To the abbot of St. Peter's, Westminster, in the diocese of London, and Henry Sharp', canon of London. Mandate, as below. The recent petition of Alice Burgoyn, of the diocese of London, relict of the late Thomas Burgoyn, layman, contained that (at the instance of John Burgoyn, layman, of the said diocese, son and, together with the said Alice, coexecutor of the will of the said Thomas, who falsely alleged that she was wrongfully detaining possession of certain charters, letters (fn. 2) and documents, and other goods which were to be converted by the said Thomas at the time of his death to pious uses, wherefore the execution of the said will was being retarded, and the pious intention of the testator defrauded), Thomas Wynterbo[r]n, clerk, vicar in spirituals, called the auditor-general, of the archbishop of Canterbury, primate of all England and legatus natus of the apostolic see, (fn. 3) ordered under pain of excommunication the said Alice to assign the said charters, writings, (fn. 4) documents and goods to the said John, and, inasmuch as she did not obey, which she was not bound to do, caused her to be publicly proclaimed excommunicate, wherefore, as soon as she learned thereof, she appealed to the said see, and afterwards caused petition to be made to the pope to commit the appeal to judges in England, and to order her to be conditionally (ad cautelam) absolved from the said sentence of excommunication. The pope, therefore, orders the above two to summon the said John and others concerned, grant Alice conditional absolution, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To John, bishop of Ardfert, William, bishop of Sidon, and Thomas, bishop of Annaghdown (Enachdunen.), [all] residing (fn. 5) in the city of London. Mandate, as below. The recent petition of Joan Keneyk, (fn. 6) mulier, of the diocese of Coventry and Lichfield, contained that William Hely, layman, of London, falsely alleging that he had contracted marriage with her per verba legitime de presenti, brought her, with the object of having her adjudged to him as his wife, before the official of London, who, wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said William and against the said Joan, from which she appealed to the apostolic see, afterwards petitioning the pope to order her to be conditionally (ad cautelam) absolved from any sentence of excommunication pronounced against her by the said official after the said appeal, and moreover to commit the appeal and nullity causes etc. to judges in England. The pope, therefore, orders the above three to summon the said William and others concerned, grant Joan conditional absolution, hear both sides, and decided what is canonical, without appeal, causing their decision to be observed by ecclesiastical censure. To the treasurer of Ardfert, and Thady (Thatheo) Ody and Thady (Tatheo) Ohynrayn, canons of the same. Mandate, as below. The recent petition of Maurice Ossouwllyuayn, priest, of the diocese of Ardfert, contained that on the voidance of the canonically united perpetual vicarages of the parish churches de Cwlly alla et deu nochuayl (? recte de nuochuayl) alla, in the said diocese, by reason that Donald Ocornuyn, after having obtained them by canonical collation, held them for more than a year without having himself ordained priest and without dispensation, John, bishop of Ardfert made by his ordinary authority collation and provision of them, thus void, and at that time so long void that by the Lateran Statutes their collation had lapsed to the apostolic see, to the said Maurice, who under pretext thereof obtained possession and wrongfully detained possession for a year, also without having himself ordained priest, and without dispensation, and has wrongfully detained possession for another year and more, but for less than two years after the lapse of the said year. The said collation and provision being therefore null and void, and the said vicarages being still void as above, the pope hereby orders the above three to collate and assign to the said Maurice, who alleges that he resigned them to the said bishop nine months ago, the said vicarages, value not exceeding 12 marks sterling. To the abbot of the monastery of Bewley and the prior of the priory of St. Leonard, Stanley, in the dioceses of Winchester and Worcester, and John Stratton', canon of Salisbury. Mandate, as below. The recent petition of William Gyan', rector of the free chapel of Tokyngton’ in the diocese of Worcester, contained that the present abbot and the convent of the monastery of St. Augustine by Bristol, O.S.A., in the said diocese, falsely alleging that certain tithes arising from certain fruits growing within the bounds of the parish of the parish church of Almendesbury (recte Almondesbury) in the said diocese, and belonging by a just title to the rector of the said chapel, belonged to the said monastery, and that the said rector was wrongfully taking them, brought him before Thomas Wynterbourne, auditor-general of causes of the court of Thomas, archbishop of Canterbury, primate of all England and legatus natus of the apostolic see, under pretext of the said legation, and that the said auditor, wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said abbot and convent and against the said rector, who appealed to the said see, but has been prevented by a lawful impediment from prosecuting the appeal within [the lawful] time. The pope therefore hereby orders the above three to summon the said abbot and convent and others concerned, proceed in the appeal cause, and confirm or quash (fn. 7) the said sentence, without appeal. To the abbot of the monastery of St. Mary, Reynsham (recte Keynsham), (fn. 8) in the diocese of Bath, the archdeacon of Bath, and the chancellor of Wells. Mandate, as below. The recent petition of Robert Wyllyadam, John Walter[i], Robert Durban, (fn. 9) and other parishioners of the parish church of St. Peter, Peturston, in the diocese of Llandaff, contained that although they are not in any way bound to contribute to the repairs of the nave of the parish church of Rumpney in the said diocese, and of its cemetery and closes, and the gardens thereof, (fn. 10) nevertheless John Watte and William Adamwyly (fn. 11) and other parishioners of the said church of Rumpney, falsely alleging that the parishioners of the said church of Peturston were