Damages claimed at £10. Bond shown in court, as well as the testamentary letters of the bishop, by which HG, RH, RP, JJ, JH and JT are his executors and have administration. [A marginal note states that it was not recorded in the pleading as to whom administration of the goods of John de Gigles was granted, or by whom.]

Pleading: John H. seeks from widow Joan C., daughter and heir of Nicholas R., five messuages and one garden with appurtenances in Coventry as his right and inheritance; in which JC does not have entry unless after the disseisin which William L., unjustly and without judgement, made to JH since the first voyage of Henry III into Gascony etc. JH says that he was seised of the aforesaid tenements with appurtenances in his demesne as of fee and by right in the time of the peace of the present king, taking profits thereof etc.

Pleading: JC defends and calls to warrant John D., who is present in the court and freely warrants JC. And upon this JH seeks the aforesaid property from JD, who is held by his warrant etc.

Pleading: JD defends and says that the aforesaid WL did not disseise JH of the aforesaid tenements with appurtenances and puts himself upon the country.

Pleading: JH seeks licence to imparl, and has it. And later, the same JH returns to this court in that same term (Trinity term 1500). JD does not return, however, in contempt of the court, and makes default. Therefore the decision is that JH is to recover his seisin from JC concerning the aforesaid tenements with appurtenances etc. 'And , that the same JC is to have (lands) from the lands of JD to the value etc.' JD is in mercy. And upon this the same JH seeks a writ of the lord king to have seisin of the aforesaid tenements with appurtenances, directed to the sheriff of Coventry. This writ is granted, and is returnable in Michaelmas term in one month 1500.

Postea text: postea 1 - before Michaelmas term in one month 1500 the case was adjourned by writ of the lord king of common adjournment as far as the morrow of All Souls 1500, on which day the sheriff of Coventry returned that the writ was enforced, and that JH was made fully seised of the aforesaid tenements, namely, on 6 August 1500. Further, on the same day, JC was made to have seisin of 8 messuages of lands from JD, namely in Stivichall, in the county of Coventry.

Pleading: JB says that he does not owe MW the aforesaid £5 8s 4d nor any other monies and offers his law, to be made in the quindene of Michaelmas term 1500. Pledges of law are named. And, it is decided that JB's attorney, Robert R. is to have his master to this court to make his law in the term aforesaid.

Postea text: postea 1 - prior to the quindene of Michaelmas term 1500 the case was adjourned by writ of the lord king of common adjournment as far as the morrow of All Souls 1500on which day JB is essoined. Therefore, the case is forwarded as far as the quindene of Martinmas 1500.

Postea text: postea 2 - MW comes, but JB does not come to make his law. Therefore, the decision is that MW is to recover the aforesaid debt plus damages assessed by the court, with at 10s. JB is in mercy.

Pleading: [Further information drawn from CP 40/954, rot 224 (Trinity 1500)] JT says that he paid prior Richard the aforesaid payments £20 due at Pentecost 1498 and £20 due at Pentecost 1499, namely at Tewkesbury, in accordance with the bond's endorsement.

Pleading: Abbot Richard says that JT did not make the payment of £20 due at Pentecost 1498, or the payment of £20 due at Pentecost 1499.

Pleading: JT reiterates his claim that he did make the aforesiad payments and puts himself upon the country, and abbot Richard puts himself likewise. Order to the sheriff of Gloucestershire to make a jury come in Hilary term 1501.

Postea text: postea 1 - the sheriff of Gloucestershire does not send the writ, and so the case is forwarded as far as the octave of the Purification 1501.

Postea text: postea 2 - to this day comes abbot Richard and JT. And upon this JT says that he is not able to deny the action against him, nor that he owes abbot Richard the aforesaid £40. Therefore the decision is that abbot Richard is to recover the aforesaid debt plus damages assessed by the court, with abbot Richard's assent, at 10s. JT is in mercy.

Postea text: postea 3 - 09/10/1501 abbot Richard acknowledges that he has been satisfied of £19 of the aforesaid debt and damages. Therefore, JT is quit concerning £19 etc.

Pleading: WH defends and calls to warrant John D., who is present in this court and freely warrants them. And upon This RT, RH, and WP seek the aforesaid property from JD.

Pleading: JD, held by his warrant, defends and says that the aforesaid JH and AH did not disseise RT, RH, and WP, as claimed in their writ, and puts himself upon the country.

And to this day, Easter term in five weeks, plaintiff RB comes by his attorney, William L., but plaintiff WP does not come and so is in default. Therefore it is decided that RB is to prosecute the suit alone, versus ND. RB sys that on 28/01/1468, at London, ND made a certain bond by which he obliged himself to the late MP in £32, to be paid to MP at the feast of All Saints then next. Damages are claimed at 10m. RB presents the bond to the court, as well as letters testamentary showing himself and WP to be executors of MP.

This release, given in the name of WP, citizen and goldsmith of London, and then chamberlain of London, acknowledged himself to have received and had on that same day for and in the name of the late MP, from ND and in the name of ND, by the hands of Henry L., £14 in full satisfaction and payment; WP having acknowledged himself to have been paid, and ND to have been acquitted, by that same writing.

