Item, that such Constable and Mareschal, as I shall depute and assigne for the Reule of the Kings Poeple that shal goo, may make suche Statuts and Ordenances as shall be thought necessaire and expedient for the good Gouvernance and Salvation of hem, the said Constable and Mareschal, and thaire Ordennances and Statuts to be obeied, under such Peines as shal be thought couvenable to be executed, freely and leefully in alle thaim that Disobeye, or that be punyshable, after the quantitee of the Offense; Considering that, for to lede overe eny Multitude of Poeple withoute Lawe to Reule hem by, were for to lese all or a greete partie of hem, whiche God defende.
Item, that the Admirall, or his Deputees, have souffisant Charge and Commandement to ordeine and brynge Shipping and Navire, suffisant for the faid Poeple at suche Ports, and at suche Tyme, as shall be advised and thoughr nacessaire, and at suche Wages as the King yeveth.
Item, as touching the Seconde, that is to say the Publication of the CRUCIAT, if any Man wol, oonly of Devotion and for Soule Heele, goo overe in the saide Expedition, that he may have fredom and licence for to goo, and under suche Proteccion as above; howe be it that myn entente is not, under colour of the said CRUCIAT, to suffre noo Religieux Men, namely in noo greete Nombre, or suche that I may have eny Conjecturation wolde take Benefice of the saide CRUCIAT, rather for to walke in Apostasie, than for desir of Merit, to goo over in the saide Expedition.
Item, that yoo, that wol oonly goo for to Reioisslie the Benefice of the saide CRUCIAT without Wages, stande under the Lawes, Statuts, and Ordennances to bee maad by the Constable and Mareschal as is abovesaid, aswell as thei that shall goo for Wages; Considered that, sith all be the King's People, it is necessarie to kepe under goode Reule, and preserve from all Meschiefs and Inconvenients, oon as oyer.
Item, I truste that my Souverain Lord and the Noble Lordes of his Conseil, Grauntyng yees Articles, as I trust to God ye wol, wol not naye me other things, lasse than theese, nedeful to
the Furthering therof, if eny suche come to mynde hereafter; for peraventure it cometh not to Remembrance now that wol hereafter, which shal algate be necessarie for the good and effectual spede of hem.
Thees be th'Answers yeven to my Lord the Cardinal &c. upon the Requestes maad by him unto the King on the behalve of oure Holy Fadre the Pope, for the weel Sustenyng, Defense, and Exaltation of the Christien Feith &c.
Furst, as toward the Publication of the CRUCIAT, and Fredom and Licence to be yeven to the Kings Subgitts to execucion of the meenes comprised therinne, to obtene by the Benefice of the same CRUCIAT;
It is conceived that the said meenes rest in two things,
Oon is the yifte of Goodes to be maad by the Kings Subgitts, in Promotion and Furyering of Godd's Cause and Querele ayenst the Hereticks &c. an oyer is the Personel goyng of the Kings Subgitts out of this Land, of theire oune Devotion, in the saide Godd's Cause and Querele.
And, as to the Furst, the King, by th'advis of his Counsail, agreeth him to that, that his Subgitts, that of Devotion wol yeve of theire Goodes to Furthering of the saide Cause, shall freely mowe do it with the Provision that followeth; that is to say,
That there be Deputed Persones notable and suffisant, the which shall receive alle the Goodes, so to be yeven of Devotion by the Kings Subgitts, the whiche Persones shall make feith, that they shall treuly certifie the King and his Conseil of alle theire Receits,
And, as ferforth as it shal stande in Gold and Silver, nought to passe out of this Land, but to be emploied, according to the Kings Lawes, in Merchandises, in suche wyse as it shal mowe by weye of Eschange be delivered in Paiement to theim of the Kings Subgitts, that shall be Waged in this Land to goo overe in the Cause of the Feith ayenst the said Heretikes.
Item, as toward the Personell goyng of the Kynges Subgittes out of this Land, of their Devotion, in the said Querele,
It is considered, on that oo part, that, for the nonn certaintee of the Nombre of hem that shall wol so to goo, my said Lord the Cardinal hath desired to have, without hem, by Licence of the King, vC. Speres, and vM. Bowes, at Wages.
