To the bishop of Dunkeld. Mandate as below. The recent petition of George de Murray, a canon of the Augustinian monastery of Inchaffray (Insule Missarum) in the diocese of Dunblane, contained that on the voidance of the said monastery by the death of abbot John, the prior and convent unanimously elected as abbot the said George, then a monk (sic) of the said monastery, in priest's orders, a bachelor in theology and of noble birth by both parents; that he consented to the election and obtained its confirmation by authority of the ordinary by the administration of blessing, and in virtue of the said election and confirmationobtained possession of the rule and administration. The said petition adding that he doubts whether the election and confirmation or administration of blessing hold good, the pope hereby orders the above bishop, if he find George fit, to approve and confirm the said election and confirmation if found canonical, and moreover, pro tutiori cautela, to make provision to him of the said monastery, whose fruits etc. are taxed in the papal Camera at 100 gold florins of the Camera, and according to the common assessment do not exceed a yearly value of 39l. sterling. Before George receives the rule and administration in virtue of these presents, he is to take to the above bishop the usual oath of fealty according to the form enclosed, faculty to receive which the pope hereby grants to the bishop, and George is to send to the pope the said oath by his letters patent, sealed with [his] seal, by his own envoy as soon as possible (fn. 2); without prejudice to the bishop of Dunblane, to whom the said monastery is by ordinary right subject. To John Valente (or Valence), elect of Tenos (Tinen). Provision, at the petition of Henry king of England and Thomas bishop of Bath and Wells, to him, a canon of the Augustinian monastery of Blithburgh in the diocese of Norwich, and holding by papal grant and dispensation the parish church of St. Laurence, Lydiard, in the diocese of Bath and Wells, in priest's orders, of the church of Tenos, so long void that there is no knowledge of the true mode of its voidance. As soon as he has had the present letters expedited, he is to betake himself to the said church and reside therein in person, and shall not exercise pontifical offices without his city and diocese. To Simon elect of Connor. Provision to him, a Friar Preacher, in priest's orders, and a completed (formatus) bachelor in theology, of the church of Connor, specially reserved during the life of bishop John by Nicholas V, who, upon its voidance by the death of the said John, made provision to the late Patrick, who, however, died without the Roman court before the letters of provision had been drawn up, so that the church is still void as above and still reserved. As soon as Simon has had the letters of provision expedited, he is to betake himself to the said church and reside there in person, and shall not be able to exercise pontifical offices without his city and diocese. from which it appears that it was Simon himself, and not Richard, who bound himself, and that Eubel's note of exclamation is therefore unnecessary. There is no mention of Nicholas V's provision to the late Patrick in Cal. Papal Lett., Vol. X. The present bull of provision by pope Pius is printed ‘Ex Archivo Apostolico, Libro xi. fol. 50,’ i.e. the present Register, in Ripoll, Bullarium Praedicatorum. Mandate (the pope having been informed by Malachy Omukyan, a monk of the Cistercian monastery of Holy Cross, Wochurlauand, in the diocese of Cashel, that Nicholas Clohnol, abbot of the Cistercian monastery de Valle Sancti Salvatoris of Duysquyd in the diocese of Ossory, does not reside in person, does not rule the monks thereof, and spends its fruits etc., not for its benefit, but for that of his sons and daughters and other laymen, so that the number of the monks daily diminishes, wherefore divine offices are not celebrated in the church of the monastery, etc.) if and after Malachy, who from fear of Nicholas's power cannot safely meet him in the city and diocese of Ossory, accuses Nicholas before the above three, to summon Nicholas and others concerned, and if they find the foregoing or some of them sufficient for the purpose to be true, to deprive and remove Nicholas, and in that event to make provision of the monastery, value not exceeding 50 marks sterling, to Malachy, if found fit; whether it become void by such deprivation, or be void by the resignation of Dermit Ymurhku, or in any other way. Mandate to reserve to the abbot's gift, in order to make collation to Gerald Figmores (apparently corrected from Figmoris, recte Fismoris), clerk, of the diocese of Ardfert (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and hold a benefice even with cure, and afterwards to hold any benefices compatible with such benefice, with or without cure, of any number and kind, even if canonries and prebends, dignities etc., even major or principal dignities, even elective dignities etc. with cure, and to resign them, simply or for exchange, as often as he pleased), if found fit, the deanery of Ardfert, a major elective dignity with cure, value not exceeding 20 marks sterling, to become void by the pope's promotion of John Stak, elect of Ardfert, to that church (above, f. 83), and by the consecration which is to be administered to him (see above, f. 84d.). and upon its becoming void to collate and assign it to Gerald; notwithstanding that the pope recently granted provision to him of the rectory of Rynbera (fn. 9) in the said diocese, value not exceeding 3 marks sterling, all right in or to which he is to resign upon obtaining possession of the deanery in virtue of these presents. Reservation to the pope's gift, for collation to him (who has studied in canon law for more than ten years, and was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold the perpetual vicarage of the parish church of Disertmalacala in the diocese of Killaloe (Laonien.), and afterwards the rectory of ecclesiastical fee in the parish church of Dromcleyb in the said diocese, and three benefices with and without cure, compatible with the foregoing, and subsequently a canonry of