The present pope lately (on being informed by Rory Omygyr, priest, of the diocese of Killaloe, that Thady Omygyr, priest, vicar of Drumeleyb (rectius Drumcleyb) in the said diocese, had perpetrated homicide and committed (fn. 7) perjury and simony) ordered the prior of Yn(i)scronan in the said diocese and two others [not here named], their own names not being expressed, if and after Rory accused Thady before them, to summon Thady, and if they found the above to be true, to deprive and remove him, and in that event to collate and assign the vicarage to Rory. Afterwards, as Rory's recent petition contained, he made the accusation etc., and caused Thady to be summoned before Thady Donati, canon of Killaloe (sub-delegated by Thady Ohamahay, prior of the said monastery) who by a definitive sentence deprived and removed the said Thady Omyger (sic), and made collation and provision of the vicarage, thus void, to Rory, who (having, after Thady's appeal to the apostolic see from the said sentence, obtained the vicarage in virtue of the said collation and provision) agreed to assign to Thady yearly half the fruits etc. of the vicarage, which he did, in order that Thady should abandon the said appeal and leave Rory in peace. To Maurice Oconchuyr, Malachy Ocluman and Thomas Omathet, canons of Achonry (Akaden.). Mandate, as below. The recent petition of John Ocluman, canon of Achonry, contained that Eugenius IV (on learning that the rectory of the canonically united parish churches of Killmactaig and Killluothreand, in the places of the rural lands of Beanfada and Officarre, respectively, in the diocese of Achonry, was void because the late Thady (fn. 9) Ocluman, having obtained it by canonical collation, had held possession for more than a year without having himself ordained priest and without dispensation) ordered the late Dermit Magaedagan, also a canon of Achonry and two others [not here named] to collate and assign it to the said John [Cal. Papal Lett. IX, p. 403], which the said canon Dermit did, and that in virtue of his collation and provision John obtained possession; that afterwards the present pope (upon its being set forth to him by the said John, Thady (Thatianus) Ycearnaid, priest, of the said diocese, and Cormac Yagra and John Flauus (i.e. Flavus) [also] Yagra, the lords of the said lands, that although the said churches had long been ruled and governed by one rector, called the rector of Officarre and Beanfada, such mortal (capitales) enmities had arisen between the said lords that the said churches, which are of the patronage of laymen, could not be peaceably and quietly ruled and governed by one rector; and it being added that if the union of the said churches were dissolved and it were ordained that henceforth in perpetuity they should be ruled and governed by two rectors, and if, in order that their fruits etc. might be equal, two townlands called [the townlands] of Dubcarnd in the said rural lands of Beanfada were appropriated to the said church of Killluothreand or to the rural lands of Officarre, it would be to the great advantage of the said churches and their parishioners) [and its being alleged that the value of the fruits etc. of the said churches did not exceed 16 marks sterling a year]) ordered the archdeacon of Achonry, his name not being expressed, if he found the facts to be as stated, to dissolve the said union, decree that the said churches should henceforth in perpetuity be ruled and governed by two rectors, the rights of patronage being reserved to their respective patrons, and appropriate the said townlands in perpetuity to the said church of Killluothreand or to the rural lands of Officarre, and moreover, in the event of his making such separation, decree and appropriation, to collate and assign the said churches of Killluothreand and Killmactaig to the said John Ocluman and Thady respectively [see above, p. 427]. Subsequently, as the pope has learned, John Odarcan, archdeacon of Achonry, proceeding to execute the said mandate, without John Ocluman's consent made the said separation, decree and appropriation, and collated and assigned the said church or rectory of Killmactaig to the said Thady. At the said petition, adding that although the said John Ocluman, the old (antiquus) rector, who still by his old right (ex antiquo jure suo) holds the said rectory of Killluothicand (sic), is ready to give his consent to the said archdeacon's proceedings, he fears lest, inasmuch as in the said later letters there was no mention that he was then holding a canonry of Achonry and the prebend of Killluothreand, the said letters may be held surreptitious and the said division and its consequences not hold good, the pope hereby wills. and grants to the said John Ocluman (who was lately successively dispensed by papal authority, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and also to receive and hold the said canonry and prebend in the event of his obtaining them in virtue of other letters of the present pope ordering provision of them to be made to him, and who afterwards, having been so promoted, obtained in succession, collated to him by papal authority, the said rectory and canonry and prebend) that the said later letters and their consequences shall hold good from the date of these presents, as if they had contained full mention of the said canonry and prebend and their value; and orders the above three, after Ocluman has given his consent, as above, to collate and assign the said rectory of Killluothreand in [the said place] of Officarre, which has cure and whose value, with the said townlands, does not exceed 10 marks sterling (fn. 10), to Ocluman, howsoever it be void; notwithstanding that he holds the said canonry and prebend, value not exceeding 4 marks sterling. Mandate (the pope having been informed by John Ohogayn, clerk, of the diocese of Killaloe (Laonien.), that Cornelius Ohurrhyle, rector of Balyncasleaynara in that diocese, has dilapidated and dissipated and converted to lay and other unlawful and unhonest uses the immoveable possessions of the said church, is a simoniac and notorious fornicator, and is publicly defamed of many other crimes [not here expressed]) (fn. 12) if and after John (who has for some time studied canon and civil law in universities and non-university places (fn. 13), and was lately dispensed by authority of the ordinary, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, nobles, to be promoted to minor orders and hold a benefice without cure, and was afterwards ordered by papal authority to be dispensed to be promoted to all, even holy orders and hold a benefice even with cure, and who from fear of Cornelius cannot safely meet him in the city or diocese of Killaloe) accuses Cornelius before the above canon, to summon Cornelius, and if he find the above or one of them enough for the purpose to be true, to deprive and remove him, and in that event to collate and assign the rectory, which is said to have been of old time of the patronage of laymen, but the whereabouts of whose present patron is unknown, and whose value does not exceed 8 marks sterling, to John, who is hereby specially dispensed to receive and hold it, notwithstanding the said defect etc. Dignum etc. (O. and A. de Cortesiis. | O. xxii.
