Bruce against Cleghorns.

Upon reading the Petition of William Bruce, Appellant in a Cause depending in this House, to which Robert Cleghorn and Alexander Cleghorn are Respondents, which stands appointed for Hearing, setting forth, "That the Petitioner having lately changed his Agent, he found that in the Appeal the Dates of Three of the Interlocutors of the 22d of November 1777, the 19th of June 1778, and the 18th of February 1779, have been omitted, and also an Interlocutor of the Lord Ordinary, of the 14th of November 1781, is omitted;" and therefore praying their Lordships, "That he may be at Liberty to amend his said Appeal, by inserting the Dates of the said Three Interlocutors, and also by inserting the said Interlocutor of the Lord Ordinary, of the 14th of November 1781, he amending the Respondent's Copy:"

It is Ordered, That the Petitioner be at Liberty to amend his said Appeal, by inserting the Dates of the said Interlocutors, and also by inserting the Interlocutor of the 14th of November 1781, as desired, he amending the Respondent's Copy.

Fraseragainst Lord Advocate for Scotland.

Upon reading the Petition of Archibald Fraser of Lovat Esquire, Appellant in a Cause depending in this House, and of His Majesty's Advocate for Scotland, Respondent thereto, which stands appointed for Hearing, setting forth, "That both the Parties in this Cause are desiorus that the Hearing thereof should for some Time be postponed;" and therefore praying, "That the Hearing of this Cause be postponed till the first Cause Day after Easter:"

It is Ordered, That the Hearing of the said Cause be put off till the first Cause Day after Easter, as desired.

This Day Augustus Henry Duke of Grafton, and Henry Lord Stawell, took the Oaths and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes.

Salop Roads Bill.

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act for continuing the Term and Powers of an Act, made in the Fourth Year of His present Majesty's Reign, for repairing several Roads leading from the Buck's Head at Watling Street to Beckbury and the New Inn, and from the Birches Brook to the Hand Post in the Parish of Kemberton, in the County of Salop, and for making the same more effectual," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to Report the same to the House, without any Amendment."

Whitchurch Road Bill.

The Lord Scarsdale made the like Report from the Lords Committees, to whom the Bill, intituled, "An continue the Term and alter and enlarge the Powers of an Act, made in the Seventh Year of His present Majesty's Reign, to repair and widen the Roads from Whitchurch, in the County of Salop, to the Turnpike Road between Nantwich, in the County of Chester, and Newcastle-under-Lyne, and from Hinstock to Nantwich aforesaid," was committed.

Newfound land Trade Bill.

The Order of the Day being read for the Second Reading of the Bill, intituled, "An Act for confining for a limited Time, the Trade between the Ports of the United States of America, and His Majesty's Subjects in the Island of Newfoundland, to Bread, Flour, and Live Stock, to be imported in none but British built Ships, actually belonging to British Subjects, and navigated according to Law, clearing out from the Ports of His Majesty's European Dominions, and furnished with a Licence according to the Form hereunto annexed;" and for the Lords to be summoned:

The said Bill, was accordingly read a Second Time.

With a Bill, intituled, "An Act for continuing an Act of the Sixth Year of His present Majesty, for amending, and widening the Road from the Town of Biddenden in the Weald of Kent, through the Towns of Smarden and Charing, to join the Turnpike Road which leads from Ashford to Feversham, at a Place called Bound Gate; to which they desire the Concurrence of this House.

Rotherham Road Bill.

A Message was brought from the House of Commons, by Mr. Knight and others:

With a Bill, intituled, "An Act for enlarging the Term and Powers of an Act made in the Fourth Year of the Reign of King George the Third, intituled, An Act for amending, and widening the Road from the South End of the Town of Rotherham, in the County of York, to the present Turnpike Road near Pleasley, in the County of Derby, and also the Road from the North End of the said Town of Rotherham, into the present Turnpike Road on the East Side of Tankersley Park, in the said County of York, so far as the same relates to the Road, leading from Rotherham aforesaid, to the Turnpike Road near Pleasley aforesaid;" to which they desire the Concurrence of this House.

Doncaster Road Bill.

A Message was brought from the House of Commons, by Mr. Knight and others:

With a Bill, intituled, "An Act for enlarging the Term and Powers of an Act, made in the Fourth Year of the Reign of King George the Third, intituled, An Act for amending, and widening the Road from Tinsley, in the County of York, to the Town of Doncaster in the said County;" to which they desire the Concurrence of this House.

The said Three Bills were, severally, read the First Time.

Cotes' Petition referred to Judges.

