To Archibald Jardin, rector of the second (alterius) portion, called the rectory of Hertyshed, of the parish church of Lammynton, in the diocese of Glasgow, wont to be governed by two rectors, bachelor of canon law. Dispensation to him (who was formerly dispensed by papal authority, as the son of an unmarried nobleman, of a race of knights and barons, and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice, even with cure, after which, having been so promoted, he obtained the above portion, of lay patronage and value not exceeding 15l. sterling; and to whom the pope lately ordered provision to be made of one or two benefices, even if one had cure etc. in the gift of the bishop and the dean, subdean and chapter etc. of Glasgow, and of the abbot and convent of the Benedictine monastery of Kylvynyn in the said diocese, and by the same letters dispensed him to receive the same) to hold any benefices with or without cure, compatible with one another and with the aforesaid, even if canonries and prebends, major or principal elective dignities etc., and to resign all, simply or for exchange, as often as he pleases; with grant that in future papal letters and graces his said defect need not be mentioned. Grant and ordinance, at the petition of Henry, king of England (who has founded and endowed in the place of Cambridge for a provost and seventy scholars a college of the Blessed Virgin Mary and St. Nicholas the Confessor, has procured its and their exemption by the apostolic see from all jurisdiction ordinary and metropolitical and of the chancellor of the university, and of other judges ordinary, and has enriched it and them, as the university has also done, with divers privileges etc.) that in perpetuity, as often as the university and the said place are under interdict so that the scholars cannot exercise scholastic acts therein, the provost, fellows and scholars may exercise their scholastic acts and complete their courses (fn. 2) within the said college, and be admitted therein to any degrees, even the doctorate; that the provost may, in time of such interdict, solemnly admit the fellows and scholars to degrees, even the doctorate, in any sciences or faculties, in the college and its church or chapel; and that for the performance of the foregoing within the college in time of interdict the provost and two deans of the faculty of arts, chosen by him, shall act in the stead and use and exercise the full power of the chancellor and the two proctors of the university respectively; and that the said fellows and scholars who, thus perform and exercise their acts within the college in time of interdict and are received to the said degrees may continue to perform and exercise their acts and complete their courses (fn. 3) in the university when there is no interdict, and otherwise fully use and enjoy, both within and without the university wheresoever, all privileges etc. and other public and scholastic acts whatsoever, and be admitted thereto, in all respects as if such acts had been performed, and such forms completed, and degrees taken in the university, and conferred by the chancellor and proctors, in times of no interdict, and as if all the aforesaid had in other respects been fully performed in accordance with the statutes etc. of the university. Motu proprio declaration and decree, as below. The pope has recently learned that formerly John, archbishop of Canterbury made collation and provision of the parish church of Adhesam in the diocese of Canterbury to Vincent Clementis, then as now S.T.M., and holding together, by papal dispensation previously granted to him, the parish churches of Montfort (de Monteforti) and Weterynsete in the dioceses of Rouen and Norwich, he being absent from those parts and wholly ignorant; that the proctors whom Vincent had previously generally appointed ratified in his name the said collation and provision, and under pretext thereof took possession of Adhesan [sic], held it for some time, but not for a year, and took the fruits, which they converted to his uses; that as soon as Vincent learned the said collation and provision etc. he, before notary and witnesses, protested that he never intended to retain the said church together with the said other two, forthwith resigned Weterynsete, and said that thenceforth, namely after the said resignation and not before, he ratified the said collation and provision etc.; that afterwards, inasmuch as Eugenius IV desired that the said church of W[e]terynsete should be collated by authority of the ordinary to John Barotius of Venice [now] a subdeacon of the present, then an acolyte of the said pope, (fn. 4) the said Vincent, who had promised to do his best for the fulfilment of the said pope's desire, said, before the said notary and before witnesses, that silence should be kept about the said resignation until a certain event, then expressed, and also protested that, if the said church of Weterynsete were held in his name until the said event, he should thereby incur no disability, which sayings and protestations the late Thomas, bishop of Norwich, admitted, as is more fully contained in divers public instruments wherein Vincent asserted, inter alia, that he had been previously dispensed by the said pope to hold a third parish church. Seeing that, as the pope has learned, the said dispensation about holding such third church had been only verbal, and that certain proctors of Vincent held in his name, after the said resignation and last protestation, the said church of Weterynsete for more than three years without other dispensation, and still hold it, taking the fruits, and that Vincent, not being otherwise dispensed in regard to retaining such third parish church, held together, within the said three years, Montfort and Adhesam for some time, and afterwards, having resigned Adhesam held, as he still does, the chancellorship of the church [of] Lichefelib (sic), a non-major dignity, although the fruits received by his proctors from Weterynsete within the said three years have not yet been set out to his use, the pope, inasmuch as in the foregoing Clement proceeded purely and not maliciously, declares and decrees, motu proprio. that Clement (who is also a subdeacon of the present pope, and was recently sent to the pope as an ambassador