To Gavin (Gauuino) de Hantmulton (recte Hammulton), provost of the church of Bothuel in the diocese of Glasgow. Dispensation to him who, as he alleges, is by both parents of a race of barons and in the order of subdeacon only, and holds the said provostship, which is a principal dignity with cure, value not exceeding 45l. (fn. 3) sterling, and a canonry of Dunkeld and the prebend of Fern (fn. 4) therein, value not exceeding 14l. sterling, not to be bound for seven years, whilst studying letters in an university, to have himself promoted to any other holy orders by reason of the said provostship or any other benefice with cure or otherwise requiring holy orders. To the bishop of Saintes (Xanctonen.). Mandate, at the recent petition of all the inhabitants of the place of Capuen within the bounds of the parish of St. Peter de Marennes (de Marempnia) in the diocese of Saintes (containing that the said parish is so large that the inhabitants of the said place, which is about a league from the said church, both on account of the distance of the said place, which touches upon the sea, and also because the English, the mortal enemies of the said inhabitants, attack (occurrunt) the said place, and also on account of the perils of the ways, cannot conveniently go to the said church for hearing divine offices and receiving the sacraments, etc.) to summon the present rector of the said church and others concerned, and if he find the foregoing to be true, to grant that the said inhabitants may have in the chapel of the said place a font, have a cemetery near it, and hear masses and other divine offices in the said chapel, etc. Romani pontificis. To the bishop of Killala (Aladen.), the prior of Crosmalina in the diocese of Killala, and the dean of Killala, Mandate as below. The complaint of Morianus Macsorgail (? recte Macfergail) a canon of the diocese (sic) of Killala. contained that for a few years past a number of nobles and non-nobles of those parts have in the city and diocese of Killala, contrary to the customs of the nation of Ireland, sacrilegeously despoiled, openly and furtively, by theft and by force, churches and ecclesiastical persons, both secular and regular, of their goods, namely cows, sheep and other animals, and even of their very (propriis) garments, wickedly compelled them by hard blows (diris verberibus) to give them food (cibaria), persecute them with divers injuries, and even slay them, as has at the present time been perpetrated in the person of their bishop, (fn. 5) and at times compel them to celebrate masses and other divine offices in the presence of the excommunicate. At the petition of the said Morianus to the pope to provide a remedy for him, who has by the sons of iniquity been despoiled of all his cows and his other goods, in order that greater losses may not befall him, especially as he is not a native of the said city and diocese, and is without temporal favours therein, the pope hereby orders the above three to monish all those who have despoiled, or shall despoil Morianus of his goods, to restore them within a certain term and make satisfaction to him, and if they do not, to issue a general sentence of excommunication against them, and cause it to be published, from which absolution cannot be given, save in the hour of death or after the making of satisfaction, except by the archbishop of Tuam, whom the pope hereby orders to defend Morianus against the said invaders. To the abbot of Holywood (Sacri memoris) in the diocese of Glasgow and the official of Glasgow. Mandate, at the recent petition of John Kendale, rector of the chapel of St. Mary de la Grace in the diocese of Glasgow, (containing that whereas a controversy arose between him and John Man (or May), then perpetual vicar of the parish church of Monkton in the said diocese about the right of oblations of the said chapel, at length the late William bishop of Glasgow and the dean and chapter of Glasgow, with consent of the said parties, made a certain concord. as is contained more fully in certain letters of the said bishop sealed with his seal) to summon the present vicar of the said church and others concerned, and if they find the foregoing to be true etc., to approve and confirm the said concord and its consequences etc. Iis per que. To Roger Baldelbyn (recte Baldewyn), rector of the parish church of Werhorn in the diocese of Canterbury. Dispensation to receive and retain together with the said church, value not exceeding 20 marks sterling, any one other benefice, or without that church any two other benefices, with cure or otherwise incompatible, even if dignities etc., even major or principal dignities, or two parish churches or their perpetual vicarages, or such mixed, etc., namely for seven years if two parish churches or their perpetual vicarages, or for life if other incompatible benefices, and to resign them, simply or for exchange, as often as he pleases.   • 1. On the back of the volume is the usual modern description in Italian: ‘Pio ii. 1462. Anno 4. Lib. 2,’ and on a modern flyleaf is Mgr. Wenzel's ‘An. 4. to. ix.’ There is no contemporary flyleaf, but the usual contemporary description of the volume occurs on its bottom edge, viz.: ‘Secundus de diversis formis anno iiii. domini nostri domini Pii pape ii.’ The text extends from f. [v.] to f. cccviii. The first 4 ff. have gone entirely, and the following 12 are injured by damp, the outer edges having more or less gone, and with them the foliation corners. The heading ‘de diversis formis’ occurs on f. 25.
  • 2. On f. [v]r. is a dispensation dated apud Hearmu(m)? Fontis in the diocese of Chiusi, 1462, 3 Kal. Aug. anno 4, to Richard Neel, clerk, of the diocese of Bayeux, by both parents of noble birth, in about his twentyfirst year and a student in the faculty of arts in the university of Caen.
  • 3. ‘quinquaginta’ of the text is cancelled and over-written ‘O[ctavianu]s,’ and in the margin is substituted ‘quatraginta’ (sic), subscribed O. [Pontanus].
  • 4. ‘de Fern’ is substituted in the margin for a cancellation of the text, and is subscribed: Cassatum et correctum de mandato domini R(oderici) Valentin., vicecancellari, P. de Varris.
  • 5. ac eciam prout modernis temporibus in personam sorum episcopi perpetratum est inhumaniter occidere non verentur….
  • 6. The usual subscriptions in the margin and at the end are wanting.
