Barlow's Bill.

The Lord Scarsdale reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting Part of the Estates in the Town and County of Southampton, devised by the Will of Benjamin Barlow deceased, in Trustees to be sold; and for laying out the Purchase Money in another Estate, to be settled in Lieu thereof to the same Uses," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Methley Enclosure Bill.

The Lord Scarsdale made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act for dividing and enclosing the Commons, Common Fields, Wastes and other Commonable Lands and Grounds, within the Manor and Parish of Methley in the County of York," was committed.

Moor Monkton Enclosure Bill.

The Lord Scarsdale also reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing a Common, and certain other Open Grounds, in the Township and Parish of Moor Monkton, in the County of the City of York," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made some Amendments thereto."

Which Amendments were read by the Clerk as follow; (videlicet)

Pr. 3. L. 25. Leave out ("Tenth") and insert ("Ninth")

Courts of Conscience Bill.

A Message was brought from the House of Commons, by Mr. Bastard and others:

With a Bill, intituled, "An Act for regulating the Time of the Imprisonment of Debtors, imprisoned by Process from Courts instituted for the Recovery of Small Debts; for abolishing the Fees of Gaolers and others, in the Cases of such Imprisonment; and for ascertaining the Qualifications of the Commissioners;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Ordered, That the said Bill be printed.

Godstone Road Bill.

A Message was brought from the House of Commons, by Mr. Medley and others:

With a Bill, intituled, "An Act to enlarge the Term and Powers of Two Acts, made in the Fourth Year of the Reign of King George the Second, and the Sixth Year of the Reign of His present Majesty, for repairing the Road from Godstone in the County of Surrey, to Highgate in the Parish of East Grinstead in the County of Sussex;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Petition of Debtors in King's Bench Prison, praying Relief.

Upon reading the Petition of the Debtors consined in the King's Bench Prison, in Behalf of themselves and several Thousand Debtors and Fugitives, either pining in Gaols at Home, or wandering in Exile Abroad, whose Names are thereunto subscribed, praying their Lordships, for the Reasons therein mentioned, "To interpose their Legislative Authority, to shield them from the Vengeance of their vindictive Creditors, who inhumanly consine and banish their unfortunate Debtors, without a Prospect of Benefit to themselves, and to the Destruction of the Petitioners and their Families, trusting that the Horrors of the long Consinement of their Lordships' Petitioners, the Cries of their Wives and Children, will draw forth their Mercy and effect their Prayer:"

It is Ordered, That the said Petition do lie on the Table.

Ld. Stourton's Estate Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for enabling the Right Honourable Charles Philip Lord Stourton, and the Right Honourable Mary Lady Stourton his Wife, the Right Honourable Hugh Lord Clifford and the Right Honourable Appollonia Lady Clifford his Wife, and Robert Butler Esquire and the Honourable Elizabeth Butler his Wife, to charge their Estates at Holme in the East Riding of the County of York, with a competent Sum of Money, for the Purpose of improving the same, and also to grant Building and other Leases of the said Estates, and of their other Estates in the Counties of York and Stafford."

East India Regulation Bill, Petition of Inhabitants of Fort Saint George respecting.

Upon reading the Petition of the British Inhabitants of the Presidency of Fort Saint George in the East Indies, and its Dependencies, whose Names are thereunto subscribed, complaining of certain Clauses in an Act of Parliament passed in the 24th Year of His present Majesty, intituled, "An Act for the better Regulation and Management of the Affairs of the East India Company, and for establishing a Court of Judicature for the more speedy and effectual Trial of Persons accused of Offences committed in the East Indies, by which their Persons and Properties are subject to much Vexation, Inconvenience, and Distress;" and praying their Lordships, as Hereditary Guardians of the Rights and Liberties of all British Subjects, "To vote a Repeal of those Clauses in the said Act of Parliament, which have given such just Cause of Uneasiness and Alarm to the Petitioners, and that their Lordships will be pleased to grant such further and general Relief in the Premises, as to their Lordships shall seem meet:"

It is Ordered, That the said Petition do lie on the Table.

Whichcote's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for vesting Part of the Estate of Thomas Whichcote Esquire, deceased, in the County of Lincoln, in Trustees for Sale, to pay off Incumbrances affecting the same, and for other Purposes therein mentioned."

