Halifax, &c. Small Debts Bill.

Derby to Brassington Road Bill.

With a Bill, intituled, "An Act for repealing so much of Three Acts, made in the Eleventh, Seventeenth, and Thirty-third Years of the Reign of King George the Second, for repairing several Roads leading to and from the Town of Derby in the County of Derby, as relates to the Road leading from the North Side of Cavendish Bridge in the said County of Derby, through the said Town of Derby to Brassington in the said County; and for making more effectual Provision for the Repair of the said Road;" to which they desire the Concurrence of this House.

With a Bill, intituled, "An Act for continuing the Term and Powers of an Act, made in the Twenty-ninth Year of the Reign of His late Majesty, for repairing and widening the Road from the Eighteen Mile Stone beyond Willoughby Hedge through the Town of Mere in the County of Wilts, and through Wincanton to Charlton Houthorn, and from thence to Milborne Port, and from Willoughby Hedge aforesaid to the West End of Long Lane in Kilmington; and from Wincanton aforesaid to the Sherborn Turnpike Cross Gate on Cattle Hill; and from Wincanton to Sparkford in the County of Somerset;" to which they desire the Concurrence of this House.

Saltash Road Bill.

A Message was brought from the House of Commons, by Sir Charles Whitworth and others:

With a Bill, intituled, "An Act for continuing the Term and enlarging the Powers of an Act made in the Second Year of the Reign of His present Majesty, for repairing and widening several Roads in the Counties of Cornwall and Devon, leading to the Borough of Saltash, in the County of Cornwall;" to which they desire the Concurrence of this House.

Chester Playhouse Bill.

Coals, to prevent Frauds in Admeasurement of, Bill.

A Message was brought from the House of Commons, by Mr. Alderman Oliver and others:

With a Bill, intituled, "An Act for continuing for a limited Time, an Act made in the Seventh Year of the Reign of His present Majesty, to prevent Frauds and Abuses in the Admeasurement of Coals sold by Wharf Measure within the City of London and the Liberties thereof; and between Tower Dock and Limehouse Hole in the County of Middlesex;" to which they desire the Concurrence of this House.

The said Ten Bills were, severally, read the First Time.

Kilborn's Petition for a Name Bill:

Upon reading the Petition of William Kilborn, of Bruntingthorp in the County of Leicester, Gentleman, praying Leave to bring in a Bill to enable him and his Issue Male to take and use the Surname of Burrowes, pursuant to the Will of John Burrowes deceased:

It is Ordered, That Leave be given to bring in a Bill according to the Prayer of the said Petition:

Bill read.

Accordingly, The Lord Scarsdale presented to the House a Bill, intituled, "An Act to enable William Kilborn and his Male, to take and use the Surname of Burrowes, pursuant to the Will of John Burrowes deceased."

The said Bill was read the First Time.

Brent Bridge to Gasking Gate Road Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act for continuing the Term and enlarging the Powers of an Act, made in the Thirty-First Year of the Reign of His late Majesty, for repairing the High Road leading from Brent Bridge in the County of Devon, to Gasking Gate, in or near the Borough of Plymouth in the said County."

The Question was put, "Whether this Bill shall pass?"

It was resolved in the Affirmative.

Message to H. C. that the Lords have agreed to it.

A Message was sent to the House of Commons, by Mr. Montague and Mr. Eames:

To acquaint them, That the Lords have agreed to the said Bill, without any Amendment.

Baldwyn and Childe Leave for a Bill:

After reading and considering the Report of the Judges, to whom was referred the Petition of Charles Baldwyn Esquire, for and on Behalf of himself and his infant Son; and also of William Childe Esquire, his eldest Son and Heir Apparent; praying Leave to bring in a Private Bill for the Purposes therein mentioned:

Bala and Dolgelley, &c. Road Bill.

A Message was brought from the House of Commons, by Sir Watkin Williams Wynne and others:

With a Bill, intituled, "An Act for repairing and widening several Roads leading to and from the Towns of Bala and Dolgelley in the County of Merioneth, and other Roads therein mentioned, in the Counties of Montgomery, Denbigh, and Salop;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Message from H. C. to return Ladbroke's Bill:

A Message was brought from the House of Commons, by Mr. Gascoyne and others:

To return the Bill, intituled, "An Act for vesting certain Estates of Robert Ladbroke Esquire, in the City of London, and Counties of Middlesex, Northampton, Berks, and Warwick, in Trustees to be sold; and for laying out the Monies to arise thereby in the Purchase of other Manors, Lands, and Hereditaments, to be settled to the same Uses as the said settled Estates now stand limited;" and to acquaint this House, That they have agreed to the same, without any Amendment.

and Harris's Divorce Bill, with an Amendment.

A Message was brought from the House of Commons, by Mr. Whitworth and others:

To return the Bill, intituled, "An Act to Dissolve the Marriage of John Potter Harris Esquire, with Elizabeth Martha Chicheley Plowden his now Wife, and to enable him to marry again; and for other Purposes therein mentioned;" and to acquaint this House, That they have agreed to the same, with One Amendment, to which they desire their Lordships Concurrence.

