Case type: Bond; Real action / rents / damage to real estate
Pleading: Thomas Tryll states that on 13 March 1441 William Lyef made a bond with him in £40, payable on the morrow of the Annunciation, but has not paid, to his damage of £20. He shows the bond in court.
Pleading: WL states that he does not owe this debt, as he states that the bond was made and sealed, and was then delivered to William Hoper for safe-keeping, to hold until an indented schedule should be written and sealed between WL and TT concerning the conditions of the bond, namely that if WL should pay to WH 23m per year for 5 years, payable at the four usual feasts, for the farm of the chapels of Radfield and Elmley in Kent, then the bond shall have no effect; otherwise it will remain in force. When one part of this indenture, sealed by WL, should be delivered to WH, then WH was to deliver the bond and schedule to TT, otherwise WH was to keep the bond. However, he states that WH did not deliver the schedule to TT, but did deliver the bond, and since the bond was delivered without the conditions, the bond was therefore not of his making. Parties on country, jury here at octave of Trinity. Pledges named for defendant. Bond in safe-keeping of Henry Fylongley.
Pleading: [continued at Trinity 1450, rot 269d] WL granted licence to imparl to quindene of Michaelmas 1450, with assent of TT. [This continuation gives only the initial plea from the previous roll, not the defendants counter-plea. However, it would seem to be the same case.]

Pleading: John Malkyn and Richard Canam state that on 24 September 1447 Thomas Shipton, now deceased, made a bond with them in £20. However, neither TS during his life, nor John Shipton, Thomas Rykes and Simon Shipton, his executors after his death, have paid this sum to JM and RC, to their damage of 20m. They show the bond in court.
Pleading: JS, TR, and SS state that they were never executors of TS, and never administered any goods previously of TS.
Pleading: JM and RC state that the defendants administered various goods previously of TS, namely in the parish of St John Zachary, Aldersgate ward, London. Enquiry by country, sheriff of London to have jury here at octave of the Purification.
Pleading: On the octave of the Purification, parties come, defendants state that no process should be taken by the jury, and the plaintiffs should not maintain their suit, as after the last pleading at the octave of Hilary, at Fordham, by a document which they show in court, dated 5 February 1449, JM and RC released them from all outstanding personal actions between them before that date.
Pleading: JM and RC granted licence to imparl to quindene of Easter.
Postea text: 4 further licence to imparl, to quindene of Easter 1451.
Postea text: Parties come, JM and RC, the plaintiffs, state that the release ought not hold because on that 5 February 1449 the release was delivered to Thomas Wodhouse under certain conditions, namely that if a certain Roger Byrkes should discharge JM and RC of £6 which should have been paid to TS the testator in Trinity term last for the rent and farm of the manor of Fordham, and if RB should settle all outstanding actions with the executors, and if the executors should pay TW or JM and RC all the costs for suing a writ of debt, and if TW or the executors should satisfy JM and RC of all the costs they have sustained, then TW would deliver the bond to the executors. JM and RC state that RB did not exonerate them of this £6, nor did they make the necessary agreement, nor did the executors or TW pay the required costs to JM and RC. TW nevertheless delivered the bond to the executors, and they therefore state that the bond was not made of them. Enquiry by country, jury here at octave of Trinity 1451.

Damages claimed: £60
Case type: Bond; Imprisonment; Sale of goods
Pleading: William Whallay, prior of New Place by Guildford, amerced for many defaults. Robert Edolf and Thomas Thorp state that on 23 July 1443 Ralph Alderley, former prior of New Place by Guildford, and the convent of that house, in their chapter house, made a bond with them in £25, payable on 3 November 1444, and on 24 July 1443 they bought from them a certain woollen cloth of Lyre, containing 33 yards, and a certain white woollen cloth containing 26 yards, a certain linen cloth of Brabant containing 52 ells, one linen Flemish cloth containing 50 ells (literally 4 dozen ells and 2 ells), all for £15, payable at Michaelmas next, for the use and clothing of the prior and canons. However, neither the former prior nor the present prior have paid this total of £40 to RE and TT, to their damage of £60. They show the £25 bond in court.
Pleading: Prior WW granted licence to imparl to quindene of Trinity, with assent of plaintiffs.
Pleading: [continued at Michaelmas 1450, rot 331] The present prior states that he should not owe the £25 bond, since at the time it was made the former prior had in his house various other co-canons, namely Roger Buk, William Trevys, William Lyngefeld, Robert Autron, William London, Richard Bryd, James Mekelheryng, Clement Grace and Richard Brampton, who were the entire convent at this time, and through the threat of imprisonment he forced them to seal this bond with the common seal of the house. Concerning the other £15, he states that the cloth never came to them. Parties on country.
Pleading: RE and TT state that the canons made the bond of their own free will, and not under any threats from the former prior. Enquiry by country, jury here at octave of Hilary.
Postea text: Process continued, jury in respite to octave of Hilary 1452. On this day, parties come, jury comes to give verdict, RE and TT do not prosecute their writ. They and pledges amerced. Prior sent without day.