Rich's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for vesting Part of the settled Estates of John Rich Gentleman, and Elizabeth his Wife, in the Counties of Leicester and Warwick, in Trustees to be sold, and for applying the Money arising therefrom in Payment of Incumbrances, under the Direction of the Court of Chancery, and for laying out the Surplus of such Money in the Purchase of other Estates, to be settled to the same Uses."

Stanhope's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for vesting Part of the settled Estates of Walter Stanhope and John Shuttleworth Esquires, in the Counties of York and Derby, in Trustees to be sold, and for laying out the Purchase Money in other Estates, to be settled to the same Uses; and for enabling the Tenants for Life to grant building and repairing Leases, and for confirming the Election made between the said Parties, respecting the said Estate."

Williamson or Wareing's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for vesting an undivided Moiety (being the settled Estate of Samuel Williamson a Lunatic) of and in certain Lands in Liverpool, in the County of Lancaster, in Trustees to be sold, with the Approbation of the Court of Chancery, and for laying out the Money arising therefrom in the Purchase of other Estates, to be settled to the same Uses."

Ordered, That the said Bill be committed to the Consideration of the Lords Committees aforenamed:

Stourbridge Canal Bill.

Hodie 1a vice lecta est Billa, intituled, "An Act for making and maintaining a Navigable Canal from the Stourbridge Canal Navigation to the River Severn near to the City of Worcester, and for varying certain Rates or Dues granted to the Company of Proprietors of the Stourbridge Canal Navigation; and for removing Shoals in the River Severn between the Cities of Worcester and Gloucester, and for other Purposes therein mentioned."

Moved, "That the said Bill be read a Second Time on this Day se'nnight."

The Question was put thereupon?

It was resolved in the Affirmative.

E. Cork et al. Petition to receive Judges' Report:

Upon reading the Petition of the Right Honourable Edmund Earl of Cork and Orrery in the Kingdom of Ireland, and Baron Boyle of Marston in the County of Somerset, and others; setting forth, "That the Petitioners have lately presented a Petition to their Lordships for Leave to bring in a private Bill, and that their Lordships have been pleased to refer the said Petition to two Judges; that unfortunately for the Petitioner the said Earl of Cork, the Reverend Mr. Clark one other of the Petitioners whose Attendance before the Judges was necessary, did not arrive in Town till Thursday the 27th Day of April last, whereby the Petitioners were prevented from getting the Report upon their said Petition from the Judges within the Time limited by their Lordships' Order; that the Judges, to whom the said Petition was referred, have, in pursuance of their Lordships' Order, made their Report, and have signed the Bill;" and therefore praying, "That, under the special Circumstances above set forth, their Lordships will please to permit the Judges' Report to be received, though out of Time:"

It is Ordered, That the said Report from the Judges be received, as desired.

Accordingly, after reading and considering the Report of the Judges, to whom was referred the Petition of the Right Honourable Edmund Earl of Cork and Orrery in the Kingdom of Ireland and Baron Boyle of Marston in the County of Somerset, and others, praying Leave to bring in a private Bill for the Purposes therein mentioned:

Land Tax Commissioners Bill.

A Message was brought from the House of Commons, by Mr. Steele and others:

With a Bill, intituled, "An Act for appointing Commissioners for putting in Execution an Act of this Session of Parliament, intituled, "An Act for granting an Aid to His Majesty by a Land Tax to be raised in Great Britain, for the Service of the Year One thousand seven hundred and eighty-six;" to which they desire the Concurrence of this House.

The said Two Bills were, severally, read the First Time.

Margate Playhouse Bill:

Hodie 1a vice lecta est Billa, intituled, "An Act to enable His Majesty to licence a Playhouse within the Town and Port of Margate in the Isle of Thanet in the County of Kent, under certain Restrictions therein limited."

Petition against.

Upon reading the Petition of the several Persons whose Names are thereunto subscribed, Inhabitants of the Town of Margate in the County of Kent, taking Notice of the last-mentioned Bill, and praying their Lordships, for the Reasons therein mentioned, "Not to pass the said Bill, and that, if necessary, the Petitioners may be allowed to be heard by their Counsel at the Bar of their Lordships, in Opposition to a Measure of so alarming a Tendency, and so injurious to the Inhabitants:"

Ld. Milton's Estate Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act to enable the surviving Parties to certain Articles of Agreement made previous to the Marriage of the Honourable John Damer, deceased, with the Honourable Ann Seymour Conway (now Ann Damer, Widow) to insert in the Settlement to be executed in pursuance of the said Articles, proper Powers for raising the Sum of Forty Thousand Pounds for the Purposes in the said Articles mentioned."