The House proceeded to take into Consideration the Amendment made by the Commons to the said Bill:

And the same being read Three Times by the Clerk; was agreed to by the House: And,

A Message was sent to the House of Commons, by the former Messengers, to acquaint them therewith.

Halifax, &c. small Debts Bill; King's Content signified.

The Earl of Clarendon acquainted the House, "That His Majesty having been informed of the Contents of the Bill, intituled, "An Act for the more easy and speedy Recovery of small Debts within the Parishes of Halifax, Bradsord, Kighley, Bingley, Guiseley, Calverley, Batley, Birstal, Mirfield, Hartishead cum Clifton, Almondbury, Kirkheaton, Kirkburton, and Huddersfield, and the Lordship or Liberty of Tong in the West Riding of the County of York; and for extending the Jurisdiction of the Courts Baron of the Honour of Pontefract, Manor of Wakefield, and Manor of Bingley in the said County;" was pleased to consent (as far as His Majesty's Interest is concerned), that their Lordships may proceed therein as they shall think fit."

Speirs et al. against Dunlops et al. et. contra:

The House being moved, "That a Day may be appointed for hearing the Cause wherein Alexander Speirs and others are Appellants, and Thomas and William Dunlops and others, Trustees for the Creditors of John Carlyle and Company, Merchants in Glasgow, are Respondents, et e contra, ex-parte; the Respondents not having put in their Answer thereto, though peremptorily ordered so to do:"

It is Ordered, That this House will hear the said Cause ex-parte by Counsel at the Bar, on the first vacant Day for Causes after those already appointed, unless the Respondents put in their Answer thereto in the mean Time.

Standing Order, No. 126, to be considered, and Accountant General to attend.

The House was moved, "That the Order of this House of the 5th of this Instant March, appointing a Committee of all the Lords who have been or shall be present this Session, to take into Consideration so much of the Standing Order, No. 126, which directs the Money arising by the Sale of Lands, as is to be laid out in a new Purchase, when no such Purchase is ready, to be paid into the Bank of England in the Name of the Accountant General of the Court of Chancery, to remain there without Interest until a proper Purchase can be got and approved of, and to report their Opinion thereupon, might be read:"

The same was accordingly read by the Clerk.

Ordered, That the said Order be discharged.

Ordered, That the House be put into a Committee on Monday next, to consider of so much of the Standing Order, No. 126, which directs the Money arising by the Sale of Lands as is to be laid out in a new Purchase, when no such Purchase is ready, to be paid into the Bank of England in the Name of the Accountant General of the Court of Chancery, to remain there without Interest until a proper Purchase can be got and approved of; and that the Lords be summoned; and that the Accountant General of the Court of Chancery do attend the said Committee of the whole House on Monday next.

Braithwaite's Divorce Bill.

The Order of the Day being read for the Second Reading of the Bill, intituled, "An Act to Dissolve the Marriage of John Braithwaite Esquire, with Elizabeth Browne his now Wife, and to enable him to marry again; and for other Purposes therein mentioned;" and for hearing Counsel for and against the same, and for the Lords to be summoned:

Counsel on both Sides were called in, and the said Bill was read a Second Time.

Mr. Selwyn was heard in Support of the Bill, and to make out the Allegations thereof; and in order to prove the Marriage, called,

The Reverend Mr. Thomas Winstanley; who, being sworn, acquainted the House, "That he married Mr. and Mrs. Braithwaite at Saint Margaret's Church, Westminster, on the 13th of April 1761; that he was acquainted with both of them; that they lived together for some Time at Point Pleasant, and cohabited as Man and Wife; that Mr. Braithwaite went soon after to join his Regiment at Gibraltar; that Mrs. Braithwaite followed him there, and that they lived together there for about Seven Years; that about the Year 1768 they returned to England, and lived in Bridge Street and other Places, and cohabited together as Man and Wife."

He was directed to withdraw.

Then Mark Holman, Deputy Register of the Consistory Court of the Bishop of London, was called in; and, being sworn, produced the original Definitive Sentence of Divorce in the said Court, against the said Mrs. Braithwaite, for the Crime of Adultery with a Person or Persons unknown.

He was directed to withdraw.

Then John Crawfurd Surgeon was called in; and, being sworn, acquainted the House, "That in the beginning of the Year 1769, he sailed with Major Braithwaite in the Middlesex East Indiaman for India; and that they arrived at Bencoolen in August in the same Year; that Mrs. Braithwaite did not go with the Major, but was left in England; that he continued with the Major at his House in Bencoolen for about a Month, when he the Witness went to Bombay, and left the Major at Bencoolen."

He was directed to withdraw.

