3 Paul II.

De Beneficiis Vacantibus.

1467.
6 Id. April.
(8 April.)
St. Mark's, Rome.
(f. 234d.)
To the archdeacon and Dermit Odonnagayn and Donald Ouchaynte, canons, of the church of Ross. Mandate (the pope having been informed by Thady Osyagayle, clerk, of the diocese of Ross, that John Omaethagayn, perpetual vicar of the parish church of Kylleoygthy, an open fornicator and simoniac, has alienated and turned to evil uses the goods of the said vicarage; and the pope having learned that the rectory of the parish church of Tolach in the said diocese, of lay patronage and with cure, is void because Thomas Hohedersceoyl, having obtained it by canonical collation, held possession of it for more than a year without having himself ordained priest, and without dispensation, although Maurice Obrayn, after the end of the said year, and after the collation had lawfully lapsed to the apostolic see, has unduly detained possession for about two years, under pretext of a presentation by the patron and a collation by the ordinary), if the said Thady will accuse the said John before them, to summon John and others concerned, and if they find the foregoing to be true, to deprive and remove him, and, moreover, if, after summoning the said Maurice they find the said rectory of Tolach to be void as above, to collate and assign both the said vicarage of Kylleoy[g]thy and the said rectory, value not exceeding 5 and 8 marks sterling respectively, to Thady. The pope hereby specially dispenses him to receive and retain them for three years, and to resign them, simply or for exchange, and receive instead two other benefices, and, if they be parish churches or their perpetual vicarages, to retain them for three years, notwithstanding the pope's late ordinance to the contrary, etc. Vite etc. (F. and A. de Montia. | F. xx. Expedita Pridie Kal. Maii Anno Tertio. Saxenat.) [31/5 pp.]
1466.
12 Kal. Nov.
(21 Oct.)
St. Mark's, Rome.
(f. 250d.)
To the bishop of Orte, the abbot of the monastery of St. Mary's, Baltinglass (de Valle Salutis), in the diocese of Leighlin, and the archdeacon of Ossory. Mandate to collate and assign to James Occurryn, clerk, of the diocese of Leighlin (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of a priest and an unmarried woman, to be made a clerk and hold a benefice without cure, after which he was made a clerk), the perpetual vicarge of the parish church of Ymisil in the said diocese, void by the death of John Occu[r]ryn, and also the archdeaconry of Leighlin, a non-major non-elective dignity with cure, void by the death of Dermit Occurryn, value not exceeding 4 and 5 marks sterling respectively. The pope hereby specially dispenses him to be promoted to all, even holy orders and receive and retain them for life, and to resign them, and any other benefices which he may hold, simply or for exchange, as often as he pleases, and receive and retain instead two other benefices, even incompatible with the others, provided that they be not canonries and prebends, or major or principal dignities, or two parish churches or their perpetual vicarages, or such mixed; notwithstanding the said defect, etc. Vite etc. (P. and N. de Castello. | P. l. Sexto Id. Novembris Anno Tertio.de Varris.) [41/5 pp. On f. 250r. are the first eleven lines of the same bull, cancelled.]
