John Prioris, both of them papal chaplains and auditors, the latter of whom revoked Bartholomew's sentence by an unjust sentence from which Alexander appealed to the apostolic see; that the pope at Alexander's instance committed this last appeal to Master Anthony de Grassis, a papal chaplain and auditor, and then to John, bishop of Nocera, holding the place of an auditor, who by a definitive sentence confirmed that of Bartholomew and revoked that of the said John Prioris; that Logan's appeal therefrom to the said see was not prosecuted within the lawful time, wherefore the said bishop decreed letters of execution; that Logan refused to obey the said letters of execution, and appealed therefrom to the said see; and that the pope committed his appeal to Master Gaspar de Teramo, a papal chaplain and auditor, etc. Seeing that whilst the cause was pending, Logan has died at the said see, the pope (who lately granted to Alexander by letters in the form of a brief (fn. 1) that he need not wear the said habit and make his profession until he had obtained possession of the said preceptory), hereby calls the said cause up to himself, and extinguishes the suit, and orders the above three to collate and assign the said preceptory, which is by some called a chapel and hospital, (fn. 2) and depends on the said monastery of [St. Anthony's, Vienne], has cure and is said by some to be of the patronage of certain barons, and whose value does not exceed 35l. sterling, whether it be void as above, or by the deaths of Alexander Stewart or Michael Gray, or in any other way, to the said Alexander, whom the pope again dispenses not to wear etc., as above. To John Odunna, a canon of Annaghdown. Grant etc., as below. The pope lately ordered provision to be made to him of the [perpetual vicarage of the] parish church of St. James, Balenclar, in the diocese of Annaghdown, void so long that was no certain knowledge of the mode of its last voidance, and that its collation had lapsed to the apostolic see. His recent petition contained that before the date of the said letters (in virtue of which he obtained possession of the said vicarage) the pope had by other letters ordered provision to be made to him of a benefice, even if a dignity etc., in the gift of the archbishop and chapter etc. of Tuam; and added that at the date of the said prior letters two possessors of the vicarage were litigating about it in those parts, and that he was a canon of Annaghdown, but had not a prebend, as he now has, of which facts no mention was made, wherefore he doubts whether the said prior letters are without force and are surreptitious. The pope, therefore, hereby grants that the said prior letters and their consequences shall hold good from the date of these presents, notwithstanding the said omissions, and notwithstanding a statute made by the present archbishop of Tuam forbidding, under pain of excommunication, any clerk of his diocese to go to the Roman court without his licence, under pretext of which, although he had asked for such licence, the said archbishop has excommunicated him, the pope hereby annulling the said statute, and declaring that John is not under the said sentence; notwithstanding also his acceptance in virtue of the said grant, which acceptance he has not prosecuted, of the prebend of Kylueyn in Tuam, of which he has not had possession. (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all holy and priest's orders and hold a benefice even with cure, and who has been so promoted) the perpetual vicarage of Inysdagraim in the said diocese, value 4 marks sterling, void so long that there is no knowledge of the mode of its voidance, and that its collation has lapsed to the apostolic see, although the present abbot of St. Mary's, Inysgad, O.S.A., in the said diocese, has unlawfully detained it for several years under a union, which is null, made by the then bishop of Killaloe to the said monastery; summoning and removing the said abbot, whom Cornelius cannot safely meet in the city and diocese of Killaloe. Mandate to collate and assign to Matthew Ocallanan, clerk, of the diocese of Elphin, who notwithstanding his illegitimacy, as the son of a priest and an unmarried woman, has been made a clerk, the perpetual vicarage of Kyllemicallan in the said diocese, value 10 marks sterling, so long void by the death of Cornelius Macybreynn (fn. 4) without the Roman court that its collation has lapsed to the apostolic see; although Cornelius Macm[u?]rcyrin, priest, of the said diocese, who is to be summoned and removed, has without any title detained it for between six and seven years. To the archdeacon of Clonfert, and Magonius and Donald Omollaly, (fn. 5) canons of the same. Mandate, as below. The recent petition of Cornelius Idonolayn, a canon of St. Mary's, Clontuasgertaomany, O.S.A., in the diocese of Clonfert, contained that the chapel of the parish church of Kyllorayn in the said diocese, which belongs to the said monastery, has been wont to be governed by its canons, and that a canon thereof has been appointed at the pleasure of the prior, but that the canons or chaplains hitherto appointed have been negligent in regard to the rule and restoration of the said chapel, as is also the present chaplain. At the petition of the said Cornelius, who is a priest, and who alleges that he has been received as a canon of the said monastery by the prior and some of the canons, and that he has made his profession, the pope hereby orders the above three to summon the present chaplain, and if they find that he has been negligent, as above, to remove him, and to collate and assign the said chaplaincy, with cure and value 8 marks sterling, to Cornelius. To John Macgyllanacht, Odo Oytiarnad, and Dermit (Dermisio) Offlagartha, canons of Annaghdown. Mandate, as below. The recent petition of Walter Blach, priest, of the diocese of Annaghdown, contained that in virtue of letters expectative of the present