Ordered, That the said Bill be committed to the Consideration of the Lords Committees aforenamed:

Rolle's Bill.

Ordered, That the Committee to whom the Bill, intituled, "An Act for vesting Part of the settled Estates of Denys Rolle and John Rolle Esquires, in Trustees upon Trust to sell the same, and to purchase Estates contiguous to the principal Estates of the said Denys Rolle and John Rolle, to be settled to the Uses of the Estates vested in Trustees for Sale," stands committed, be revived, and meet on Monday the 8th Day of this instant May.

Stourbridge Canal Bill, Petitions against.

Upon reading the Petition of the Honourable Andrew Foley (the Survivor of the Devisees in Trust of Thomas Lord Foley, deceased), and also of the other Persons whose Names are thereunto subscribed, Owners or Occupiers of several Forges, Iron Works, Corn and other Mills upon certain Brooks or Streams commonly called Belbroughton and Barnett Brooks, or which slow into and compose the same, and of several other Forges, Iron Works, Paper, Corn, and other Mills upon certain Brooks or Streams commonly called Churchill, Hurcott, and Broadwater Brooks, or which flow into and compose the same, in the County of Worcester; and likewise of the Owners or Occupiers of Lands adjoining or near to or interested in such Brooks, Streams, or Rivulets:

Also, upon reading the Petition of the several Persons whose Names are thereunto subscribed, Owners or Occupiers of several Corn, Cotton, Needle, Paper, Cloth, Leather, and other Mills and Waterworks upon the several Brooks, Streams, and Rivulets in and near the Towns of Broomsgrove and Droitwich in the County of Worcester, which afterwards communicate with the River Severn at and near Hawford Bridge in the same County, and also of the Owners or Occupiers of Lands and Estates adjoining or near to such Brooks, Streams, or Rivulets, or interested therein:

And also, upon reading the Petition of the Manufacturers, Forge Men, Labourers, and others, employed at the several Forges, Iron Works, Cotton Manufactory, Corn, Needle, Paper, Leather, and other Mills and Works upon certain Brooks, Streams, and Rivulets lying between the Stourbridge Canal Navigation and the City of Worcester and the Neighbourhood thereof, whose Names are thereunto subscribed, taking Notice of a Bill depending in this House, intituled, "An Act for making and maintaining a Navigable Canal from the Stourbridge Canal Navigation to the River Severn near to the City of Worcester, and for varying certain Rates or Dues granted to the Company of Proprietors of the Stourbridge Canal Navigation, and for removing Shoals in the River Severn between the Cities of Worcester and Gloucester, and for other Purposes therein mentioned;" and severally praying their Lordships, "That the said Bill may not pass into a Law, and that they may be heard by their Counsel against the same at their Lordships' Bar, and may be otherwise relieved in the Premises as to their Lordships shall seem meet:"

It is Ordered, That the Petitioners be at Liberty to be heard by their Counsel against the said Bill at the Second Reading thereof, on Monday the 8th Day of this instant May, as also Counsel be heard for the said Bill at the same Time, if they think fit.

Causes put off.

Ordered, That the Hearing of the Cause, wherein Messieurs Caddells and Sons Merchants in Cockenzie are Appellants, and Margaret Cadell and others are Respondents, which stands appointed for this Day, be adjourned to Monday the 15th Instant, and that the rest of the Causes on Cause Days be removed in Course; and that the Cause which stands appointed for To-morrow be adjourned to Tuesday the 16th Instant; and that the Cause which stands appointed for Thursday next be adjourned to Thursday the 18th Instant.

Upon reading the Petition as well of the Right Honourable Thomas Lord Foley Baron of Kidderminster in the County of Worcester, and of Samuel Skey Esquire, as of the other Persons whose Names are thereunto subscribed; setting forth, "That an Application to Parliament hath been in Agitation a considerable Time for Leave to bring in a Bill for perfecting and compleating an Exchange and Sale of divers Lands and Premises in the County of Worcester, which had been contracted and agreed for between Thomas Lord Foley deceased, and the Petitioner Samuel Skey, and which they had respectively taken the Possession of and held and occupied from the Time such Contract had been entered into between them, but the proper Application could not be regularly made without all the Parties interested attending and giving their Consent; and as the Earl of Clanbrassil and the Countess of Clanbrassil his Wife, being Persons materially interested, commonly live and reside in Ireland, are now in England, and ready and willing to attend and give their Consent to the said Bill, but the Petitioners have been informed that they will return to Ireland about the latter end of this Year, and may not come to England again for several Years; it has therefore been thought expedient to endeavour to obtain an Act for the Purposes aforesaid; but the Day appointed for receiving Reports upon Petitions for private Bills from the Judges being past;" the Petitioners therefore humbly pray their Lordships, "That Leave may be given to present a Petition for effecting the aforesaid Proposal of the said Petitioners in such Manner as to their Lordships shall seem meet, notwithstanding the Time limited for receiving Reports from the Judges is expired:"