Upon reading the Petition of John Cotes of Woodcote in the County of Salop Esquire, Devisee for Life of the real Estates therein mentioned; Charles Cotes, James Cotes, Thomas Cotes, and Washington Cotes, the younger Brothers of the said John Cotes, respectively remainder-men for Life of the same Estates, with Remainder to their First and other Sons in Tail-Male, praying Leave to bring in a Bill for the Purposes in the said Petition mentioned:

It is Ordered, That the Consideration of the said Petition be and is hereby referred to the Lord Chief Baron of the Court of Exchequer, and Mr. Justice Gould, who are forthwith to summon all Parties concerned in the Bill, and after hearing them are to report to the House the State of the Case, with their Opinion thereupon under their Hands; and whether all Parties who may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Grove et al. against Sir J. Grant et al.

A Petition of Martha Grove and others, Appellants in a Cause depending in this House, to which Sir James Grant Baronet and others are Respondents, was presented and read, setting forth, That this Cause was only set down for hearing on Wednesday the 16th instant; that from so many Causes which stood in the Paper before it being put off, the same will stand for hearing in Course on Friday next: That the Petitioner's Scotch Counsel, who is engaged to argue this and another Cause, wherein similar Points of Scotch Law occur, is now engaged in the Court of Session, but will be in London at the ending of the Term of the said Court: That as the necessary Papers are not arrived from Scotland, the Appellants cannot be prepared for the Hearing in so short a Time, and as no Inconveniency can arise from a few Weeks Delay to either Party, the Petitioners humbly pray their Lordships to put off the Hearing of this Cause to Wednesday the 23d Day of March next, or such other Day in the present Session as to their Lordships shall seem proper."

And thereupon the Agents on both Sides were called in and heard at the Bar, and being withdrawn:

Pincke and Thornycroft against Thornycroft:

After hearing Counsel as well on Monday the 21st, and Friday the 25th, as this Day, upon the Petition and Appeal of Alured Pincke Esquire, and Anne Thornycroft Spinster, complaining of a Decree or Order of Dismission of the Court of Chancery of the 2d of July 1783, and praying, "That the same might be reversed or varied; or that the Appellants might have such other Relief in the Premises as to this House, in their Lordships' great Wisdom, should seem meet;" as also upon the joint and several Answer of Edward Thornycroft Esquire, Ann Thornycroft, and Eleanor Thornycroft, put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause:

Decree reversed with Directions.

It is Ordered and Adjudged by the Lords Spiritual and Temporal in Parliament assembled, That the said Decree or Order of Dismission complained of in the said Appeal be and the same is hereby reversed: And it is further Ordered and Adjudged, That the Bill be retained in the said High Court of Chancery for Twelve Months from this Time, or so much longer as the said Court shall, on future Circumstances to arise in the Cause, think fit to order; and that the Plaintiff shall be at Liberty, in the mean Time, to bring such Action or Actions at Law, as he shall be advised for Recovery of the Lands and other Premises mentioned in the Pleadings: And it is further Ordered and Adjudged, That the Defendant Edward Thornycroft do, on or before the last Day of Easter Term next, produce before and leave with One of the Masters of the said Court (to be appointed for that Purpose by the Court) upon Oath, the Deeds of the 8th and 9th Days of May 1745, mentioned in the Pleadings, and all other Deeds, Writings, and Muniments respecting the Title of the Testatrix above in the Pleadings named to the said Lands and Premises in his Custody or Power: And it is further Ordered and Adjudged, That the Plaintiff shall be at Liberty to inspect the same in the Hands of the said Master; and to take Copies thereof, or of such Part thereof as he shall be advised at his own Expence: And it is further Ordered and Adjudged, That such of the said Deeds, Writings, and Muniments as either Side shall give Notice to have produced at the Trial of the said Action, shall be produced accordingly: And it is further Ordered and Adjudged, That the said Defendant, Edward Thornycroft, shall not be at Liberty in such Action or Actions, or any Trial to be had thereon, to set up the Trust Term mentioned in the Deeds of the 15th and 16th of March 1722, and 18th Day of June 1741, or any other unsatisfied Term or Terms outstanding, in the Hands of any other Persons than the said Defendant: And it is further Ordered and Adjudged, That the said Defendant Edward Thornycroft shall not insist in such Action or Actions, or in any Trial to be had thereon on the said Fine mentioned in the Pleadings, or on any Non-claim which may have ensued thereon, or on any other Fine or Non-claim which may have incurred since siling the original Bill in this Cause: And it is further Ordered and Adjudged, That in Case the Plaintiff shall not bring such Action or Actions, and proceed to Trial thereon within the Time aforesaid, the Plaintiff's Bill shall stand dismissed out of Court with Costs, as the said Court shall direct; but in Case the Plaintiff shall bring such Action, and proceed to Trial within the Time aforesaid: Then it is further Ordered and Adjudged, That the Consideration of Costs, and of all further Directions, shall be reserved in and to the said High Court of Chancery, till after the Trial and Determination of the said Action or Actions: And it is further Ordered and Adjudged, That all Parties shall be at Liberty to apply to the said Court of Chancery, as they shall be advised.