Limerick and the prebend of St. Munchins (sancti Munchyni) therein and the perpetual vicarage of the parish church of Garr in the diocese of Limerick and any other benefices, of any number and kind, with and without cure, compatible with the foregoing, even if canonries and prebends, dignities etc., even elective dignities, etc. and with cure, and to resign them, simply or for exchange, as often as he pleased, and finally the deanery of Cashel, a major elective dignity with cure, after the first of which dispensations he had himself so promoted), of the archdeaconry of Limerick, a non-major non-elective dignity with cure, value not exceeding 50 marks sterling, to become void by the pope's promotion of John Sthac, elect of Ardfert, to that church (above, f. 83), and by the consecration which is to be administered to him (see above, f. 84d.); notwithstanding the said defect, or that he holds the said vicarage of Disertmalacala without cure and the said rectory of ecclesiastical fee, value not exceeding 10 and 5 marks respectively, that provision has been made to him by papal authority of the said vicarage of Garr and of the said canonry and prebend of St. Munchins, of which he is not in possession, the value of each of which does not exceed 20 marks sterling, and that provision was lately ordered to be made to him by the same authority of the said deanery, value not exceeding 24 marks sterling, and that he was dispensed by the same authority to retain for life the said vicarage [of] Desertmalacala or that of Garr together with the said deanery, or without them any two other benefices with cure or otherwise incompatible, even if dignities etc., even if one of such dignities were major or principal, and to resign them, simply or for exchange, as often as he pleased. The pope hereby dispenses him to retain together with the said archdeaconry, if it be collated to him, his said canonry and prebend of St. Munchins, notwithstanding the said defect etc. As soon as he obtains possession of the archdeaconry, together with the said deanery or one of the said vicarages, he is to resign that other or others of the same deanery and vicarages of which provision was first made or ordered to be made to him, as above, if he have obtained possession thereof, or all right in or to them. To David Odonchir (recte Odonchu), dean of Kilmacduagh. (fn. 13) Decree as below. It was set forth to Calixtus III by the said David that after he had been dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, he in virtue thereof obtained. collated to him by authority of the ordinary, with the consent of the patrons, the rectory of the parish church of Disertceallaig in the diocese of Kilmacduagh, of the patronage of laymen and value not exceeding 3 marks sterling, and retained it for more than a year without having himself ordained priest, and without dispensation; that he afterwards obtained, also by collation by authority of the ordinary, a canonry of Kilmacduagh and the prebend of Kindmar therein, value not exceeding 2 marks sterling, on their voidance by the resignation of David Valen(s) made to Denis bishop of Kilmacduagh, and that on account of the slenderness of the fruits etc. of the said canonry and prebend and rectory he obtained the union for his life, by the same authority of the ordinary, with the consent of the said patrons, of the rectory to the canonry and prebend; that he got provision made to him by papal authority of the deanery of Kilmacduagh, a major nonelective dignity with cure, value not exceeding 10 marks sterling, void by the death of Denis Ydubgilla, and obtained possession of it, and that on account of the slenderness of the fruits etc. of the said deanery he obtained the union thereto for his life, by authority of the ordinary, with the consent of the chapter of Kilmacduagh, of the perpetual vicarage of the parish church of Bahac in the same diocese, value not exceeding 3 marks sterling, and in virtue of the said union obtained possession thereof. The said pope therefore on 15 Kal. Aug. anno 4 (18 July, 1458) rehabilitated him, and required him to resign all the said benefices. The said deanery having thus become void and reserved, the same pope made collation and provision of it, non-elective and with cure, value not exceeding 10 marks sterling, whether void as above or by the consecration of Denis bishop of Kilmacduagh, or in any other way, to David. the said pope further dispensing him on the said date to receive and retain it, notwithstanding the said defect etc. In order that the said pope's said letters of collation and provision and dispensation etc. may not fail to take effect because he died before the letters were drawn up, the present pope hereby decrees that the said collation etc. shall hold good from the said date, as if the letters had been drawn up, and that these presents shall be sufficient proof thereof. Mandate (the pope having been informed by Donatus Odonnawayn, clerk, of the diocese of Ross, that Donatus also [called] Odonnawayn, archdeacon of Ross, has dilapidated etc. the goods of the archdeaconry and committed simony, and is greatly defamed of this and divers other crimes in those parts) if and after the said Donatus, clerk (who says that he is of a race of dukes by both parents, and that he is in or about his seventeenth year, and was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents related in the third and third degrees of kindred and the third and fourth degrees of affinity, to be promoted to all even holy orders and hold a benefice even with cure, and who thereafter had himself made a clerk) accuses archdeacon Donatus, who has also neglected to reside in the said church, before the above prior, to summon archdeacon Donatus, and if he find the foregoing to be true, or one thereof sufficient for the purpose, to deprive and remove him, and in that event to collate and assign the archdeaconry, a non-major nonelective dignity with cure, value not exceeding 16 marks sterling, to the said Donatus, clerk, if found fit, whom the pope hereby dispenses, notwithstanding the defects of age and birth etc., to receive and retain it, and to resign it, simply or for exchange, when he pleases.
