Pleading: Gilbert K. and Thomas Haket claim that William H. unjustly detains two bonds which were given to him for safe-keeping, but which he now refuses to return. One of these bonds shows that a certain Katherine A. who was the wife of William A. is held to GK and TH in £100 by certain terms within-written. The second of these bonds shows that GK and TH are held to the same KA in £100 by certain terms within-written. Damages are claimed at £200.
Pleading: WH presents these bonds to the court and says that he is ready to deliver them with the court's decision. However, WH says that these bonds were given to him with the mutual assent of KA, GK, and Thomas Haket only to be returned to KA, or GK and Thomas Haket, under certain conditions. WH says that he is ignorant, on the part of KA, as to whether or not these conditions have been met and seeks that KA be warned. Therefore the sheriff of London is ordered to make it known to KA by good and honest men that she is to be to this court in the octave of St John the Baptist 1426 (later in Trinity term 1426) if she wishes to object to GK and Thomas Haket having livery of the aforesaid bonds. Day is given between the parties in the same term.
Pleading: [further information drawn from CP40/667 rot.564. - Michaelmas 1427] Katherine A. says that Gilbert K. and Thomas Haket ought not have livery of the bonds. KA says that due certain discords between herself on one part, and the aforesaid GK and Thomas Haket on the other part, concerning the detention of diverse goods and chattels, by GK and Thomas Haket, which had belonged to the late WA at the time of his death, KA herself as much as GK and Thomas Haket submitted to arbitration at London on 04/05/1426, before arbiters William D., Thomas G., William G., and Thomas Denys, citizens of London (civium de London'). KA says that on this day the aforesaid bonds were given to (defendant) WH for safe keeping under the conditions if KA should not keep to the arbiters' decision the bonds should then be delivered to GK and Thomas Haket, and conversely if GK and Thomas Haket should not keep to the arbiters' decision the bonds should be delivered to KA. The arbiters gave their decision on 16/05/1426, saying that: (1.)GK and Thomas Haket ought to deliver to KA all the equipment (apparatum), vestments and paenulas, belts/girdles (cingula), and other personal items of the late WA which they detained, namely: one sanguine coloured outer garment (togam) with a red-grey paenula (penual de rubio griseo) in he same; one scarlet outer garment with a grey paenula in the same; one outer garment of musterdevillers with a paenula of cristigrey in the same; one blue outer garment paenulated (paenulat') with ‘scathed grey'(elsewhere ‘stagegrey'); one outer garment of green called (a?) ‘bukhorne' paenulated with ‘croppes and busshes'; one light green huke paenulated with red-grey; another huke of murreypaenulated with ‘croppes and scache (checkes?)'; another huke lined with hemp (cum canabio duplicator); one red colobium (‘colobum') lined with green cloth; one tunic called a ‘frende' of blue cloth, paenulated with grey; one simple tunic of russet; one red tunic; two tunics of black worsted; one blue tunic; two hoods of scarlet cloth; one old (vetus) red hood; two pair of sleeves/gloves (manucarum) of scarlet cloth; two forcers with three woollen kerchiefs (duas forceras cum trib' flamiolis de panno de lanne); one rosary of blank jet; one silver bound ‘arcam telam cinguli' of red colour; one shirt (camisiam); one ‘limatem?'; one broad cloth of green and black silk, checked; one girdle of plane silk bound with ‘stipis argenteis adinstar aquile factis et coronis argento deaurato coronatus cum largis pluscula et pendent' argenteis deauratis et enamelatur'; one broad cloth of red silk bound ‘cum pluscula appendent' et sex stipis argenteis'; one silver rosary; one rosary of jet with silver rosary beads; two pair of knives with handles of black jet, silver bound; two purses of cloth of gold covered with silk and ‘caprino' (duas bursas de panno aureo cerico et caprino coopertas); one purse of red and white silk with castle work (cum opere castellino); one double colobium (dublum collobium) of green and violet cloth; four shirts; four night-kerchiefs; two saddle-breeches/woman's-saddles bound with brass gilded ‘faleris' (duas sellas feminales cum ‘faleris' auricalcillo deaurato); three forcers; two great chests; one deep blue (fundo blodio) bed of tapisser-work spangled with flowers and angels; one pair of blankets; 4 pair of sheets; two hemps/canvases (canabia); two good cushions; two long cushions; two felts (fultras); one cushion covered with silk cloth called tartarin; one basin; one laver; one tablecloth (mappam); one small-garment? (togillam); one mazer; one piece of silver; one-half dozen set of pewter/latten vessels (dimid' duodenam vasorum electriorum garneziat'); two half-gallon pewter/latten jars (ollas electrias); two one-quart pewter/latten jars; one copper/brass jar (ollam enema); one copper/brass plate; one copper/brass pitcher (ursiolum); two iron cooking-dishes (verna); one pair of andirons; one tripod; one frying pan; one stone mortar; and one pestle. (2.) And, GK with Thomas Haket ought to enfeoff to KA a certain messuage in Wandsworth, Surrey, in accordance with the customs of the manor. (3.) After the aforesaid goods have been delivered to her, KA ought to give to GK and Thomas Haket a general acquittance concerning all actions against them. (4.) GK and Thomas Haket ought then, in return, deliver a general acquittance to KA. (5.) And, after the aforesaid acquittances have been exchanged, GK and Thomas Haket ought to make, to KA her heirs and assigns, a gift of 100m, to be paid in the church of St Martin Ludgate in a certain manner underwritten. Namely, the 100m were to be paid as: 20m in the feast of the nativity of St John the Baptist 1426 (24/06/1426); 20m in Christmas 1426 (25/12/1426); 20m in the feast of the nativity of St John the Baptist 1427 (24/06/1427); 20m in Christmas 1427 (25/12/1427); and the feast of the nativity of St John the Baptist 1428 (24/06/1428). KA says herself, GK & Thomas Haket, and the goods & chattels aforesaid were all in the aforesaid parish and ward (St Martin Ludgate, ward of Farringdon Within) at the time of the arbiters' judgement, in the presence of the arbiters; but that GK with Thomas Haket did not deliver all the goods to her (minime deliberarunt). KA says that if all of the goods and chattels had been delivered to her at the time of the arbitration she would have given GK and Thomas Haket a general acquittance and thus kept fully to the arbiters' judgement etc. Thus it is she who should have livery of the aforesaid bonds.
Pleading: GK and Thomas Haket say that they ought to have livery of the bonds. They say that they did indeed have arbitration with KA in the manner aforesaid, where it was decided that; GK and Thomas Haket ought to deliver to KA goods and chattels aforesaid, and enfeoff KA with the aforesaid messuage; that KA should then give them a general acquittance; that they should then give KA a general acquittance; and because the late WA, at the time of his death, was owed at least 100m by diverse men, GK & Thomas Haket as executors of will of WA ought to prosecute at least 100m of those debts and pay the same 100m to KA.