And it is also Considered, on that other part, howe that the Poeple of this Land is Lessed and Decressed of late tyme, by Mortalite, Werres, and in other divers wyses, and namely of Defensable Men and Persons like for the Werre,
And, overe this, the greete necessitee that the King hath of suche Persones, for the Defense, keeping seure, and sauf Garde of his Reaumes, Landes, Lordships, and Subgittes, and in especial of this his Reaume,
So that it is thought right perillous and dangerous to suffre the Kings Poeple to paffe out of this Land, on eny other Behalve, to eny other Strange Cuntree, that is not of the Kings Obeissance,
Nevere the lesse, to the Worship of God, and Promotion of his saide Cause, and at the reverence and request of oure Holy Fadre the Pope, and spetial contemplation of my said Lord the Cardinal, that hath take upon him the Soliciting of the said Cause (whom whoos Estate, whoos Worship, Persone, and Seuretee it is well thought that the King and this Land, for many greete and evident couses, owen especially to tendre and considere) the King, by th'advis of his Conseil, is agreed to Licence his Subgittes, aswell suche as wol goo of Devotion, as suche as wol goo at Wage, to the Nombre of ccl. Speres, and iiM. Bowes in al, to passe out of this Lend, to emploie their Persones, in Godde's Service, in the Querele abovesaid, under the Conditions that ensuen;
Furst, that it like oure Holy Fadre the Pope to be good, gracieux, and tendre Fadre unto the King, to this Land, and to the Kings Subgittes of the same, and generally to alle the Kings Landes and Subgitz.
Item, that it like oure said Holy Fader, as toward good to be had in this Land, to Promotion of the saide Cause, to contente him with that, that the Kings Subgits, of the same Land, wol yeve yerton, of their especial Devotion;
and, in alle wyses, to forbere eny commune Charge to be born of eny of th' Estates of this Land, be it by the Clergie, or eny other.
Item, that, before the departyng of the King's said Subgittes out of this Land, ther be seen and shewed unto the King's Conseil here seuretee of weyes and meenes Resonable of Passage for the said King's Subgitts, out of this Land, to the Place that thei shul goo too, and Repassage for them fro thens ayen into this Reaume.
Item, that the King's Subgitts, that be now in his Reaume of France, entending to his Service there and to the Defense and Saufgarde of the same his Reaume, be not Stured, Admitted, ne Received to goo fro thens by my said Lord the Cardinal, or eny other as ferforth as he may lette it; Considering the greet Paril and Daunger, that myght falle to the Kyng in his said Royaume, by the Dispurveu, Departyng, or Withdraught of his Subgitts fro the same.
Item, that my Lord the Cardinal shal do his effectuel and notable diligence and devoir toward the King of Scotts, to make the King seure that the said King of Scotts shal holde him in Frendship and Reste with the King, his Lands and Subgittes, and namely with this Land, and to make him treuly and duely observe and kepe as well his Treus as other Appointmentz maad with the King, to the which he is bounden as wel by his Ooth, maad furst in this Land, and after him beyng at fredom in Scotland, as by his Lettres and his Seal:
And so, in conclusion, the King agreeth him to Execution of the said CRUCIAT, with and under the Conditions and Provision before rehersed, and to the PUBLICATION of the same, to be maad in alle the Places of this Land, where it shal be thought expedient to my said Lord the Cardinal:
In the whiche Publication it shall be openly declared, that the said CRUCIAT is so Published of the King's assent and Licence:
And, overie that, in the PUBLICACION of that part of the CRUCIAT, that toucheth tham that goon and expose her Persones in the saide Godde's Querele, it shal be openly declared that the King hath graunted his Assent and Licence to his Subgittes of this Land, so to goo in the saide Querele, for their Soule heel, in greet and notable Nombre.
Item, as toward that my said Lord the Cardinal desireth to be graunted him, to have such Captaines as he wil chose to Lede the Kings said Subgittes that shall goo out of this Land, the King is agreed that my said Lord the Cardinal shal Name to the King suche Persones here, as he wol desire to be Captaines; and yoo, that the King wol agree him, to Trete them in his best wyse.
Item, the Kyng agreeth him to that, that my said Lord the Cardinal, according to his Requeste, shall mow make to be proclamed in all Places of this Land, where as it shal be thought unto him expedient, what Wages he wol yeve to such as wol goo in the said Viage.
Item, the Kyng is agreed that my said Lord the Cardinal shal name to the Kyng suche as he wol desire to be Conestable and Mareschal of the Felauship of the King's said Subgittes, that shall Passe out of this Land; and that yoo, that the Kyng shall like to agree him to be thair Conestable and Mareschal, shul have Auctoritee and Power, of the Kyng, to Reule and Gouverne his said Poeple, and to Chastise and Punysshe theim that Disobeye or offende ayenst the Law of Armes.