of Henry, king of England, and has rendered and continues to render services to the pope and the apostolic see) has not on account of the aforesaid incurred any disability, grants that he may retain for life, with the said church of Montfort and the said chancellorship, the said church of Weterynsete, as if, before the said collation and provision were made, he had been sufficiently dispensed to hold for life with Montfort and Weterynsete another parish church and, resigning one of them, to hold with the remaining two a dignity in a cathedral church, even with cure and elective, and as if the said resignation had not taken place; and that these presents shall be sufficient proof of the said verbal dispensation and the rest of the foregoing. The pope also grants to him all the fruits etc. received from Weterynsete after the archbishop's said collation and Vincent's resignation and from other incompatible benefices, etc., and dispenses him to hold for life with any two of the said churches of Montfort and Weterynsete and chancellorship, any third benefice with cure or otherwise incompatible, provided that he do not hold a third parish church or its perpetual vicarage, etc. Ad fut. rei mem. To Robert Botyll', prior of the priory of England of the hospital of St. John of Jerusalem. Grant and indult, in consideration of his divers occupations, that as long as he holds the said priory, or as long as he lives, he need not go in person to any general chapter or convocations etc. of the said hospital in the island of Rhodes or elsewhere, even if personally summoned, but that, whenever expedient or necessary, he may send one or two or more proctors; and that, if he go in person, as soon as such chapter etc. is over, he may leave with his retinue forthwith, without requiring the licence of the master or any other; any oaths or vows to the contrary being hereby relaxed. Annulment. as below. The petition of the above Robert Botill’ contained that formerly Richard Schyplod, a brother of the above hospital, was transferred from the monastery of Herberi in the diocese of Coventry and Lichfield, of which he was a canon, to the said hospital, and received as a priest brother; and that, after remaining therein for some time and acquiring some property, he, desiring to exempt himself from the said hospital or the jurisdiction etc. of its superiors, impetrated or rather extorted letters from the present pope, by which the pope dispensed him to receive and hold for life a benefice wont to be governed by secular clerks, and by which, as is alleged, he is exempted from the said jurisdiction etc. At the said petition, adding that the said and similar letters, dispensations, exemptions etc. are greatly to the prejudice of the said hospital and the weakening of its religion, the pope hereby annuls the said letters and any others, similar or by which the said Richard is exempted from the said jurisdiction etc., and orders them to be cancelled from the registers of petitions and apostolic letters.Ad fut. rei mem. Dec.anno 15, exempting, at the petition of the above king, his foundation of King's College of SS. Mary the Virgin and Nicholas, Cambridge, and its present and future provost, scholars etc. from all jurisdiction etc. of the archbishop of Cranterbury, the bishop and archdeacon of Ely, and the chancellor of the university etc. [Cal. Confirmation, at the recent petition of the above prior Robert (containing that a number of popes have granted certain indulgences to those who visit at certain times of the year and give alms to churches etc. of the priories, preceptories etc. of the above hospital, wheresoever existing; and adding that those who do so, some of whom come from distant parts, in many cases desire, in order to obtain the said indulgences more easily, to be absolved from their crimes etc. on their arrival and before such visit), of the said indulgences; with grant and indult, in perpetuity, that in the priory of Clerkenwell by London the subprior and three priests, secular or regular of any orders, appointed by the said prior or by the subprior, and in each of the other preceptories, houses and places in the realm one priest, secular or regular, appointed by the said prior or by the preceptor, may (from the first vespers of Palm Sunday to the second vespers of Easter Day, inclusive, every day in Holy Week, (fn. 7) in cases of homicide, apostasy, arson, sacrilege, incantations, sorceries, perjury, lecturing in, studying or practising civil law (leges) or physic by clerks, secular or regular, adultery, incest and all other crimes etc. and other sins, even sodomy, and in all cases except those reserved to the apostolic see; and on all other days of the year, whenever and as often as expedient, in all cases, except only in reserved cases) hear the confessions of all who wish to visit the said churches etc., whencesoever they come, grant them absolution and enjoin penance; and that they may absolve from sentences of excommunication etc., dispense ecclesiastics on account of consequent irregularity, and rehabilitate them, administer the sacraments, and commute any vows, even of fasting and pilgrimage, except only vows to visit the shrine of the Apostles, the Holy Land and St. James in Compostella. To Master Michael Amici, canon of Tournai, doctor of canon law, scriptor and member of the pope's household. Faculty, as below. Eugenius IV granted to Peter, bishop of Brescia, whom he had sent as his orator and special nuncio to the realm of England for certain business concerning the Roman church, a faculty to impose, levy and collect a whole tenth for the purpose of a fleet (fn. 8) against the Infidels, which tenth, as the pope has been informed on good authority, the said bishop duly imposed, but has given no full account in the papal camera of the great sums which he has received from the clergy and people of the realm for the purpose of the said fleet. The pope therefore, wishing to be better informed, hereby grants faculty to the said Master Michael, whom he is also sending as his special nuncio, to inform himself in the matter, in the best ways he can; with mandate to be diligent, and to let the pope have as soon as possible the evidence which he gathers from witnesses and his whole proceedings in the matter.
