To William de Elfynston, Thomas Penuen and Gilbert de Rerik, canons of Glasgow. Mandate, as below. The recent petition of Thomas Charmichale, perpetual vicar of the parish church of Striueling in the diocese of St. Andrews, contained that a cause arose before Thomas Luthirdale, official of St. Andrews, between Henry de Mureffe, then perpetual vicar of the said church, and the abbot and convent of St. Mary's, Cambuskynnech, O.S.A., in the said diocese, about certain tithes of salmon, which both parties claimed, the said official, wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said abbot and convent and against the said Henry, from which the latter appealed to the apostolic see; that afterwards, when provision had been canonically made to the above Thomas Carmichale of the said vicarage, on its voidance by the resignation of the said Henry, and he had obtained possession, and when the said sentence had come to his knowledge, he appealed therefrom to the said see. The pope therefore orders the above three to summon the said abbot and convent and others concerned, conditionally absolve the said Thomas from any sentences of excommunication incurred, hear both sides, and decide what is just, without appeal, taking cognizance also of the said principal matter, and causing their decision to be observed by ecclesiastical censure. To Master John Franciscus de Pavinis, a papal chaplain and auditor. Mandate, as below. The recent petition of Thomas Pasleewe, priest, of the diocese of Norwich, contained that on the voidance of the parish church of Nether Walloppe in the diocese of Winchester by the resignation of William Fenton, made to William bishop of Winchester, and admitted by that bishop by his ordinary authority, Hugh Pakenh[a]m, layman, of the said diocese, alleging that he had faculty for the purpose by public instrument from the then treasurer of York, to whom the presentation by ancient custom belongs, presented the said Thomas to the said bishop William; that Richard Andrewe, dean, and the chapter of York, untruly alleging that the said church had been canonically granted to them by authority of the ordinary for the sustentation of the vicars choral of York, opposed Thomas's being instituted at the said presentation; and that the said bishop William refused to institute him, wherefore he appealed to the apostolic see, and the pope committed the appeal, at Thomas's instance, to the above auditor, who has proceeded, short of a conclusion. The said petition adding that some allege that the said presentation was not canonical, and that the said dean and chapter have no right in or to the said church, the pope hereby orders the above auditor, if he find as the result of the suit that the said presentation was not canonical, and that the said dean and chapter have no such right, to collate and assign the said church, value not exceeding 40 marks sterling, to the said Thomas. To the bishops of Lincoln and Ardfert, and the abbot of St. Albans in the diocese of Lincoln. Mandate, as below. The recent petition of John Cok, rector of the parish church of Lynle in the diocese of Lincoln, contained that although he obtained that church by a collation made to him by authority of the ordinary, and held it for some time, nevertheless Edward Crooke, clerk, falsely alleging that the said church belonged to him, and that the said John hindered him from having peaceable possession, etc., brought him before Thomas Wynterburne, auditor of the court of causes of Thomas, archbishop of Canterbury, who, wrongfully proceeding, promulgated an unjust definitive sentence in favour of Edward and against John, condemning the latter in costs, from which sentence John has appealed to the apostolic see, and petitioned for its commission in England. The pope therefore orders the above three to summon the said Edward and others concerned, and confirm or invalidate the said sentence, without appeal. Humilibus supplicum votis. (Hug. and A. Mandate, at the recent petition of Alice Piers, mulier, of the diocese of Canterbury, contained that formerly Edward Hovynden, layman, of the same diocese, falsely alleging that he had contracted marriage with her per verba legitime de presenti, brought her before Thomas Wynturborne, auditor of causes of the court of Thomas, archbishop of Canterbury, who, unjustly proceeding, promulgated an unjust definitive sentence in favour of Edward and against Alice, from which she has appealed to the apostolic see and petitioned for the commission in England of the hearing of the appeal), to summon the said Edward and others concerned, taking cognizance of the said sentence, and to decide what is canonical, without appeal, causing their decision to be observed by ecclesiastical censure. To the abbot of St. Mary's, Middleton (de Choro benedicti), and the prior of Bridgetown (Ville pontis), in the diocese of Cloyne (Clonen.) and Dermit Okywe, canon of Cloyne. Mandate, as below. The recent petition of John [son] of Maurice de Giraldinis (sic), clerk, of the diocese of Cloyne, contained that on the voidance of a certain perpetual benefice of lay patronage, called the parcel of Dromada in the parish church Ville Martir, in the said diocese, by the deprivation for his faults and demerits of Robert Howed, (fn. 2) made by Jordan bishop of Cork and Cloyne, to whom on account of old age and impotence a coadjutor had been assigned by papal authority, Maurice [son] of Richard de Geraldinis, layman, the patron, presented the said John, whom the said bishop instituted, in virtue of which presentation and institution he obtained possession, and has held it for about four years, of which presentation and institution he now doubts the validity, because the said coadjutor's consent was not given, and for other reasons. The pope therefore orders the above three to summon the said Robert and others concerned, and to collate and assign the said benefice, without cure and value not exceeding 5 gold florins of the Camera, to the said John, who is by both parents of noble birth. To the abbot of Newbottyle in the diocese of St. Andrews. and the chancellor and Thomas Bulle, canon, of Glasgow, Mandate, at the recent petition of John Rokburn the younger, knight, of the diocese of St. Andrews (containing that formerly Thomas Brayn de Baldoui, layman, of the said diocese, falsely alleging that the said knight owed him certain sums of money and divers animals etc., brought him before the official of St. Andrews, to whom belongs by ancient custom the cognizance of civil causes between lay persons of the said diocese, and who, unjustly proceeding, promulgated an unjust definitive sentence in favour of the said Thomas and against the said knight, from which the latter has appealed to the apostolic see), to summon the said Thomas and others concerned, proceed in the appeal cause, and confirm or quash the said sentence, without appeal. Wenzel's numerical note is wanting, and there is no contemporary end-paper with the contemporary description. The latter occurs, however, as usual, on the bottom edge of the volume, viz.: Primus de Exhibitis anno tercio domini nostri domini Pauli pape ii. There are ff. i—cccii. of text (some of them blank) + ff. ccciii.—cccv. blank. On the back of the last leaf, f. cccv., is the contemporary note: Jo. Belloc.quesitus et non repertus.