so bound, (fn. 12) brought Thomas Crede, Walter Coly and Nicholas Adam, the then masters of the fabric of the said church of Petruston [sic], with the object of having them declared to be so bound, (fn. 13) before William Lynwode, official of the court of the late Henry, then archbishop of Canterbury and primate of all England and legatus natus of the apostolic see; that although the said official promulgated a definitive sentence in favour of the said Thomas Crede, Walter Coly and Nicholas Adam, and other parishioners of Petruston [sic], nevertheless the said parishioners of Rumpney, falsely alleging that it was unjust, appealed from it to the said see, and obtained papal letters to the abbot of the monastery of St. Mary's, Neth', in the said diocese, under pretext of which they caused the said Thomas Crede, Walter Coly, Nicholas Adam, and other parishioners of Petruston [sic] to be brought before the present abbot of the said monastery, who, wrongfully proceeding in the appeal cause, promulgated an unjust definitive sentence, by which he revoked the sentence of the said official and condemned the said Thomas Crede, Walter Coly, Nicholas Adam, and other parishioners of Petruston [sic] to contribute as above, whenever required, from which latter sentence the said Thomas Crede, Walter Coly, Nicholas Adam and other parishioners of Petruston [sic] have appealed to the said see, whilst the said John Watte, William Adamwylly and other parishioners of Rumpney have obtained in the matter of the said last appeal other papal letters to the bishop of Llandaff, and under pretext thereof have caused the said Robert Wyllyadam, John Walteri, Robert Durban and other parishioners of Petruston [sic] to be summoned in the cause of the said last appeal, wherefore the said Robert Wyllyadam, John Walteri, Robert Durban and other parishioners of Petruston [sic], on account of certain alleged grievances (expressed) inflicted on them by the said bishop, have appealed to the said see, and petitioned for the commission of the said appeal and of the principal matter to judges in England. The pope, therefore, hereby orders the above three to summon the said John Watte and William Adamwylly and the other parishioners of Rumpney, and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To Matthew Ofaelve, treasurer of Ardfert, Dermit Ossullewayn, canon of the same, and the official of the same. Mandate, as below. The pope has been informed by Thady (Tatheus) Osethecayn (? recte Ofethecayn), perpetual vicar of the parish church of Kyllcowayn (? recte Kylleowayn) in the diocese of Ardfert, that Egneach Odwynnyn, perpetual vicar of the parish church of Kylluauaegan in the said diocese, has committed simony, is an open fornicator, has offspring living, and has dilapidated and alienated the goods of the said vicarage of Kylluauaegan. The pope, therefore, hereby orders the above three, if the said Thady will accuse the said Egneach before them, to summon Egneach and others concerned, and if they find the foregoing to be true, to deprive and remove Egneach, and in that event to collate and assign the said vicarage of Kylluauaegan, value not exceeding 6 marks sterling, to the said Thady, whom the pope hereby further dispenses to receive and retain it together with the said vicarage of Kyllcowayn, value not exceeding 3 marks sterling, for five years, during which time he is to resign whichever of the said two vicarages he pleases for another benefice incompatible with the one retained, provided that it be not a parish church or its perpetual vicarage. To the abbot of the monastery of Saudul and the prior of the priory of Ardk[a]than, in the diocese of Argyll (Ergadien.), and the treasurer of Argyll. Mandate, as below. The pope has been informed by Malco[l]m [son] of Solomon Davidis, dean of Argyll, that Robert F[o]wlar, rector of the parish church of St. Columba in Moruarne, in the diocese of Argyll, is an open fornicator, has committed simony, has dilapidated the immoveable goods of the said rectory, does not reside in person, and is much defamed in those parts of several other crimes and excesses, to the shame of the clerical order. The pope, therefore, hereby orders the above three, if the said Malco[l]m (who was lately dispensed by papal authority, on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and who has been made a clerk) will accuse the said Robert before them, to summon Robert and others concerned, and if they find the foregoing to be true, to deprive and remove Robert, and in that event to collate and assign the said rectory, of lay patronage, with cure, and value not exceeding 9l. sterling, to Malco[l]m; notwithstanding that he holds the deanery of Argyll, a major elective dignity with cure, value not exceeding 8l. sterling. The pope hereby dispenses him to retain with the said rectory, if it be collated to him by virtue of these presents, the said deanery, or, without the latter, to receive any one other benefice, or, if he resign both, any two other benefices, with cure or otherwise incompatible with one another, even if they be parish churches or their perpetual vicarages, or major or principal dignities (not elective nor with cure) in cathedral or collegiate churches, and to retain them for three years only if they be parish churches or their perpetual vicarages, and for life if they be other incompatible benefices, and to resign them, simply or for exchange, as often as he pleases, etc. (fn. 14) Within the said three years he is to resign whichever he prefers of such parish churches or vicarages for another benefice incompatible with the one retained, provided that it be not a parish church or its perpetual vicarage. The pope has been informed by Donatus Okcleachayr, priest, of the diocese of Ardfert, that Thady (Thateus) Ocuyll, perpetual vicar of the parish church of Maghoflathymh in the said diocese, has committed simony, dilapidated and alienated the immoveable goods of the said vicarage, and been an open fornicator. (fn. 15) The pope, therefore, hereby orders the above three, if the said Donatus will accuse the said Thady before them, to summon Thady and others concerned, and if they find the foregoing to be true, to deprive and remove Thady, and in that event to collate and assign the said vicarage, with cure and value not exceeding 12 marks sterling, to Donatus.