Pleading: Roger H. claims that John Y., one of the executors of the will of Richard C., together with Lawrence A. and Thomas B., co-executors of the will of RC, owes him £7. RH says that in the Penecost of 1497 (14/05/1497) at Chalkwell, Essex, he demised to the late RC half of the manor of Chalkwell in the county aforesaid with appurtenances, 200 acres of land, 100 acres of meadow, and 40 acres of wood with appurtenances in Chalkwell, Prittlewell, and Bradfield [near north Benfleet], Essex, to be had and occupied by the late RC from the same Pentecost for the one year then next following, for a rent of £10 to be paid in the feasts of Martinmas and the Pentecost then next following, in equal portions. RH says that by force of this demise the late RH had and occupied the aforesaid half-manor and lands etc. for the aforesaid year, but that £7 of the aforesaid £10 rent is still in arrears. RH says that the late RC did not pay him this £7 arreas of rent while living, nor has RC's executor JY or co-executors LA or TB paid him this money. RH claims damages of 5m.

Pleading: JY comes and says that he is not able to deny the action of RH, nor that himself and co-executors LA and TB detain the aforesaid late RC's arrears of rent etc.

Postea text: Therefore, the decision is that RH is to recover the aforesaid £7 against the aforesaid executors, from the goods and chattels which were of the late RC at the time of his death and are now in the hands of the executors. Damages are assessed by the court, with RH's assent, at 5s, also to be taken from the goods and chattels of the late RC. JY, who came when first summoned, is not in amerced. And upon this RH remits to the executors the aforesaid damages; and so, the executors are quit concerning the said damages.

Pleading: James H., attorney for the king, states that Christopher P. owes the king £40. JH says that at Horncastle, Lincolnshire, on 18 November 1497, Leonard R., Thomas S., William B., and Robert E., before Richard T., then one of the keepers of the peace in the Parts of Lindsey, stood as sureties for CP, each under penalty of £20, while CP placed himself under a penalty of £40 that he should not cause or procure any bodily damage or harm to Philip S. or any of the king's people. If such damage or harm was caused to PS or any other by CP, then the said sums of £40 and £20 should be levied from their lands and chattels, to the use of the king. However, it was later show in Chancery that on 22 April 1499, in Horncastle, CP assaulted Thomas Dowenam and his wife Alice, against the king's peace and contrary to the form of his surety. He therefore owes the king the said £40, but has not paid, to the king's damage of £10.

Pleading: CP says that he did not assault TD and AD, or either of them as claimed. Parties on country, sheriff of Lincolnshire to have jury here at the octave of Michaelmas.

Postea text: Process continued, jury in respite to quindene of Michaelmas 1501, nisi prius they come before the justices of assize at Lincoln on 10 September 1501. On this day, CP came by attorney, justices send record that on that day, before John Vavasour and John Fysher, justices of assize, CP came in person, jury came, and a public proclamation was made for the king that if anyone wished to give information concerning this before the justices, the king's sergeants or attorneys, then they should come and be heard; however, nobody appeared, so process continued, and the jury said that CP was not responsible for the assault on TD and AD, or anyone else. Therefore order that CP should be quit.

Pleading: William Eston clerk, Hugh I. and John H., executors of the will of William Eston mercer, claim that Thomas F. and his wife Elizabeth F. owe them £21 3s arising from the sale of cloth which EF, while a single woman, bought from the late William Eston mercer but did not pay for. William Eston clerk, HI and JH say that at London on 01/01/1497 EF, then a single woman, bought from the late William Eston mercer: one piece and 2 ells of linen cloth called Holland cloth, 2 pieces of linen cloth called Flemish cloth, 10 pieces of lawn, 6 pounds of thread called Cologne thread, 2 pounds of thread called blue thread ('trede'), one pound of thread called 'outenard' (alt. reading 'outevard') thread, 2 ells of silk called satin, 2 yards of velvet, 4 pieces Cyprus, 4 pieces of linen cloth called cottons, 2 ells of silk called damask, one piece of cloth called blue tuke, one piece of linen cloth called nifle ('Nyfyls'), and 6 ells of cloth called canvas. The plaintiffs say that although this money has often been requested neither EF as a single woman nor EF and TF after their marriage paid it to the late Wiiliam Eston mercer, nor have they paid it to Willaim Eston clerk, HI, and JH as the executors of William Eston mercer. Damages are claimed at 10m. Willaim Eston clerk, HI, and JH present letters testamentary to the court showing them to be the executors of William Eston mercer.

Pleading: TF and EF defend and seek licence to imparl as far as the octave of Michaelmas term 1500.

Pleading: Roger B. claims that John W. owes him £4 as the unpaid reside of a £40 11s 11d debt arising from the sale of 10 bales of woad which JW bought but did not fully pay for. RB acknowledges that he has been satisfied concerning £36 11s 11d of the original £40 11s 11d debt, leaving the aforesaid unpaid residue of £4. Damages are claimed at 5m.

Pleading: JW claims that he does not owe RB the aforesaid 34 nor any other monies and offers his law, to be made in the octave of Michaelmas term 1500. pledges of law are named. And JW's attorney, William B. is ordered to have his master to this court to make his law in the term aforesaid.