Stourbridge Canal Bill.

The Order of the Day being read for the further Consideration of the Bill, intituled, "An Act for making and maintaining a navigable Canal from the Stourbridge Canal Navigation to the River Severn, near to the City of Worcester; and for varying certain Rates or Dues granted to the Company of Proprietors of the Stourbridge Canal Navigation; and for removing Shoals in the River Severn between the Cities of Worcester and Gloucester; and for other Purposes therein mentioned;" and for hearing Counsel for and against the same:

Counsel were accordingly called in.

And John Harris, William Edwards, Richard Parker, Samuel Twamley, Jacob Turner, Henry Pratt, Thomas Jacob White, James Parker, William Jessop, and George Young, were severally called in, sworn, and examined for the Petitioners against the said Bill.

Then Mr. Lane was heard for the Petitioners against the said Bill.

The Counsel were directed to withdraw.

Ordered, That the further Consideration of the said Bill be put off till To-morrow, and that the Counsel be called in at Half past Two o'Clock.

Pawnbrokers' Bill.

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act for providing a proper Workhouse, and better regulating the Poor within the Parish of Romford, in the Liberty of Havering Atte Bower in the County of Essex," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Coventry Canal Bill.

The Lord Scarsdale made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act to enable the Company of Proprietors of the Coventry Canal Navigation, to complete the said Canal to Fradley Heath in the County of Stafford, and for other Purposes therein mentioned," was committed.

Brimington, &c. Roads Bill.

The Lord Scarsdale made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act for enlarging the Term and Powers of an Act, made in the Sixth Year of the Reign of His present Majesty King George the Third, intituled, "An Act for repairing and widening the Roads from Brimington and Chesterfield, in the County of Derby, over the High Moors, to the several Places therein mentioned," was committed.

Rolle's Bill.

The Lord Scarsdale also reported from the Lords Committees, to whom the Bill, intituled, "An Act for vesting Part of the settled Estates of Denys Rolle and John Rolle Esquires, in Trustees upon Trust to sell the same, and to purchase Estates contiguous to the principal Estates of the said Denys Rolle and John Rolle, to be settled to the Uses of the Estates vested in Trustees for Sale," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made One Amendment thereto."

Which Amendment, being read Twice by the Clerk, was agreed to by the House.

Ordered, That the said Bill, with the Amendment, be engrossed.

Edinburgh Streets Bill.

Foley for Leave to present a Petition for a Divorce Bill:

Upon reading the Petition of the Honourable Edward Foley; setting forth, "That the Petitioner having obtained a Verdict at Law with £2,500 Damages, against the Earl of Peterborough and Monmouth, for criminal Conversation and Adultery with Lady Ann Foley, his Wife, the Petitioner instituted a Suit in the Consistory Court of the Bishop of London against the said Lady Ann, for a Divorce from Bed, Board, and mutual Cohabitation, and on the 6th of this instant May obtained a Sentence in the said Court: That the Petitioner proposed to apply to Parliament for a Bill to dissolve his Marriage, and should he be deprived of the Benefit of this Session, he not being able to make an earlier Application, would be greatly injured;" and therefore praying their Lordships, " That Leave may be given to present a Petition for the above Purpose, though the Time limited for receiving Petitions for private Bills is expired:"

It is Ordered, That the Petitioner be at Liberty to present his said Petition, as desired.

Leave for a Divorce Bill.

Accordingly, Upon reading the Petition of the Honourable Edward Foley, praying Leave to bring in a Bill, " To dissolve his Marriage, and for vacating a Settlement made upon Lady Ann Foley in the Petition mentioned, and making her such Provision in Lieu thereof as shall be deemed reasonable, and to give the Petitioner such other Relief, as to their Lordships shall seem meet:"