Then William Petrie Esquire was called in; and, being sworn, acquainted the House, "That he was Paymaster of the Army in India; that he knew Major Braithwaite from August 1771 to July 1775 in India, where he continued all that Time; that from the frequent Opportunities he had of seeing Major Braithwaite, he knew it was impossible for Major Braithwaite to have been in England during that Time; and that his Wife was not with him all the Time he was in India; that he sailed with the Major from India in July 1775, and that in their Passage they touched at the Island of Mauritius and at the Cape of Good Hope."

He was directed to withdraw.

Then Captain James Rice, of the Northumberland East Indiaman, was called in; and, being sworn, acquainted the House, "That he brought Major Braithwaite from the Cape of Good Hope in December 1775, to Lisbon, in March 1776, where he was drove by Distress; that waiting there some Time to refit, Major Braithwaite came from Lisbon to England in a Snow."

He was directed to withdraw.

Then Walter Farquhar Surgeon, was called in; and, being sworn, acquainted the House, "That he knew Mr. and Mrs. Braithwaite at Gibraltar, and had kept up an Acquaintance with them ever since, and attended Mrs. Braithwaite as a Surgeon; that Major Braithwaite went to India in the Year 1769, and left his Wife in London; that she continued to live in and about London, to his Knowledge, during the Absence of Mr. Braithwaite; that in the Year 1772, Mrs. Braithwaite applied to him, and acquainted him that she was with child, and that he, at her Desire, got her a private Lodging, a Nurse, and a Midwife; that she went to the Lodging, and that he was present when she was in Labour, but did not see her delivered; that he saw her soon after, and the Child, which was a Boy: That in about Five Hours after her Delivery she returned in a Chair to her Lodgings in Maddox Street; that the next Day the Child was sent to Nurse; that Mrs. Braithwaite soon after acquainted him, that her Breasts were very sore and inflamed, and that he procured a Person to draw her Breasts; that in the Year 1774, Mrs. Braithwaite applied to him, and told him she was again breeding; that she went to Egham to lie in, where she was delivered of a Daughter." Being asked, "If he knew who was the Father of the Children?" said, "he did not." Being again asked, "If he could safely upon his Oath say, he did not know, or had ever heard from Mrs. Braithwaite, who was the father?" said, "Yes."

He was directed to withdraw.

Then Hannah Onions was called in; and, being sworn, acquainted the House, "That she was employed by a Mr. Farquhar to attend a Lady in her Lying-in, in February 1773, at a private Lodging; that on the 25th of February 1773, Mrs. Braithwaite was delivered of a Son by Mrs. Taylor, a Midwife; that a few Hours after her Delivery, Mrs. Braithwaite went away in a Chair; that she the Witness attended Mrs. Braithwaite in another Lying-in at Egham, in July 1775, where she was delivered of a Daughter by a Doctor Stevenson at that Place."

She was directed to withdraw.

Then Ann Taylor Midwife was called in; and, being sworn, acquainted the House, "That she delivered Mrs. Braithwaite of a Son in February 1773, and that Hannah Onions was her Nurse."

She was directed to withdraw.

Then Mr. Selwyn, Counsel for the Bill, acquainted the House, "That Mr. Braithwaite had executed a Bond of Provision for Mrs. Braithwaite."

Then Mr. White, Counsel for Mrs. Braithwaite, acquainted the House, "That he should not give any Opposition to the Bill, and that she was satisfied with the Provision made for her."

The Evidence being finished;

The Counsel were directed to withdraw.

Ordered, That the said Bill be committed to a Committee of the whole House.

Ordered, That the House be put into a Committee upon the said Bill To-morrow.

The Lord Scarsdale (according to Order) reported the Amendments made by the Committee of the whole House to the Bill, intituled, "An Act to Dissolve the Marriage of John Braithwaite Esquire, with Elizabeth Browne, his now Wife, and to enable him to marry again; and for other Purposes therein mentioned."

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act for vesting Part of the settled Estates of Robert Grimston Esquire, at Thwing and Octon in the Parish of Thwing upon the Woulds, in the East Riding of the County of York, in the said Robert Grimston in Fee-Simple; and for settling an Estate of the said Robert Grimston, in the Township of Neswick in the Parish of Bainton, in the said East Riding of the County of York, of greater Value, in Lieu thereof; and for other Purposes," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Sir T. Broughton's Estate Bill.

The Lord Scarsdale made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act for Sale of Part of the settled Estate of Sir Thomas Broughton Baronet, situate in the County of Stafford, and purchasing other Estates, situate in the County of Chester, to be settled to the same Uses; and for extinguishing the said Sir Thomas Broughton's Power of making Leases for Lives, as to Part of his settled Estate in the County of Chester, and making such Recompence to him for the same, as therein is mentioned," was committed.

The Lord Scarsdale also reported from the Lords Committees, to whom the Bill, intituled, "An Act for continuing the Term, and enlarging the Powers of an Act made in the second Year of the Reign of His present Majesty, for repairing and widening several Roads in the Counties of Cornwall and Devon, leading to the Borough of Saltash, in the County of Cornwall," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Coals, to prevent Frauds in Admeasurement of, Bill.