pope, by which provision was ordered to be made to him of one or two benefices, even if one had cure etc., in the gift of the archbishop etc. of Tuam and the chapters etc. of Tuam and Annaghdown (which latter is united to Tuam, but has a separate chapter), he accepted and had provision made to him of the perpetual vicarage of Galwei in the said diocese, then void (although Richard de Burgo, archdeacon of Annaghdown, was detaining possession of it, without any canonical right), and obtained possession, but was disturbed in his possession by the said Richard; that he also, in virtue of the same letters, accepted and had provision made to him of the perpetual vicarage of Balliondara (?) (fn. 6) in the said diocese, and obtained possession, and that he has held both vicarages unlawfully for some time. The said vicarage of Galwei being therefore void by his obtaining that of Wallenclare (sic), which he afterwards resigned, and it being alleged that the said Richard has also no right to the said vicarage of Galwei, which he is detaining in virtue of papal letters, but without canonical title, the pope hereby orders the above three, if they find that neither Walter nor Richard has any right in or to the said vicarage of Galwei, to collate and assign it, value 8 marks sterling, to Walter, removing the said Richard. Before they proceed to execution Walter is to resign Galwey, and, as soon as he obtains it, the pope's said former letters are to be void. Apostolica sedes. (In the margin: Decembris.) Ordinance, etc. as below. The pope lately ordered the feast of the Visitation of St. Mary the Virgin to St. Elizabeth, and its octave, to be everywhere celebrated annually on 6 Non. Julii (2 July), and the newly instituted office to be recited, and granted certain indulgences. It has been recently set forth to him by Elizabeth, queen of England, that within the octaves of the said feast there are other very solemn feasts in England, which are very devoutly kept by both clergy and people, so that the said office cannot be sung on those feasts. At the petition, therefore, of the said queen, containing that she has a singular devotion for the feast of the Visitation, the pope, in order that she and the faithful of those parts may not be deprived of the said indulgences on the said feasts, hereby ordains that all the faithful of the realm who, in addition to the recital of the office usually recited on the said feasts within the said octave, recite also in choir or privately the office of the octaves of the feast of the Visitation, or are present at the recital thereof, shall, being penitent and having confessed, gain the same indulgences as they would gain if they recited the office of the said octaves as the principal office of the day, (fn. 7) or were present thereat. Moreover, seeing that, as the pope has learned, there is observed in divers parts of the world a certain new way of praying, newly and not without great devotion invented, called the Psalter of the Blessed Virgin Mary, (fn. 8) to wit, that any one wishing to pray in this way daily says, to the honour of the same Blessed Virgin Mary and against the threatening perils of the world, as many times the Angelical Salutation ‘Ave Maria’ as there are psalms in the Psalter of David, (fn. 9) namely, a hundred and fifty times, saying the Lord's Prayer once every ten salutations, (fn. 10) the pope, approving the said way of praying, hereby grants to all the faithful of the realm, present and future, each time they pray in the said way, for each fifty [psalms] of the Psalter a relaxation of five years and five quarantines of enjoined penance. Furthermore, seeing that both in those parts and throughout almost the whole of Christendom the bells are wont to be rung for the Salutation of the Virgin Mary at dawn and noon and sunset, in order to stir up the devotion of the faithful to salute Her, and seeing that the queen desires the devotion of the faithful of the realm for the said Salutation to be increased more and more, the pope grants by these presents (which shall hold good in perpetuity as far as regards all the aforesaid) to all of the said faithful who, being penitent and having confessed, when the bells are rung at dawn or noon or eventide (fn. 11) for the said Salutation, kneel and devoutly say, at least once, the Angelical Salutation, a hundred days of indulgence for each time they do so. Moreover, inasmuch as it would be difficult for these presents to be borne to all places in which there would be need of them, the pope hereby decrees that a notarial copy, bearing the seal of an ecclesiastical court or of a bishop or other prelate or ecclesiastical dignitary, shall receive the same credence as if the present original letters were exhibited. To John Odiuina (recte Odunna), a canon of Annaghdown. Mandate, as below. The pope has learned that the archdeaconry of Clonfert is void by the death of Donatus Ohanim without the Roman court; and the recent petition of John Okelay, clerk, of the diocese of Clonfert, contained that he was formerly present in arms at divers conflicts in which a number of men were killed, but without killing or wounding anybody himself, and that he has held the perpetual vicarage of Killenacosue in the said diocese for between one and two years without being promoted to holy orders, and without dispensation, taking the fruits to a sum of 3 marks sterling, thereby contracting disability. The pope, therefore, hereby orders the above canon to absolve John, who is by both parents of noble birth, and has resigned the said vicarage, from excommunication, enjoining penance, dispense him on account of irregularity, and dispense him to be promoted to all holy, even priest's orders, etc., and hold any compatible benefices and resign or exchange them, rehabilitate him, and thereupon to collate and assign to him the said archdeaconry a non-major non-elective dignity with cure, value 16 marks sterling.