Item, the Kyng is agreed that his said Subgittes of this Land, that, as it is before reherced, shul goo out of this Land to expose thair Persones in the saide Godd's Querele, shul stande in his Protection, with the Provision and in the manere and fourme conteined in answere, Yeven, upon the same, to Maister Cuntzo, sent unto the King from our holy Fadre the Pope.
Item, the King is agreed that th'Admiral, or his Deputes, shul have sufficeant Commandement and Charge to ordeigne and bring Shipping and Navie, sufficeant for Passage of the said People, at suche Ports and at such Tyme as it shall be advised, at suche Wages as the King yeveth for his owne Viages.
And, if it happe that the said Journee ayenst th'Eretickes, before reherced, holde not, for oo cause or other, that thanne the said Moneye, to be gadred, in noo wyse be employed to other use, without th'advis and assent of the King and his Conseil.
This Endenture,
Maad Betwix the King oure Souverain Lord on that oo partie, And, the moost Worshipful Fadre in God, Henry Cardinal of the Title of Seint Eusebee, named Cardinal of England, on that other Partie,
Witnesseth that,
At th'Instance, Reverence, and Requeste of oure Holy Fadre the Pope, and for the weele and defense of the Christien Feith,
Our said Souveraine Lord hath GEVEN and GRAUNTED his Licence Roiale and Assent to his Subgittes of this his Land,
To the Nombre of CC. L. Speres, and M. m. D. Bowes, or withinne at the Moderation of the said Cardinal,
For to passe out of this his said Land, in the Compaignie of the said Cardinal, for the Redduction or Chastisyng of the Heretikes in Boeme,
The which Licence before reherced, and also the Captainship and Leding of the foresaid Speres and Bowes, the King hath Graunted unto the forsaid Cardinal, and Maad, Ordeined, and Deputed him CAPITAINE and LEDER of them, with and under the Provisions that folowe.
First, that the said Cardinal shal effectuelly do al his devoir and diligence toward oure Holy Fadre the Pope, to that that he be Good and Tendre Fadre to the King oure Soverein Lord and to this his Land, and to the King's Subgitts of the same, and generally to all the King's Landes and Subgittes.
Item, that the said Cardinal shal sufficiently pourveye and ordeigne for the seure and save Passage of the Kings said Subgitts, out of this Land, to the saide Land of Boeme, and for the Repassage and Retourne of hem into the same, under the Rule, Governaille, and Leding of a Captaine or Captaines sufficeant and covenable therto; without that the said Cardinal shal assente, or, as ferforth as in him is, soeffre the King's forsaid Subgitts to be withholden, lad, or drawen to emploie them in eny other Werre or Service, save oonly to the Redduction or Chastising of the Heretikes of Boeme before reherced; except that the said Cardinal may, if it like him, take to accompanie him forth unto the Court of Rome CC. Persones of the Nombre before reherced.
Item, the forsaid Cardinale ne shall in eny wise moeve ne sture the King's Subgitts, that be nowe in his Reaume of France, entending there to the Defense and Savegarde of the same, nor, as ferforth as he may lette it, suffer eny other to sture or moeve them to departe or to withdrawe them out of the said Reaume of France, nor admitte ne receive them to goo from thens, with him, or his, in this present Viage.
Item, the forsaid Cardinal shal not take with him, ne seuffre to goo with him, out of this Land, in this his forsaid Passage, but to the Nombre before reherced, or withinne; the which shal Moustre hem self, before thair Departing, in the Presence of the King's Commissioners, that shal be Deputed therto: and their Names shul be retourned and brought in writing to the King's Conseil.
The which CAPITANSHIP and LEDYNG, in the manere, and forme, and under the Provisions before reherced, the said Cardinal hath take upon him, and, by thees presente ENDENTURES, Byndeth unto the King treuly and deuly, after the grace that God wol yeve him, to execute that that perteigneth to th'Office of the said CAPITAINSHIP, as ferforth as it may belang and accorde with his Estate,
And our said Souverain Lord Wol and Deolareth that neither the forsaid Cardinal, nor eny of his Executoures or Assignez, by vertue of thees ENDENTURES, be Bounde to eny maneres of Acconte, or to Answere or Assieth the King or his Heires of eny Thriddes, or other Gaines of Werre, or to eny Averrement as therefore.
In Witness of the whiche thing, to the Partie of this ENDENTURE, Remaigning towards the said Cardinal, oure saide Souverain Lord the King hath maad to be put to his Prive Seal.
